Il volume si presenta suddiviso in varie parti rispettivamente dedicate: all’esame specifico dei nuovi meccanismi istituzionali che governano il complesso fenomeno delle ispezioni e della vigilanza in materia di sicurezza sul lavoro alle linee di sviluppo del nuovo apparato sanzionatorio così come individuato dal d.lgs. n. 81/2008 e successivamente modificato dal d.lgs. 106/2009, con particolare riferimento: al procedimento ispettivo e sanzionatorio, amministrativo e penale, ai limiti di applicabilità dei poteri degli organi di vigilanza (prescrizione, disposizione, diffida), alla lettura dell’apparato punitivo fra contravvenzioni e sanzioni amministrative, alla responsabilità diretta dell’ente, alle condizioni di estinzione agevolata dell’illecito, all’esercizio dei diritti della persona offesa all’analisi dell’apparato sanzionatorio e alla puntuale individuazione di tutte le ipotesi sanzionatorie previste dal nuovo testo unico, anche mediante apposite tabelle che individuano: la fattispecie illecita, la reazione punitiva, le forme di estinzione agevolata dell’illecito Infine viene proposta: la normativa e la prassi amministrativa di principale rilievo, accanto alla modulistica riguardante le fasi principali del procedimento sanzionatorio penale e amministrativo.

Book excerpt: Nel nostro Paese, negli ultimi venti anni, la normativa relativa agli appalti di lavori pubblici ha avuto una continua evoluzione per la necessità di dover recepire le direttive emanate dalla Unione europea. A livello nazionale si è cercato inoltre di contrastare la piaga del lavoro nero ed irregolare, il rischio di infiltrazioni mafiose e di coordinare la normativa sugli appalti con quella relativa alla tutela della salute e della sicurezza nei cantieri. Per quanto riguarda specificatamente la parte esecutiva dei lavori è sempre stato molto utilizzato, sia per i lavori pubblici che privati, l’istituto del subappalto che può assumere forme diversificate come cottimo, nolo a caldo ed a freddo, fornitura a piè d’opera e con posa in opera. Nel testo si è cercato prima di tutto di evidenziare le numerose modifiche che, relativamente alle diverse forme di subappalto, sono state introdotte dal Codice appalti (D.Lgs. 50/2016, come modificato dal D.Lgs. 56/2017) e dalle linee guida ANAC già pubblicate. Sono state riportate anche le modalità di utilizzo dell’istituto dell’avvalimento che, malgrado sia possibile utilizzare da parecchi anni, è ancora poco conosciuto anche dagli addetti ai lavori e che consente ad un operatore che intende partecipare ad una gara di appalto pubblica e che non possiede tutti i requisiti richiesti dal bando, di “avvalersi” dei requisiti e delle capacità di altri soggetti. Nel complesso il nuovo Codice appalti ha previsto, a carico delle stazioni appaltanti, numerosi e precisi obblighi di controllo nei riguardi delle imprese affidatarie che utilizzano subappalti e avvalimenti, al fine di assicurare il corretto svolgimento dei lavori e di evitare contestazioni e ricorsi da parte delle imprese esecutrici e sanzioni da parte dell’ANAC. Nel volume sono riportate numerose sentenze del Consiglio di Stato, del TAR e di Cassazione che sono utili per chiarire le modalità di corretta applicazione degli articoli del Codice.
