This is not just an important change in the way we live in modern Britain; it is also a political and theoretical marker. Some commentators see cohabitation as evidence of selfish individualism and the breakdown of the family, while others see it as just a less institutionalised way in which people express commitment and build their families. Politically, 'stable' families are seen as crucial - but does stability simply mean marriage? At present the law in Britain retains important distinctions in the way it treats cohabiting and married families and this can have deleterious effects on the welfare of children and partners on cohabitation breakdown or death of a partner. Should the law be changed to reflect this changing social reality? Or should it - can it - be used to direct these changes? Using findings from their recent Nuffield Foundation funded study, which combines nationally representative data with in-depth qualitative work, the authors examine public attitudes about cohabitation and marriage, provide an analysis of who cohabits and who marries, and investigate the extent and nature of the 'common law marriage myth' (the false belief that cohabitants have similar legal rights to married couples). They then explore why people cohabit rather than marry, what the nature of their commitment is to one another and chart public attitudes to legal change. Book excerpt: Imaginative Resistance, Queer Fiction and the Law develops a novel account of how heteronormative sociolegal orders undermine the well-being of same-sex attracted people, even when these normative orders may fall short of coercively interfering with their choices. Queer well-being is generally studied from psychological perspectives, through the concept of ‘minority stress.’ Taking four texts of mid-century Anglo-American queer fiction as illustrative case studies, this book argues – in a philosophical rather than a psychological register – that heteronormativity also affects queer well-being in more intangible ways. The central claim is that heteronormativity shackles the imagination: it curtails no less the imaginative reach of authors of queer fiction, than our ability – engaged as we are in projects of self-authorship – to make-believe personal futures in which same-sex intimacy is brought to bear on our well-being. The book’s central claim re-works a concept central to the philosophy of fiction – ‘imaginative resistance’ – and puts it into service of questions raised in moral philosophy. Apart from its political and normative implications – strengthening the case for at least some global gay rights – and from challenging some of queer theory’s orthodoxies, the book also makes contributions to queer literary history, criticism and biography. Drawing on archival material and personal interviews, fresh readings are offered of Charles Jackson’s The Fall of Valor (1946), Gillian Freeman’s The Leather Boys (1961), and Patricia Highsmith’s The Price of Salt (1952) and The Talented Mr Ripley (1955), making a case for their inclusion in the queer literary canon. As an acquaintanceship turns into a friend ship, for example, both members of this newly formed interpersonal bond are likely to expect that their interactions will become increasingly frequent, diverse, and intimate over time. This expectation is perhaps most apparent in romantically involved couples who, through a variety of verbal and symbolic means, make explicit pledges to a long-lasting relationship. In either case, it is clear that these relationships represent something valuable to the individuals in volved and are pursued with great enthusiasm. Virtually all close relationships are formed within the context of mutually rewarding in teractions and/or strong physical attraction between partners. Friends and romantically in volved couples alike are drawn to one another because of similarity of attitudes, interests, and personality and, quite simply, because they enjoy one another's company. This enjoyment, cou pled with the novelty that characterizes new relationships, almost makes the continuation of the relationship a foregone conclusion. As relationships progress, however, their novelty fades, conflicts may arise between partners, negative life events may occur, and the satisfaction that previously characterized the relationships may diminish.
