The authors argue that in most of the prevalent conceptualizations the conflict dimension of civil society is either downplayed or inadequately addressed. They contend that the ability to deal with conflict is at the heart of organized civil society; in the political process, one of civil society's key functions is to express and mediate between different interests, thus contributing to political decision-making. The chapters draw on detailed, empirical data from the CIVICUS Civil Society Index - a unique comparative data-set drawn from 25 countries, which has not previously been made publicly available. It examines the different ways violence has been manifested in civil societies, the meaning of violent protest and the impact of security legislation that might hinder the mediating efforts of civil society. The book offers a sophisticated comparison between conflict and post-conflict countries and an analysis of the role of civil society in conflict resolution, reconciliation and transitional justice.

Book excerpt: Civil Paths to Peace contains the analyses and findings of the Commonwealth Commission on Respect and Understanding, established in response to the 2005 request of Commonwealth Head of Government for the Commonwealth Secretary-General to 'explore initiatives to promote mutual understanding and respect among all faiths and communities in the Commonwealth.' This report focuses particularly on the issues of terrorism, extremism, conflict and violence, which are much in ascendancy and afflict Commonwealth countries as well as the rest of the world. It argues that cultivating respect and understanding is both important in itself and consequential in reducing violence and terrorism. It further argues that cultivated violence is generated through fomenting disrespect and fostering confrontational misunderstandings. The report looks at the mechanisms through which violence is cultivated through advocacy and recruitment, and the pre-existing inequalities, deprivations and humiliations on which those advocacies draw. These diagnoses also clear the way for methods of countering disaffection and violence. In various chapters the different connections are explored and examined to yield general policy recommendations. Accepting diversity, respecting all human beings, and understanding the richness of perspectives that people have are of great relevance for all Commonwealth countries, and for its 1.8 billion people. They are also importance for the rest of the world. The civil paths to peace are presented here for use both inside the Commonwealth and beyond its boundaries. The Commonwealth has survived and flourished, despite the hostilities associated with past colonial history, through the use of a number of far-sighted guiding principles. The Commission argues that those principles have continuing relevance today for the future of the Commonwealth--and also for the world at large.

Six country volumes (one each on Bangladesh, Nepal, Pakistan, Sri Lanka, and two on India, as well as two standalone volumes) comprising over fifty research papers and two book-length studies, detail the histories of sexual violence and look at the systemic, institutional, societal, individual and community structures that work together to perpetuate impunity for perpetrators. The essays in this volume focus on Nepal, which though not directly colonized, has not remained immune from the influence of colonialism in its neighbourhood. In addition to home-grown feudal patriarchal structures, the writers in this volume clearly demonstrate that it is the larger colonial and post-colonial context of the subcontinent that has enabled the structuring of inequalities and power relations in ways that today allow for widespread sexual violence and impunity in the country - through legal systems, medical regimes and social institutions. The period after the 1990 democratic movement, the subsequent political transformation in the aftermath of the Maoist insurgency and the writing of the new constitution, has seen an increase in public discussion about sexual violence. The State has brought in a slew of legislation and action plans to address this problem. And yet, impunity for perpetrators remains intact and justice elusive. What are the structures that enable such impunity? What can be done to radically transform these? How must States understand the search for justice for victims and survivors of sexual violence? The essays in this volume attempt to trace a history of sexual violence in Nepal, look at the responses of women's groups and society at large, and suggest how this serious and wide-ranging problem may be addressed.

Yet NGOs find themselves highly constrained in bringing their material and epistemic resources to bear in the security arena where their activities normally must be authorized by states, or international organizations acting with authority delegated from states. Kalyvas specifies a novel theory of selective violence: it is jointly produced by political actors seeking information and individual civilians trying to avoid the worst but also grabbing what opportunities their predicament affords them. Violence, he finds, is never a simple reflection of the optimal strategy of its users; its profoundly interactive character defeats simple maximization logics while producing surprising outcomes, such as relative nonviolence in the 'frontlines' of civil war.

The aim of this book is to unpack the meaning of legitimacy for the population in peacebuilding processes and the relationship this has with civil society involvement. There is a growing consensus for addressing local concerns in peacebuilding, with the aim of ensuring local ownership. Moreover, scholars have noted a relationship between civil society inclusion in peace negotiations and legitimacy. Yet, the very idea of legitimacy remains a black box. Using data from original empirical fieldwork – including over 100 semi-structured interviews and 12 focus group discussions – the book focuses on two case studies of negotiations that, respectively, ended a long civil war in Liberia in 2003 and ended the post-election violence in Kenya in 2008. It argues that civil society involvement is conceptually insufficient to show a multidimensional understanding of legitimacy. Instead, the book shows a complex picture of legitimate peace negotiations, based on outcome and participation-based characteristics with the involvement of both ‘guarantors’ of legitimacy and a more general civic agency which includes the general population. Through forms of participative communication, the passive audience become active stakeholders in the construction of legitimacy. This has repercussions for how we think about civil society and peacebuilding more generally. This book will be of much interest to students of peacebuilding, conflict resolution, security studies and IR in general.
