Book excerpt: El 1 de enero de 2016 empezó a regir para todo el territorio nacional el Código General del Proceso. Dicha implementación fue lograda de manera gradual mediante la expedición de acuerdos por parte del Consejo Superior de la Judicatura, en el campo civil. Sin embargo, con anterioridad a dicha fecha, este estatuto ya empezó a aplicarse como norma supletoria en los procesos contencioso-administrativos y algunos llevados por autoridades administrativas en ejercicio de funciones jurisdiccionales. Igualmente, la Corte Constitucional tuvo la oportunidad de emitir algunos pronunciamientos alrededor de la constitucionalidad de varias normas contenidas en este Código. Por esta razón la Universidad Externado de Colombia y su Departamento de Derecho Procesal ofrecen esta segunda edición del Código General del Proceso comparado con el Código de Procedimiento Civil. En esta segunda edición, además del ya conocido Código comparado, podrán encontrarse como anexos: la referencia concreta a los pronunciamientos de constitucionalidad realizados por la Corte Constitucional sobre algunas normas del Código General del Proceso; los diversos acuerdos expedidos por el Consejo Superior de la Judicatura que dieron implementación al Código General del Proceso; el Decreto 1736 de 2012 y su fe de erratas, por medio de los cuales se introducen algunas modificaciones al Código General del Proceso; la Ley 1561 de 2012, por la que se establece un proceso verbal especial para otorgar títulos de propiedad al poseedor material de bienes inmuebles urbanos y rurales de pequeña entidad económica, sanear la falsa tradición y se dictan otras disposiciones; así como nuevas herramientas de consulta que facilitan la labor de comparación. Al final del texto, el lector podrá encontrar un índice normativo en el cual ubicará de manera más expedita las páginas donde están las normas del Código de Procedimiento Civil, según su artículo equivalente en el Código General del Proceso.

La Universidad Externado de Colombia y su Departamento de Derecho Procesal de la Facultad de Derecho, conscientes de la trascendencia que para la comunidad jurídica nacional representa la derogatoria del Código de Procedimiento Civil y la expedición del Código General del Proceso (asi como del Decreto 1736 del 17 de agosto de 2012 que supuestamente corrigió algunos yerros), ofrece esta publicación, con la que se pretende facilitar la lectura de ambos estatutos y comprender la dimensión de la ambiciosa y trascendental reforma. En efecto, en las páginas de este libro se registran enfrentados a doble columna el Código de Procedimiento Civil y el Código General del Proceso, de manera que, en la medida de lo posible, el lector pueda comparar los cambios sufridos en cada disposición. Como no todas las disposiciones del Código General del Proceso encuentran coincidencia con las del Código de Procedimiento Civil, no fue posible realizar las comparaciones en todo el articulado. No obstante, cuando la concordancia ha de hacerse respecto de una norma que existía pero no en el Código de Procedimiento Civil, se ha tomado la precaución de citar la disposición pertinente, así haga parte de otro estatuto. Asimismo, al final se incluye un anexo que contiene completa información sobre las normas o apartes de algunas disposiciones que han sido derogadas, de manera que también puedan consultarse rápidamente las mismas. En este documento adjunto se precisan las normas que se han derogado íntegramente y también aquellas de las que se han derogado algunos de sus apartes, de manera que la consulta resulte expedita.
