Book Synopsis The EU's Shifting Borders by : Klaus Bachmann
Download or read book The EU's Shifting Borders written by Klaus Bachmann and published by Routledge. This book was released on 2012-03-12 with total page 293 pages. Available in PDF, EPUB and Kindle. Book excerpt: The EU’s internal borders have become mostly invisible. Today, external borders are at the centre of controversy about an alleged 'fortress Europe'. Using different theoretical and methodological perspectives this book examines the challenges facing the EU’s external borders, including Neighborhood Policy, migration issues and the diffusion of norms and values to other countries. Divided into two parts, the book first presents different theoretical approaches and empirical studies of the EU’s external borders, mobility and security issues. It is an invaluable guide to border research within a framework of European Integration and Globalization Studies. The second part of this volume focuses on the analyses of the EU’s Neighbourhood Policy, the approach to Eastern Europe and EU energy policy. Expert contributors collaborate to explore debates about migration, the EU as a normative, 'civil' power, energy security and the securitization of borders. Highly relevant and insightful, the text provides a timely assessment of EU borders in an increasingly globalized and integrated European neighbourhood. The EU's Shifting Borders will be of interest to students and scholars of European Union Politics and International Relations.

Book Synopsis Judicial Protection in the European Union by : Henry G. Schermers
Download or read book Judicial Protection in the European Union written by Henry G. Schermers and published by Kluwer Law International B.V.. This book was released on 2001-12-20 with total page 922 pages. Available in PDF, EPUB and Kindle. Book excerpt: Appearing at a time when the ancient problem of the individual versus the state once again occupies the minds of thinking Europeans, this important new book thoroughly evaluates the judicial system of the European Union, fully describing the nature of the judicial protection available to individuals, undertakings, and member States. With attention to the rapid and continuing development of the Community legal order, Schermers and Waelbroeck provide a much-needed perspective on the reasoning of the European Court of Justice in significant decisions, especially recent cases, and shed revealing light on how the rule of law may develop in future. An introductory chapter offers a masterful description of how Treaty provisions, Community acts, international law, and national legal orders interact in the procedures and decisions of the Court of Justice. Further chapters provide analysis and insight into such matters as the following: the crucial role of national courts as guarantors of the rights of individuals in Community law the validity of acts taken by Community institutions and member States, and protection against them the delivery of non-judicial opinion and other tasks of the Court of Justice the composition, function, and rules of procedure of the Court the organisation of the Court of First Instance and the appeal procedure against its decisions. Judicial Protection in the European Union is organised to facilitate its prodigious reference value. All important cases are examined, and abundant footnotes clearly indicate relevant precedents in each case. This is a fundamental source for students of European law, as well as a basic reference for practitioners and a valuable analysis of the strengths and weaknesses of the European system of judicial protection.

Book Synopsis The Internet and the Emerging Importance of New Forms of Intellectual Property by : Susy Frankel
Download or read book The Internet and the Emerging Importance of New Forms of Intellectual Property written by Susy Frankel and published by Kluwer Law International B.V.. This book was released on 2016-05-01 with total page 452 pages. Available in PDF, EPUB and Kindle. Book excerpt: The term ‘intellectual property’ has come to include numerous intangible rights beyond the traditional ‘Big Three’ (patent, trademark and copyright) – rights that force us to reconsider and maybe also change the object and purpose of intellectual property (IP). Not only do these rights generally have less solid normative footing and few if any well understood inherent limits, but the borders of their misappropriation are hard to draw. This groundbreaking book scrutinizes the existence of commonalities in this realm, and poses the question of what risks and advantages accrue to such IP or ‘IP-like’ rights. Sixteen distinguished contributors offer in-depth analyses of such rights as the following: - trade secrets; - image and publicity rights; - geographical indications; - traditional knowledge; - protection of databases; and - sports rights and ambush marketing. Recommendations and solutions investigated include the use of specialized courts or judges and of private standards. There are also thoughtful considerations of practices such as forum-shifting and an analysis of the special value of evolving Chinese law as a ‘norm laboratory’. Two chapters discuss the complexities of enforcement. Enforcement impacts substantive intellectual property and can be said to be its own ‘form’ of IP. Practitioners, judges, academics, and policymakers will all welcome this work and value it highly. Its contributors collectively take a giant step toward clarifying and synthesizing one of the most baffling areas of current law both internationally and at national level around the globe.

Book Synopsis Byzantium by : Metropolitan Museum of Art (New York, N.Y.)
Download or read book Byzantium written by Metropolitan Museum of Art (New York, N.Y.) and published by Metropolitan Museum of Art. This book was released on 2004 with total page 682 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fall of the Byzantine capital of Constantinople to the Latin West in 1204 during the Fourth Crusade abruptly interrupted nearly nine hundred years of artistic and cultural traditions. In 1261, however, the Byzantine general Michael VIII Palaiologos triumphantly re-entered Constantinople and reclaimed the seat of the empire, initiating a resurgence of art and culture that would continue for nearly three hundred years, not only in the waning empire itself but also among rival Eastern Christian nations eager to assume its legacy. Byzantium: Faith and Power (1261–1557), and the groundbreaking exhibition that it accompanies, explores the artistic and cultural flowering of the last centuries of the "Empire of the Romans" and its enduring heritage. Conceived as the third of a trio of exhibitions dedicated to a fuller understanding of the art of the Byzantine Empire, whose influence spanned more than a millennium, "Byzantium: Faith and Power (1261–1557)" follows the 1997 landmark presentation of "The Glory of Byzantium," which focused on the art and culture of the Middle Byzantine era—the Second Golden Age of the Byzantine Empire (843–1261). In the late 1970s, "The Age of Spirituality" explored the early centuries of Byzantium's history. The present concluding segment explores the exceptional artistic accomplishments of an era too often considered in terms of political decline. Magnificent works—from splendid frescoes, textiles, gilded metalwork, and mosaics to elaborately decorated manuscripts and liturgical objects—testify to the artistic and intellectual vigor of the Late and Post-Byzantine era. In addition, forty magnificent icons from the Holy Monastery of Saint Catherine, Sinai, Egypt, join others from leading international institutions in a splendid gathering of these powerful religious images. While the political strength of the empire weakened, the creativity and learning of Byzantium spread father than ever before. The exceptional works of secular and religious art produced by Late Byzantine artists were emulated and transformed by other Eastern Christian centers of power, among them Russia, Serbia, Bulgaria, and Cilician Armenia. The Islamic world adapted motifs drawn from Byzantium's imperial past, as Christian minorities in the Muslin East continued Byzantine customs. From Italy to the Lowlands, Byzantium's artistic and intellectual practices deeply influenced the development of the Renaissance, while, in turn, Byzantium's own traditions reflected the empire's connections with the Latin West. Fine examples of these interrelationships are illustrated by important panel paintings, ceramics, and illuminated manuscripts, among other objects. In 1557 the "Empire of the Romans," as its citizens knew it, which had fallen to the Ottoman Turks in 1453, was renamed Byzantium by the German scholar Hieronymus Wolf. The cultural and historical interaction and mutual influence of these major cultures—the Latin West and the Christian and Islamic East—during this fascinating period are investigated in this publication by a renowned group of international scholars in seventeen major essays and catalogue discussions of more than 350 exhibited objects.
Book Synopsis Colonel Joseph Bampfield's Apology by : Joseph Bampfield
Download or read book Colonel Joseph Bampfield's Apology written by Joseph Bampfield and published by Bucknell University Press. This book was released on 1993 with total page 326 pages. Available in PDF, EPUB and Kindle. Book excerpt: "This book consists of two parts of approximately equal length: Colonel Joseph Bampfield's Apology (1685), edited by John Loftis and Paul H. Hardacre; and a biographical account, Bampfield's Later Career, by John Loftis. Bampfield's Apology provides an account of the author's war service and his subsequent service to Charles I as a courier and agent in the period of frustrated negotiations that led to the second civil war and the execution of the king. Bampfield describes Charles's negotiations with parliament, with the army, with commissioners representing the Scots, and he describes the attempt by the king and leaders of Parliament to reach agreement in the Treaty of Newport before Cromwell's army returned from the north, after defeating the Scottish army. Although the narrative is partisan, it is (except in rare instances) factually accurate. Bampfield prints ten letters written to him by the king, not published elsewhere, for which there is convincing external as well as internal evidence of authenticity." "As long ago as 1894, C. H. Firth wrote that Bampfield's "biographical 'Apology,' published at The Hague in 1685, is a book of the utmost rarity, and deserves reprinting." Yet the Apology has never before been reprinted, presumably because of Bampfield's reputation as a spy for the protectorate." "The Apology is primarily a memoir of the reign of Charles I. Bampfield, twenty-six at the time of the king's death, lived many more years, many of them years of vigorous and varied activities. These years are recounted in the second half of this volume, Bampfield's Later Career. The biographical record provided by the Apology, and corroborated by the Memoirs of Anne, Lady Halkett, can be supplemented by Bampfield's voluminous correspondence, published and unpublished, in both French and English. Bampfield wrote most of the letters as intelligence reports. Though they include only incidental references to his personal activities, cumulatively they provide a detailed account of his life, and an informed commentary on national and international affairs as well."--BOOK JACKET.Title Summary field provided by Blackwell North America, Inc.
