Available in PDF, EPUB and Kindle. Book excerpt: Fact-Finding Without Facts explores international criminal fact-finding - empirically, conceptually, and normatively. After reviewing thousands of pages of transcripts from various international criminal tribunals, the author reveals that international criminal trials are beset by numerous and severe fact-finding impediments that substantially impair the tribunals' ability to determine who did what to whom. These fact-finding impediments have heretofore received virtually no publicity, let alone scholarly treatment, and they are deeply troubling not only because they raise grave concerns about the accuracy of the judgments currently being issued but because they can be expected to similarly impair the next generation of international trials that will be held at the International Criminal Court. After setting forth her empirical findings, the author considers their conceptual and normative implications. The author concludes that international criminal tribunals purport a fact-finding competence that they do not possess and, as a consequence, base their judgments on a less precise, more amorphous method of fact-finding than they publicly acknowledge.

Book excerpt: Soon to be an FX Docuseries from Emmy® Award-Winning Producer Marc Smerling (The Jinx) featuring the author Errol Morris! Academy Award–winning filmmaker Errol Morris examines one of the most notorious and mysterious murder trials of the twentieth century In this profoundly original meditation on truth and the justice system, Errol Morris—a former private detective and director of The Thin Blue Line—delves deeply into the infamous Jeffrey MacDonald murder case. MacDonald, whose pregnant wife and two young daughters were brutally murdered in 1970, was convicted of the killings in 1979 and remains in prison today. The culmination of an investigation spanning over twenty years and a masterly reinvention of the true-crime thriller, A Wilderness of Error is a shocking book because it shows that everything we have been told about the case is deeply unreliable and that crucial elements of case against MacDonald are simply not true.

Available in PDF, EPUB and Kindle. Book excerpt: Marvin Miller changed major league baseball and the business of sports. Drawing on research and interviews with Miller and others, Marvin Miller, Baseball Revolutionary offers the first biography covering the pivotal labor leader's entire life and career. Baseball historian Robert F. Burk follows the formative encounters with Depression-era hard times, racial and religious bigotry, and bare-knuckle Washington and labor politics that prepared Miller for his biggest professional challenge--running the moribund Major League Baseball Players Association. Educating and uniting the players as a workforce, Miller embarked on a long campaign to win the concessions that defined his legacy: decent workplace conditions, a pension system, outside mediation of player grievances and salary disputes, a system of profit sharing, and the long-sought dismantling of the reserve clause that opened the door to free agency. Through it all, allies and adversaries alike praised Miller's hardnosed attitude, work ethic, and honesty. Comprehensive and illuminating, Marvin Miller, Baseball Revolutionary tells the inside story of a time of change in sports and labor relations, and of the contentious process that gave athletes in baseball and across the sporting world a powerful voice in their own games.

Economic growth, the presence of constraints on vehicle ownership and driving, and environmental conditions differentiate the scenarios. By making potential long-term mobility futures more vivid, the team sought to help decisionmakers at different levels of government and in the private sector better anticipate and prepare for change.

Book excerpt: Celebrating the twentieth anniversary of the groundbreaking Testimony, this collection brings together the leading academics from a range of scholarly fields to explore the meaning, use, and value of testimony in law and politics, its relationship to other forms of writing like literature and poetry, and its place in society. It visits testimony in relation to a range of critical developments, including the rise of Truth Commissions and the explosion and radical extension of human rights discourse; renewed cultural interest in perpetrators of violence alongside the phenomenal commercial success of victim testimony (in the form of misery memoirs); and the emergence of disciplinary interest in genocide, terror, and other violent atrocities. These issues are necessarily inflected by the question of witnessing violence, pain, and suffering at both the local and global level, across cultures, and in postcolonial contexts. At the volume’s core is an interdisciplinary concern over the current and future nature of witnessing as it plays out through a ‘new’ Europe, post-9/11 US, war-torn Africa, and in countless refugee and detention centers, and as it is worked out by lawyers, journalists, medics, and novelists. The collection draws together an international range of case-studies, including discussion of the former Yugoslavia, Gaza, and Rwanda, and encompasses a cross-disciplinary set of texts, novels, plays, testimonial writing, and hybrid testimonies. The volume situates itself at the cutting-edge of debate and as such brings together the leading thinkers in the field, requiring that each address the future, anticipating and setting the future terms of debate on the importance of testimony.
