Compliance wird häufig als Trend-Thema bezeichnet, da in Zeiten des schnellen Informationsaustausches Schlagzeilen bezüglich Korruption, wie beispielsweise Schmiergeldaffären oder der Abgasskandal, dem Thema ein immer größer werdendes Interesse zukommt. Compliance-Risiken sind schließlich in fast jedem Unternehmensbereich und Wirtschaftszweig ausfindig zu machen und deren Minimierung im Interesse sämtlicher Stakeholder und Shareholder eines Unternehmens.

Die Zahl der Skandale wächst und wird in den Medien öffentlich verurteilt. Dazu gehört der VW-Dieselskandal, menschenunwürdige Arbeitsbedingungen, Kinderarbeit, Korruption oder Preisabsprachen, um nur einige Beispiele zu nennen. Daher gewinnt das Thema Corporate Social Responsibility (CSR) immer mehr an Bedeutung. Die kritischen Blicke der Gesellschaft sowie von Kunden und Investoren verlangen nachhaltige Managementansätze, die mit den Unternehmenszielen und Produkten im Einklang stehen. Auch die Politik reagiert auf die lauter werdenden Forderungen und führte 2017 ein Gesetz zur Offenlegung des sozialen Engagements von deutschen börsennotierten Unternehmen ein. Bereits vorher stellten sich viele Unternehmen freiwillig dieser gesellschaftlichen Verantwortung. Andere wurden nur aktiv, wenn sie darin einen wirtschaftlichen Vorteil sahen oder setzten auf kurzfristige Aktivitäten, die keinerlei Berührungspunkte mit ihrem Geschäftsfeld aufwiesen, um die kritischen Stimmen zu beruhigen und das öffentliche Ansehen nicht zu verlieren.

Anschließend wird in Kapitel 5 mittels einer kritisch vergleichenden Analyse der Versuch eines Brückenschlags zwischen beiden Positionen unternommen. Weil Unternehmen in hohem Maße zur Verbesserung oder Verschlechterung der ökologischen, sozialen oder ökonomischen Situation einer Gesellschaft beitragen können, sind sie gleichzeitig Adressat großer Hoffnungen und Befürchtungen. In Anbetracht dieser Machtsituation zwischen privater Wirtschaft und Nationalstaaten steigen auch die Erwartungen an den Wirtschaftssektor vermehrt Verantwortung für gesellschaftliche Probleme zu übernehmen und das entstandene Machtvakuum gewissenhaft zu füllen. Eine Unternehmensethik in diesem Sinne ist dabei nicht frei von inneren Spannungen. Während der Staat über Steuern, Abgaben und die Erhöhung der Staatsverschuldung Einkommen generiert, muss der private Wirtschaftssektor zunächst einmal Gewinn erwirtschaften, um seinen dauerhaften Bestand zu sichern. Lange wurde deshalb die Verknüpfung von finanziellem Erfolg und der Übernahme von Verantwortung als ein Oxymoron bezeichnet. Man müsse sich eben entscheiden, entweder Gewinn oder Ethik. Nach dieser Lesart ist die Übernahme von Verantwortung den guten Zeiten vorbehalten, während in schlechten Zeiten die Moral schlicht nicht zu finanzieren ist. Im Bewusstsein dieses Problems haben sich zwei divergente Positionen zu CSR herausgebildet. Auf der einen Seite der sog. Business Case, der mittels einer ökonomischen Instrumentalisierung von moralischen Wertvorstellungen aus dem Kostenfaktor Ethik, einen Erfolgsfaktor Ethik machen will. Klug umgesetzte Ethik koste demnach kein Geld, sondern lasse sich vielmehr zum Motor des ökonomischen Erfolgs machen. Auf der anderen Seite steht der sog. Moral Case, der eingesteht: Ja, Ethik kostet Geld! Aber der private Wirtschaftssektor sei eben nicht nur der eigenen Gewinnmaximierung, sondern als gesellschaftliche Institution auch dem Gemeinwohl verpflichtet. Verantwortbar sei eben nicht der maximale, sondern der legitime Gewinn, welcher oftmals genügend Raum für ein erfolgreiches Wirtschaften lasse.
