Book excerpt: Excerpt from The Principles and Forms of Practice in Civil Actions in Courts of Record Under the Codes of Procedure, Vol. 1: Adapted Also to Common Law and Equity Practice If my experience of the needs of a practitioner is like that of others, what is needed in a book of practice is not so much a survey of general principles, nor a compend of authorities, as a practical statement of the existing powers and usages of the courts in each of the various stages of litigation. My object in this work has therefore been to exhibit the powers of the court (common law, equitable, and statutory), as they are seen, so to speak, in motion, in the actual litigation of to-day. Book excerpt: Excerpt from The Principles and Forms of Practice in Civil Actions in Courts of Record, Under the Codes of Procedure Adapted Also to Common Law and Equity Practice, Vol. 2 It will be seen that I have given special attention to elucidating what is still called Equity Practice. The Codes, while pruning away the redundancies and verbiage of the old chancery forms, have sanctioned them, in substance, to a far greater extent than many young practitioners suppose; and these Forms now consti tute remedies of singular value and efficiency; although the proper adaptation of them to the modern methods is not easily learned. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Principles of Pleading in Civil Actions: Under the Common-Law System and as Modified and Applied Under Modern Codes and Practice Acts, Introduced by a Summary View of the Proceedings in Legal Actions Stephen on Pleading is one of the great works in English law. Common-law pleading stands forth in it in its finished form. It places Mr. Stephen in the foremost rank of juridical thinkers. Besides its theoretic excellence, exhibiting the principles of pleading cohering in a logical system, the work is rendered eminently practical by introducing a summary and connected account of the whole proceedings in a suit, in which the end that pleading subserves in litigation, and the forms through which it works, are distinctly presented. This edition of the work has been prepared especially for American students of law. It is, nevertheless, as will be presently seen, the best edition for the practicing lawyer. In the year 1824 Mr. Stephen published the first edition of his work. In the year 1827 he published the second edition; and in the advertisement to that edition says: "This work, as its title imports, is in its main design elementary and institutional, and intended for the use rather of those who are exploring the principles, than of those who are engaged in the practice of pleading. But as there is reason to believe that it has proved in some measure acceptable to the latter class of readers also, the author has endeavored to adapt it better to their purposes, by introducing into this second edition some additional matter of a practical kind. This is contained, however, for the most part, in notes at the foot of the page, and does not at all derange or in any degree affect the original plan of the work. "With the same view the index has been considerably enlarged and a table of cases prefixed." In this second edition Mr. Stephen gave his matured view of the system of common-law pleading, and never attempted to do anything more towards making it more complete. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Cases on Civil Procedure: Selected and Annotated The purpose of this volume is to point out through selected cases, the principal problems of civil procedure, to explain how they were approached at common law and to indicate how they are com mouly dealt with in modern courts. Such a course it is believed will not only prepare the student for the more intelligent study of the procedure of the state in which he expects to practice, but will also assist him in those branches of substantive law that are rooted in procedure. It is hoped, too, that in schools where the local practice alone is taught and in the ofiice, preceptor and student may find here material useful for comparative study. Indeed, as the practice of the law tends in this country to extend beyond state boundaries, it becomes increasingly dangerous to restrict one's information to the methods of a single locality. While one can hardly expect to become expert in the daily routine of courts other than those in which his life's work is centered, a broad comprehensive view of the more im portant points upon which a diversity of practice may be anticipated is an equipment not to be despised. Book excerpt: Excerpt from The Principles of Pleading in Civil ActionsIT has been remarked by high authority that if the practice of Special Pleading were entirely banished from the courts, the science of Pleading would still be the most instructive branch of the Common Law.1 Therefore every student should learn to plead, accord ing to the laws of Special Pleading. The science should be studied and carried into practice, although the penalties attending an infringement of its strict rules have been most properly mitigated.About the PublisherForgotten Books publishes hundreds of thousands of rare and classic books.
