Book excerpt: In 2001, the European Commission published its so-called Ports Package, a first attempt at developing a European policy for seaports. The Ports Package includes a Directive on Market Access to Port Services, which will influence the port industry thoroughly and lead to fundamental changes in daily port operations. In this volume, academics as well as practising lawyers from France, Ireland, Italy and Belgium describe the legal framework for the several branches of the port sector, recalling the far-reaching practical implications of existing general EU law and discussing the latest versions of the Port Services Directive proposal. Completed by authoritative views from the head of the Commission's ports unit, a specialist MEP, and representatives from both the public and the private port sector, this book offers a fairly complete overview of existing port law as well as the main points of concern in the policy debate. Its purpose is to serve both as a policy background document and as a working tool for public and private port players, as well as for academics and lawyers.

Available in PDF, EPUB and Kindle. Book excerpt: This twelfth volume of Correspondence contains authoritative and fully annotated texts of all known letters sent both to and from Bentham between July 1824 and June 1828. The 301 letters, most of which have never before been published, have been collected from archives, public and private, in Britain, the United States of America, Switzerland, France, Japan, and elsewhere, as well as from the major collections of Bentham Papers at University College London Library and the British Library. In mid-1824 Bentham was still preoccupied with the Greek struggle for independence against Turkey, though his active involvement waned as he became disenchanted with the behaviour of the deputies sent to London by the Greek National Assembly. His international reputation was reflected in his continuing contact with Simón Bolívar and Bernardino Rivadavia in South America, and with John Quincy Adams, John Neal, Henry Wheaton, and others in the United States, and his forging of new contacts in Guatemala, India, and Egypt. In the autumn of 1825 he visited France, where he stayed with Jean Baptiste Say and La Fayette, and was fêted by the French liberals. Bentham made considerable progress drafting material for his pannomion, or complete code of laws, and in particular for his Constitutional and Procedure Codes, while John Stuart Mill edited the massive Rationale of Judicial Evidence. Bentham became increasingly active in the cause of law reform, and exchanged a series of letters on the subject with Robert Peel, the Home Secretary, and Henry Brougham. He maintained his friendships with John and Sarah Austin, George and Harriet Grote, James and John Stuart Mill, John Bowring, Joseph Hume, Francis Burdett, Francis Place, and Joseph Parkes, re-established contact with the third Marquis of Lansdowne, son of his old friend the first Marquis, and made new acquaintances in James Humphreys, Sutton Sharpe, and Albany Fonblanque.

Available in PDF, EPUB and Kindle. Book excerpt: Comprising five microhistories, this book proposes that the French Revolution’s religious politics in small towns weakened democratic society to such an extent that it precluded political democracy. It details two revolutionary dynamics that damaged the civic life of small towns: social polarisation and the loss of local institutions that had been a source of social capital as well as a common good. Detailed narratives about Pont-à-Mousson, Gournay-en-Bray, Vienne, Haguenau and Is-sur-Tille also reveal that contrary to the view upheld by many scholars, small-town religious politics extended far beyond the pivotal Ecclesiastical Oath of 1791. Other developments — the nationalisation of Church property, the dissolution of religious orders, and the elimination of bishoprics, chapters, parishes and collegial churches — also adversely affected the wellbeing of these small urban communities not only in the Revolution but also in the two centuries that followed.

Available in PDF, EPUB and Kindle. Book excerpt: Reinterpreting the Haitian Revolution as both an islandwide and a circum-Caribbean phenomenon, Graham Nessler examines the intertwined histories of Saint-Domingue, the French colony that became Haiti, and Santo Domingo, the Spanish colony that became the Dominican Republic. Tracing conflicts over the terms and boundaries of territory, liberty, and citizenship that transpired in the two colonies that shared one island, Nessler argues that the territories' borders and governance were often unclear and mutually influential during a tumultuous period that witnessed emancipation in Saint-Domingue and reenslavement in Santo Domingo. Nessler aligns the better-known history of the French side with a full investigation and interpretation of events on the Spanish side, articulating the importance of Santo Domingo in the conflicts that reshaped the political terrain of the Atlantic world. Nessler also analyzes the strategies employed by those claimed as slaves in both colonies to gain liberty and equal citizenship. In doing so, he reveals what was at stake for slaves and free nonwhites in their uses of colonial legal systems and how their understanding of legal matters affected the colonies' relationships with each other and with the French and Spanish metropoles.
