The role of transnational economic law in influencing and reorganising national systems of governance evidences the constitutional dimensions of global capitalism: the power to institute new rules and limits for national states. This form of new constitutionalism does not undermine the state but transforms it by eroding national capacities and implanting global alternatives. While leading scholars in the field have emphasised the much-needed value of case studies, there are no studies available which consider the cumulative impact of multiple axes of transnational legal ordering on the national state or its constitution. This monograph addresses this empirical gap, whilst expanding the theoretical scope of the field. Mongolia’s recent transformation as a mineral-exporting country provides a rare opportunity to witness economic and legal globalisation in process. Based on careful empirical analysis of national law and policy-making, the book traces the way distinctive processes of transnational legal ordering have reorganised and reframed the governance of Mongolia’s mining sector, specifically by redistributing state power in relation to the market, sub-national administrations and civil society. The book investigates the role of international financial institutions, multinational corporations and non-governmental organisations in normative transmission, as well as the critical role of national actors in embedding transnational investment norms within the domestic legal and policy environment. Dr. Philip King Brown noticed rising tuberculosis rates among the women who worked there, and he knew there were few places where they could get affordable treatment. In 1911, with the help of wealthy society women and his wife, Helen, a protégé of philanthropist Phoebe Apperson Hearst, Brown opened the Arequipa Sanatorium in Marin County. Together, Brown and his all-female staff gave new life to hundreds of working-class women suffering from tuberculosis in early-twentieth-century California. Until streptomycin was discovered in the 1940s, tubercular patients had few treatment options other than to take a rest cure at a sanatorium and endure its painful medical interventions. For the working class and minorities, especially women, the options were even fewer. Unlike most other medical facilities of the time, Arequipa treated primarily working-class women and provided the same treatment to all, including Asian American and African American women, despite the virulent racism of the time. Author Lynn Downey’s own grandmother was given a terminal tuberculosis diagnosis in 1927, but after treatment at Arequipa, she lived to be 102 years old. Arequipa gave female doctors a place to practice, female nurses and social workers a place to train, and white society women a noble philanthropic mission. Although Arequipa was founded by a male doctor and later administered by his son, the sanatorium’s mission was truly about the women who worked and recovered there, and it was they who kept it going. Based on sanatorium records Downey herself helped to preserve and interviews she conducted with former patients and others associated with Arequipa, Downey tells a vivid story of the sanatorium and its cure that Brown and his talented team of Progressive women made available and possible for hundreds of working-class patients.

Book excerpt: For much of the twentieth and twenty-first centuries, public officials in cities like New York, Chicago, and Baltimore have criminalized uprisings as portending Black "thugs" throwing rocks at police and plundering private property to undermine complaints of police violence. Liberal mayors like Fiorello H. La Guardia have often been the deftest practitioners of this strategy. As the Depression and wartime conditions spurred youth crime, white New Yorkers' anxieties—about crime, the movement of Black people into white neighborhoods, and headlines featuring Black "hoodlums" emblazoned all over the white media—drove their support for the expansion of police patrols in the city, especially in Harlem and Bedford-Stuyvesant. Though Blacks also called for police protection and for La Guardia to provide equitable municipal resources, they primarily received more punishment. This set the stage for the Harlem uprising of 1943. Shannon King uncovers how Black activism for safety was a struggle against police brutality and crime, highlighting how the police withholding protection operated as a form of police violence and an abridgement of their civil rights. By decentering familiar narratives of riots, King places Black activism against harm at the center of the Black freedom struggle, revealing how Black neighborhoods became occupied territories in La Guardia's New York.
