Book Synopsis Digital Copyright by : Jessica Litman

Book excerpt: Professor Litman's work stands out as well-researched, doctrinally solid, and always piercingly well-written.-JANE GINSBURG, Morton L. Janklow Professor of Literary and Artistic Property, Columbia UniversityLitman's work is distinctive in several respects: in her informed historical perspective on copyright law and its legislative policy; her remarkable ability to translate complicated copyright concepts and their implications into plain English; her willingness to study, understand, and take seriously what ordinary people think copyright law means; and her creativity in formulating alternatives to the copyright quagmire. -PAMELA SAMUELSON, Professor of Law and Information Management; Director of the Berkeley Center for Law & Technology, University of California, BerkeleyIn 1998, copyright lobbyists succeeded in persuading Congress to enact laws greatly expanding copyright owners' control over individuals' private uses of their works. The efforts to enforce these new rights have resulted in highly publicized legal battles between established media and new upstarts. In this enlightening and well-argued book, law professor Jessica Litman questions whether copyright laws crafted by lawyers and their lobbyists really make sense for the vast majority of us. Should every interaction between ordinary consumers and copyright-protected works be restricted by law? Is it practical to enforce such laws, or expect consumers to obey them? What are the effects of such laws on the exchange of information in a free society?Litman's critique exposes the 1998 copyright law as an incoherent patchwork. She argues for reforms that reflect common sense and the way people actually behave in their daily digital interactions. This paperback edition includes an afterword that comments on recent developments, such as the end of the Napster story, the rise of peer-to-peer file sharing, the escalation of a full-fledged copyright war, the filing of lawsuits against thousands of individuals, and the June 2005 Supreme Court decision in the Grokster case.Jessica Litman (Ann Arbor, MI) is professor of law at Wayne State University and a widely recognized expert on copyright law.
Book Synopsis The EU Maritime Safety Policy and International Law by : Henrik Ringbom
Download or read book The EU Maritime Safety Policy and International Law written by Henrik Ringbom and published by BRILL. This book was released on 2008-09-30 with total page 620 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book offers a comprehensive international law analysis of the European Union’s maritime safety legislation. This is a relatively novel field of activity of the EU, but its development has been very rapid. Since 1993, over 40 acts of EU law have been adopted, dealing with a variety of subjects, such as port State control, classification societies, vessel traffic management, ship construction, environmental protection and pollution sanctions. This legislation is analysed from the point of international law, notably the law of the sea and the international maritime conventions. Regional legislation in a field that is traditionally regulated primarily by means of international conventions is bound to create tensions with the related international conventions and with well-established principles of international law. This study assesses how the EU has acted as a flag State, port State and coastal State and measures the trends in this development against the international legal framework. More detailed legal analyses are offered for specific aspects of EU legislation that are considered to be particularly interesting from an international law point of view. The relationship between EU law and international law within the internal EU legal system is also analysed from the specific perspective of maritime safety law.

Book Synopsis Intellectual Property Rights by : Nikolaus Thumm
Download or read book Intellectual Property Rights written by Nikolaus Thumm and published by Springer Science & Business Media. This book was released on 2013-03-09 with total page 169 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the result of the PhD project I started four years ago at Europa-Kolleg Hamburg. I had the great opportunity to work on it for one year at the European University Institute in Florence and to finalise the oeuvre during my stay with the European Commission's Institute for Prospective Technological Studies in Seville. The subject matter of the book is intellectual property rights, patents in particular, and their process of harmonisation in Europe. At the beginning of the work, the intention was not to focus immediately on one narrow field in the huge realm of intellectual property rights but rather to open my mind in order to capture a broad variety of new ideas and concepts in the book. The work at three different institutes in three different European countries over the period of four years naturally exposed the work to diverging ideas and the exchange of views with many people. This is one reason for the wide spread of topics ordered around the given leitmotif, such as epistemological foundations, political background information,. the protection of biotechnological inventions and the building up process of intellectual property right systems in the countries of Central and Eastern Europe. In chapter two I take up Polanyi's differentiation of codifiable and tacit knowledge. Applying these concepts to my own work I realise that this book is only the visible and codified part of knowledge I was able to capture.
Book Synopsis EU Cohesion Policy and European Integration by : Mr Carlos Mendez
Download or read book EU Cohesion Policy and European Integration written by Mr Carlos Mendez and published by Ashgate Publishing, Ltd.. This book was released on 2014-01-28 with total page 523 pages. Available in PDF, EPUB and Kindle. Book excerpt: EU Cohesion policy accounts for a major share of the EU budget and is central to economic and social development in many European countries. This book provides a comprehensive and theoretically-informed analysis of how Cohesion policy has evolved over time, in particular the budgetary and policy dynamics of the 2007–13 reform. In the context of the budgetary politics of the EU, the book examines the process by which the reform of Cohesion policy has been shaped; it identifies the key factors that explain the allocation of funding, assesses the roles of the Member States, European Commission and European Parliament, and tests whether the process and outcome are consistent with the expectations of EU decision-making and integration theories. Based on extensive, EU-wide research over a ten-year period, the book provides new insights into both the process and outcomes of EU policy reform. Presenting original research in an accessible format, this book will be of interest to scholars as well as undergraduate and postgraduate students in the fields of European integration and policy studies.
Book Synopsis Search Engine Freedom by : Joris van Hoboken
Download or read book Search Engine Freedom written by Joris van Hoboken and published by Kluwer Law International B.V.. This book was released on 2012-10-01 with total page 654 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, the author explores how search media can be incorporated into freedom of expression doctrine, as well as media and communications law and policy more generally. And the book develops a theory of the legal relations between national governments and search media providers on the one hand and between end-users and information providers on the other. Among the many issues covered are the following: role of government under the right to freedom of expression; lack of transparency about the ranking and selection of search results; search engine and ISP intermediary liability; filtering by access providers; freedom of expression and the governance of public libraries; the search engine market, its business model and the separation rule for advertising; search engine self-regulation; user profiling and personalization; decisions and actions for which search engines should be able to claim protection. The analysis draws on specific legal developments under Article 10 of the European Convention on Human Rights and the United States First Amendment, and investigates issues of diversity, pluralism, and freedom of expression as they relate to editorial control in other media. The author concludes with recommendations regarding search engine governance and the proper role of government, indicating which existing elements of the regulatory framework for search media can be improved and offering directions for future legal and empirical research. Considering the ever-growing cultural, political, and economic importance of the Internet and the World Wide Web in our societies, and the societal interests involved in the availability of effective search tools, this first in-depth legal analysis of search engine freedom will prove indispensable to the many practitioners and policymakers concerned with freedom of expression in the digital age.

Book Synopsis Social Inclusion and Economic Development in Latin America by : Mayra Buvinić
Download or read book Social Inclusion and Economic Development in Latin America written by Mayra Buvinić and published by IDB. This book was released on 2004 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: Poverty and inequality in Latin America are easily recognizable in the faces of women, Afro-descendents, the indigenous, people with disabilities, victims of HIV/AIDS, and other groups outside the societal mainstream. Social Inclusion and Economic Development in Latin America reviews the common features of these excluded populations, including their invisibility in official statistics and the stigma, discrimination, and disadvantages they have long endured. But it also examines the region's inclusionary policies and programs that can improve access by these groups to the quality social services and economic and political resources these groups need to level the playing field. Case studies examine ethnic and racial political organization, gender quotas, and labor markets across the region, and social exclusion in Brazil, Honduras, Guatemala, Mexico, and Peru. Comparative studies summarize social inclusion policies of both the European Union and selected countries on the Continent.
