En effet, beaucoup de juristes, et surtout les positivistes, se reportent à la jurisprudence pour ce qui est de leur définition, la Constitution canadienne indiquant que ces droits ancestraux et issus de traités y " sont reconnus et confirmés ". Partant de l'idée que l'on ne peut reconnaître et confirmer que ce qui existe déjà, et que, par conséquent, c'est en deçà du droit canadien, dans le droit maintenu depuis la colonisation par les Autochtones du Québec - qui n'ont pas été conquis et ne sont pas soumis -, qu'il fallait chercher cette définition, on a visé à repérer les conceptions respectives des droits ancestraux dans chacune des onze nations autochtones vivant actuellement au Québec. Au-délà de la connaissance de ces droits, cela a permis de dégager un éventuel noyau commun permettant de mettre en rapport chaque corpus avec les traditions orales respectives, chaque fois qu'elles sont disponibles.

However, at a finer level of analysis multijuralism is a more widespread or common phenomenon and a more fluid reality than the civil law/common law distinction suggests. The papers in this study are therefore rooted in the latter frame of reference. They explore various types of multijural manifestations from the harmonizing potential of international treaties to indigenous law and the use of hard and soft pluralism. In addition, the authors consider the external events which are not part of the processes of multijural adjustment but which serve to influence these processes.
