Book excerpt: La tematica dei diritti fondamentali dell’uomo costituisce oggetto di particolare interesse nell’ambito degli studi giuridici nazionali, internazionali ed europei. Ne dà testimonianza anche buona parte della riflessione dottrinale italiana contemporanea. Essa dedica a questa specifica materia significativa attenzione sia sotto il profilo teoretico sia sotto l’aspetto dogmatico, coinvolgendo nello stesso tempo, sebbene da prospettive diverse, tanto i filosofi del diritto e i civilisti, quanto i giuspubblicisti, e, fra questi ultimi, specialmente i costituzionalisti e gli internazionalisti. Dal punto di vista sistematico, l’interesse di studio verso il tema dei diritti umani appare alimentato soprattutto dal fatto che gli operatori giuridici si trovano di fronte ad una pluralità di Costituzioni contemporanee, fra cui quella italiana, che dedicano intere loro sezioni alle libertà fondamentali, spesso disciplinandole con particolare considerazione e dettaglio in norme iniziali e di ‘apertura’ degli stessi testi costituzionali. I giuristi, inoltre, si trovano davanti ad un manipolo sempre più nutrito di Carte internazionali sui diritti dell’uomo, espressione tangibile della volontà comune degli Stati di assicurare alle libertà umane un’oggettiva eterofondazione, che, in linea di principio, sia assiologicamente sganciata dalle determinazioni contingenti del potere sovrano degli Stati nazionali. L’esigenza di una eterofondazione dei diritti fondamentali, e, perciò, l’aspirazione ad un loro ancoramento in grado di ‘trascendere’ e di superare gli eventuali condizionamenti derivanti dalle singole autorità politiche statuali, ha tradizionalmente toccato, e continua tuttora a toccare, anche la “sensibilità intellettuale” propria degli studiosi del diritto ecclesiastico italiano. Questa singolare attenzione non deve sorprendere, in quanto, nell’ambito dei giuristi positivi, gli ecclesiasticisti rappresentano categoria di studiosi che, in linea di principio, ha forse più naturale consuetudine con problemi di eterofondazione, segnatamente ove si guardi ad alcune specifiche figure o fattispecie che formano usualmente oggetto del loro specifico interesse scientifico. Così, prendendo ad esempio il caso dell’ordinamento giuridico italiano, quando si afferma che il diritto positivo riconosce la sovranità della Chiesa cattolica o l’indipendenza di tutte le confessioni religiose ovvero l’originarietà dei loro rispettivi ordinamenti giuridici, e, ancora, quando si afferma che lo Stato dichiara la propria incompetenza nei confronti delle materie e degli «ordini» tipicamente confessionali (le cui dinamiche possono pure incidere, talora in maniera profonda, nella vita concreta dei consociati), è evidente la presupposizione (implicita) dell’esistenza di una dimensione extra-statuale in cui trovano genetico fondamento e ragion d’essere soggetti e sistemi di valori – per loro natura – non riferibili strettamente alla sfera ordinamentale dello Stato.
