Book Synopsis Swiss Public Administration by : Andreas Ladner
Download or read book Swiss Public Administration written by Andreas Ladner and published by Springer. This book was released on 2018-08-07 with total page 397 pages. Available in PDF, EPUB and Kindle. Book excerpt: Swiss citizens approve of their government and the way democracy is practiced; they trust the authorities and are satisfied with the range of services Swiss governments provide. This is quite unusual when compared to other countries. This open access book provides insight into the organization and the functioning of the Swiss state. It claims that, beyond politics, institutions and public administration, there are other factors which make a country successful. The authors argue that Switzerland is an interesting case, from a theoretical, scientific and a more practice-oriented perspective. While confronted with the same challenges as other countries, Switzerland offers different solutions, some of which work astonishingly well.

Book Synopsis Judicial review in comparative law by : Allan R. Brewer Carias
Download or read book Judicial review in comparative law written by Allan R. Brewer Carias and published by Ediciones Olejnik. This book was released on 2023-11-24 with total page 442 pages. Available in PDF, EPUB and Kindle. Book excerpt: "All over the world, in all democratic States, independently of having a legal system based on the common law or on the civil law principles, the courts – special constitutional courts, supreme courts or ordinary courts – have the power to decide and declare the unconstitutionality of legislation or of other State acts when a particular statute violates the text of the Constitution or of its constitutional principles. This power of the courts is the consequence of the consolidation in contem-porary constitutionalism of three fundamental principles of law: first, the existence of a written or unwritten constitution or of a fundamental law, conceived as a superior law with clear supremacy over all other statutes; second, the “rigid” character of such constitution or fundamental law, which implies that the amendments or reforms that may be introduced can only be put into practice by means of a particular and special constituent or legislative process, preventing the ordinary legislator from doing so; and third, the establishment in that same written or unwritten and rigid constitution or fundamental law, of the judicial means for guaranteeing its supremacy, over all other state acts, including legislative acts. Accordingly, in democratic systems subjected to such principles, the courts have the power to refuse to enforce a statute when deemed to be contrary to the Constitu-tion, considering it null or void, through what is known as the diffuse system of judicial review; and in many cases, they even have the power to annul the said unconstitutional law, through what is known as the concentrated system of judicial review. The former, is the system created more than two hundred years ago by the Supreme Court of the United States, and that so deeply characterizes the North American Constitutional system. The latter system, has been adopted in consti-tutional systems in which the judicial power of judicial review has been generally assigned to the Supreme Court or to one special Constitutional Court, as is the case, for example, of many countries in Europe and in Latin America. This concentrated system of judicial review, although established in many Latin American countries since the 19th century, was only effectively developed particularly in the world after World War II following the studies of Hans Kelsen. Of course, during the past thirty years many changes have occurred in the world on these matters of Judicial Review, in particularly in Europe and specifically in the United Kingdom, where these Lectures were delivered. Nonetheless, I have decided to publish them hereto in its integrality, as they were: the written work of a law professor made as a consequence of his research for the preparation of his lectures, not pretending to be anything else, but the academic testimony of the state of the subject of judicial review in the world in 1985-1986". Schultz, Parthenon Marbles and many more) and analyses legal issues (bona fide, relevant UNESCO and UNIDROIT Conventions, Supreme Court Decisions, procedure for requests etc.). Essential reading for students, specialists, scholars and decision-makers as well as those interested in these topics.
Book Synopsis E-voting Handbook by : Susanne Caarls
Download or read book E-voting Handbook written by Susanne Caarls and published by Council of Europe. This book was released on 2010-01-01 with total page 68 pages. Available in PDF, EPUB and Kindle. Book excerpt: The use of electronic voting systems has caused controversy in the media and among the general public, and has even come under the scrutiny of the law courts. it has become clear that the uncertainties surrounding the introduction of e-voting are rarely of a technical nature, but primarily raise political and societal concerns. The key issue is to ensure that the principles of free and fair elections are upheld, regardless of the voting method chosen. This handbook is written for governments and organisations considering whether or not to conduct e-voting pilot schemes and trials or to make e-voting a feature of their electoral system. it reviews relevant issues such as building and safeguarding trust in the system, The value of open-source software And The implications of a voter verifiable audit paper trail. Concrete e-voting issues are discussed in the framework of the electoral cycle. This handbook can be used as a stand-alone guide, but governments or organisations would benefit most by consulting it in conjunction with Recommendation Rec(2004)11 of the Committee of Ministers of the Council of Europe on legal, operational and technical standards for e-voting

Book Synopsis The Republican Alternative by : André Holenstein
Download or read book The Republican Alternative written by André Holenstein and published by Amsterdam University Press. This book was released on 2008 with total page 362 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Republican Alternative seeks to move beyond the mere notion of scholarly inquiry into the republic—the subject of recent rediscovery by political historians interested in Europe’s intellectual heritage—by investigating the practical similarities and differences between two early modern republics, as well as their self-images and interactions during the turbulent seventeenth and eighteenth centuries. Among the world’s most economically successful societies, Switzerland and the Netherlands laid much of the foundation for their prosperity during the early modern period discussed here. This volume attempts to clarify the special character of these two countries as they developed, including issues of religious plurality, the republican form of government, and an increasingly commercially-driven agrarian society.
