The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. None had to fight harder than the nation’s seamen, whose labor took them far from home and deep into the Atlantic world. Citizen Sailors tells the story of how their efforts to become American at sea in the midst of war and revolution created the first national, racially inclusive model of United States citizenship. Nathan Perl-Rosenthal immerses us in sailors’ pursuit of safe passage through the ocean world during the turbulent age of revolution. Challenged by British press-gangs and French privateersmen, who considered them Britons and rejected their citizenship claims, American seamen demanded that the U.S. government take action to protect them. In response, federal leaders created a system of national identification documents for sailors and issued them to tens of thousands of mariners of all races—nearly a century before such credentials came into wider use. Citizenship for American sailors was strikingly ahead of its time: it marked the federal government’s most extensive foray into defining the boundaries of national belonging until the Civil War era, and the government’s most explicit recognition of black Americans’ equal membership as well. This remarkable system succeeded in safeguarding seafarers, but it fell victim to rising racism and nativism after 1815. Not until the twentieth century would the United States again embrace such an inclusive vision of American nationhood.

Book excerpt: In 1755 Benjamin Franklin observed "a man without a wife is but half a man" and since then historians have taken Franklin at his word. In Citizen Bachelors, John Gilbert McCurdy demonstrates that Franklin's comment was only one side of a much larger conversation. Early Americans vigorously debated the status of unmarried men and this debate was instrumental in the creation of American citizenship. In a sweeping examination of the bachelor in early America, McCurdy fleshes out a largely unexamined aspect of the history of gender. Single men were instrumental to the settlement of the United States and for most of the seventeenth century their presence was not particularly problematic. However, as the colonies matured, Americans began to worry about those who stood outside the family. Lawmakers began to limit the freedoms of single men with laws requiring bachelors to pay higher taxes and face harsher penalties for crimes than married men, while moralists began to decry the sexual immorality of unmarried men. But many resisted these new tactics, including single men who reveled in their hedonistic reputations by delighting in sexual horseplay without marital consequences. At the time of the Revolution, these conflicting views were confronted head-on. As the incipient American state needed men to stand at the forefront of the fight for independence, the bachelor came to be seen as possessing just the sort of political, social, and economic agency associated with citizenship in a democratic society. When the war was won, these men demanded an end to their unequal treatment, sometimes grudgingly, and the citizen bachelor was welcomed into American society. Drawing on sources as varied as laws, diaries, political manifestos, and newspapers, McCurdy shows that in the course of the seventeenth and eighteenth centuries the bachelor was a simultaneously suspicious and desirable figure: suspicious because he was not tethered to family and household obligations yet desirable because he was free to study, devote himself to political office, and fight and die in battle. He suggests that this dichotomy remains with us to this day and thus it is in early America that we find the origins of the modern-day identity of the bachelor as a symbol of masculine independence. McCurdy also observes that by extending citizenship to bachelors, the founders affirmed their commitment to individual freedom, a commitment that has subsequently come to define the very essence of American citizenship.
