Book excerpt: This title was first published in 2000: This volume discusses the impact of the transfer of undertakings regime upon the public sector, particularly focusing on the interaction between the protection of employee rights and the restructuring and modernization of public services. The crux of the book is the interaction of market-led policies in the public sector, such as compulsory competitive tendering, best value and the PFI, with the protection of employee rights on the transfer of imployment. It considers the evolving law on the scope of a relevant transfer under the European Acquired Rights Directive and the TUPE regulations, before reviewing the present stte of the law on dismissals, variation of terms, pensions and employee consultation in transfer-related situations. The book incorporates consideration of the text of the 1998 revision of the Acquired Rights Directive.

Book excerpt: A cascade of TUPE cases, notably and centrally upon the service provision change, and the subsequent enactment of the Collective Redundancies and the Transfer of Undertakings (Protection of Employment) (Amendment) Regulations 2014 by the UK Government, have made necessary this fourth edition of TUPE: Law & Practice. The new 2014 Amendment Regulations, in force from 31 January 2014, are intended to clarify the issues raised by recent cases and also to reduce the burdens on employers of small enterprises. This guide provides analysis of the new 2014 TUPE Amendment Regulations including: the scope to “service provision changes” (i.e. outsourcing/contracting-out and in), as well as clarification of the Regulation 3; key changes relating to transfer dismissals and changes to terms and conditions; pensions obligations under TUPE; clarified ‘joint‘consultation rights; the confusing application of TUPE where the transferor is insolvent. Lawyers, politicians and policymakers, HR practitioners, as well as academics, will find this book brings them up to speed on TUPE. This book aims to keep pace with these changes, providing practical advice and cutting edge analysis.

Available in PDF, EPUB and Kindle. Book excerpt: Deakin and Morris' Labour Law, a work cited as authoritative in the higher appellate courts of several jurisdictions, provides a comprehensive analysis of current British labour law which explains the role of different legal and extra-legal sources in its evolution, including collective bargaining, international labour standards, and human rights. The new edition, while following the broad pattern of previous ones, highlights important new developments in the content of the law, and in its wider social, economic and policy context. Thus the consequences of Brexit are considered along with the emerging effects of the Covid-19 crisis, the increasing digitisation of work, and the implications for policy of debates over the role of the law in constituting and regulating the labour market. The book examines in detail the law governing individual employment relations, with chapters covering the definition of the employment relationship; the sources and regulation of terms and conditions of employment; discipline and termination of employment; and equality of treatment. This is followed by an analysis of the elements of collective labour law, including the forms of collective organisation, freedom of association, employee representation, internal trade union government, and the law relating to industrial action. The seventh edition of Deakin and Morris' Labour Law is an essential text for students of law and of disciplines related to management and industrial relations, for barristers and solicitors working in the field of labour law, and for all those with a serious interest in the subject.

Available in PDF, EPUB and Kindle. Book excerpt: First published in 1997. Politicians of all shades argue that the labour market should be more flexible and workers more mobile. But what does this mean in reality? How flexible and mobile are workers likely to be? Is there an ideological base to the language of flexibility? These are some of the issues covered in this book. Data from a large factory and office is used to argue that the macro labour market consists of non-competitive work groups where strongly held views and values represent a substantial barrier to simplistic definitions of flexibility and mobility. The analysis takes place in three chapters, dealing with recruitment for work, skills used in work and perceptions of different types of work and workers. The findings suggest that non-economic forces (such as institutional, social, historical and political phenomena) strongly influence the creation of separate work cultures. Furthermore, it is argued that the reason for differences between work groups being articulated in a defensive fashion reflects the climate of fear in the labour market, where flexibility is associated with a loss of the (often limited) power, control and influence workers have over their position in the labour market.

Available in PDF, EPUB and Kindle. Book excerpt: The subject of industrial relations is intimately connected with the nature of schooling - in particular, the teacher trade unions have played and will continue to play a crucial role in shaping the school system - yet this subject has been virtually neglected in educational literature. Mike Ironside and Roger Seifert's book redresses this balance and unravels the complex issues surrounding the employment and management of teachers. Recent changes in education have had massive implications for the way in which our education system is organised. In the light of recent events, this book questions who controls or ought to control schools, focusing on the government, Department of Education, LEA's, head teachers, school governors, parents and teaching unions. The authors argue that in order for schools to continue to function, industrial relations must be given priority, including the development of a proper framework for negotiation and the resolution of conflicts.
