Book Synopsis Cooperative Compliance by : Jeffrey Owens
Download or read book Cooperative Compliance written by Jeffrey Owens and published by Kluwer Law International B.V.. This book was released on 2021-08-18 with total page 152 pages. Available in PDF, EPUB and Kindle. Book excerpt: National taxation authorities around the world are rapidly improving international cooperation, given the unprecedented triple impact of persistent revelations of large-scale corporate tax avoidance, the ever-increasing intricacies of digital cross-border transactions, and the unprecedented revenue deficits engendered by the COVID-19 pandemic. There is also a growing recognition that improving tax compliance needs to be reconciled with a legitimate desire on the part of businesses to have some certainty about their taxes. Cooperative compliance is one way to achieve that. This first analysis of the details of cooperative compliance programmes currently in operation describes tax control frameworks, suggests practical examples to assist practitioners in tax administrations and the private sector, and provides multiple perspectives on the design and legitimacy of such programmes. Drawing on detailed information contributed by tax practitioners and academics from a wide range of jurisdictions worldwide, the book identifies and explains certain crucial elements of successful programmes: the criteria for access to cooperative compliance (e.g., is the programme voluntary or mandatory? Is there a financial threshold? Will the criteria be publicly available?); model legislation that can facilitate the operation of such programmes (statutory provisions, administrative rules and procedures, etc.); the foundations for an international agreement on an audit assurance standard for tax control frameworks (including the role of the Organisation for Economic Co-operation and Development (OECD), the European Union (EU), and other international organizations); how to develop a methodology to measure the cost and benefits of cooperative compliance programmes; detailed case studies of existing compliance programmes in Australia, Austria, China, Germany, Italy, Poland, and Russia; and how to communicate a cooperative compliance programme to obtain trust from society. The analysis draws on two years of work led by WU Global Tax Policy Center (GTPC) at Vienna University of Economics and Business in cooperation with the International Chamber of Commerce (ICC) and the Commonwealth Association of Tax Administrators (CATA). The project brought together over two hundred people from 25 countries, including public officials, businesses, and academics. Tax certainty and predictability are key components for providing a tax environment that is conducive to cross-border trade and investment, and, in the long term, it is in the interest of both governments and businesses to minimize tax uncertainty as much as possible. This truly helpful book promises to pave the way to an internationally effective tax framework that will be welcomed by taxation authorities and practitioners worldwide.

Book excerpt: Internet-based information systems, the second covering the large-scale in- gration of heterogeneous computing systems and data resources with the aim of providing a global computing space. Eachofthesefourconferencesencouragesresearcherstotreattheirrespective topics within a framework that incorporates jointly (a) theory, (b) conceptual design and development, and (c) applications, in particular case studies and industrial solutions. Following and expanding the model created in 2003, we again solicited and selected quality workshop proposals to complement the more "archival" nature of the main conferences with research results in a number of selected and more "avant-garde" areas related to the general topic of Web-based distributed c- puting. For instance, the so-called Semantic Web has given rise to several novel research areas combining linguistics, information systems technology, and ar- ?cial intelligence, such as the modeling of (legal) regulatory systems and the ubiquitous nature of their usage. We were glad to see that ten of our earlier s- cessful workshops (ADI, CAMS, EI2N, SWWS, ORM, OnToContent, MONET, SEMELS, COMBEK, IWSSA) re-appeared in 2008 with a second, third or even ?fth edition, sometimes by alliance with other newly emerging workshops, and that no fewer than three brand-new independent workshops could be selected from proposals and hosted: ISDE, ODIS and Beyond SAWSDL. Workshop - diences productively mingled with each other and with those of the main c- ferences, and there was considerable overlap in authors.

Book Synopsis International Climate Change Law and State Compliance by : Alexander Zahar
Download or read book International Climate Change Law and State Compliance written by Alexander Zahar and published by Routledge. This book was released on 2014-12-17 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: A solution to the problem of climate change requires close international cooperation and difficult reforms involving all states. Law has a clear role to play in that solution. What is not so clear is the role that law has played to date as a constraining factor on state conduct. International Climate Change Law and State Compliance is an unprecedented treatment of the nature of climate change law and the compliance of states with that law. The book argues that the international climate change regime, in the twenty or so years it has been in existence, has developed certain normative rules of law, binding on states. State conduct under these rules is characterized by generally high compliance in areas where equity is not a major concern. There is, by contrast, low compliance in matters requiring a burden-sharing agreement among states to reduce global greenhouse gas emissions to a ‘safe’ level. The book argues that the substantive climate law presently in place must be further developed, through normative rules that bind states individually to top-down mitigation commitments. While a solution to the problem of climate change must take this form, the law’s development in this direction is likely to be hesitant and slow. The book is aimed at scholars and graduate students in environmental law, international law, and international relations.
Book Synopsis Between Compliance and Particularism by : Marton Varju
Download or read book Between Compliance and Particularism written by Marton Varju and published by Springer. This book was released on 2019-02-08 with total page 347 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book examines how the interests of the member states, which provide the primary driving force for developments in European integration, are internalised and addressed by the law of the European Union. In this context, member state interests are taken to mean the policy considerations, economic calculations, local socio-cultural factors, and the raw expressions of political will which shape EU policies and determine member state responses to the obligations arising from those policies. The book primarily explores the junctions and disjunctions between member state interests defined in such a manner and EU law, where the latter expresses either an obligation for the member states to comply with common policies or an acceptance of member state particularism under the common EU framework.
