Available in PDF, EPUB and Kindle. Book excerpt: The new edition of Farber, Eskridge, Frickey, and Schacter's Cases and Materials on Constitutional Law exploits two of the most exciting developments in Constitutional Law teaching in the last thirty years: the judiciary's dramatic engagement with social movements and key political debates, and academic and judicial deployment of original meaning as a central methodology. Thus, the new edition presents a most systematic introduction of original meaning methodology for law students, starting with the evolution of "originalism" in response to the academic debates over Brown v. Board of Education, and continuing with in-depth examination of what original meaning teaches us about the Fourteenth Amendment, as well as the First and Second Amendments, the Commerce Clause and other authorizations for congressional regulation, and the separation of powers. The new edition provides in-depth treatment of the most exciting issues in constitutional law today--including the validity of affirmative action, the continuing battle over abortion restrictions, the recognition of same sex marriage and the continuing clash between claims based on gay rights and those based on religious freedom, the expanded use of the First Amendment to limit economic regulation, more aggressive deployment of justiciability limitations based upon Article III, and issues of presidential power posed by the current Administration as well as its recent predecessors.

Book excerpt: To view or download the 2020 Supplement to this book click here. Constitutional Law: Cases, Approaches, and Applications is a succinct and careful presentation of canonical constitutional law cases and important constitutional law statements from the political branches. Additionally, its annual supplement includes material based on recent appellate cases applying Supreme Court constitutional doctrine. Its main features include: Relatively longer excerpts of relatively fewer cases, carefully edited to preserve citations to relevant precedent. This feature allows professors to engage students about appropriate use of precedent. The book also includes note material that connects the featured cases, thus providing the students with a comprehensive explanation of the law in a manageable number of pages. Thematic, as well as topical, organization, which allows professors to explore particular jurisprudential approaches. For example, much of the equal protection material is organized around the Court's use, and eventual abandonment, of suspect class analysis. An annual supplement that, in addition to excerpting the Supreme Court's most recent constitutional law opinions, also features appellate cases applying the Court's constitutional law doctrines, in the form of excerpts, notes, or problems. This feature helps students understand how the Court's often-vague statements of constitutional law are actually applied. It also teaches the fundamental (but often-unlearned) reality that practicing lawyers need to know not just what the Supreme Court has said about a particular issue, but how the relevant lower court jurisdiction has understood that statement. Moreover, providing these cases as problems allows students to work through the implications of a Supreme Court decision in a concrete, real-life context.

Book excerpt: The updated casebook, Manning and Stephenson's Legislation and Regulation, 2d, is designed for a first-year class on Legislation & Regulation, and provides a proven, ready-to-use set of materials for those interested in introducing such a class to their 1L curriculum. The book focuses on the tools and methods of interpreting legal texts, using Supreme Court and other appellate decisions as the primary texts, yet the note material gently introduces students to applicable insights from political science, history, economics, and philosophy. The book aims to familiarize students with tools and techniques that lawyers and judges use when crafting legal arguments in statutory or regulatory contexts, and to give students a sense of the larger questions of institutional design implicated by these interpretive questions.

Book excerpt: The 2016-2017 Annual Supplement is available here. This volume is now available only as a paperback--ISBN 978-1-5310-0476-7 ($90). Through both historical essays and a timeline of American constitutional history, Constitutional Law in Context helps students understand constitutional law in light of cases, doctrine, constitutional analysis, federalism, and historical context. It covers both structure of government and individual liberty cases, and it includes a substantial chapter on free speech. In addition, the book provides historical context for the cases. The casebook helps students to see how historical context shaped doctrinal developments. It also shows how historical developments affecting one doctrine often shaped other doctrines as well. Examples include parallel changes in commerce clause, substantive due process, and equal protection cases, and in cases related to race and gender. The chapter on incorporation includes excerpts from the Black Codes and from the congressional debates on the Fourteenth Amendment. The incorporation chapter also shows how the framers of the amendment were influenced by denials of civil liberties that occurred during the crusade against slavery. The book contains materials on constitutional decision-making outside of the Supreme Court including materials on the Clinton impeachment and examples from free speech history. By its emphasis on the types of constitutional arguments, Constitutional Law in Context is designed to assist students in understanding and formulating constitutional arguments based on text, history, precedent, and policy. To help students understand constitutional doctrine, the book contains short doctrinal essays, charts, and diagrams. It also deals with some state constitutional law cases to remind students that state constitutions may provide independent and sometimes greater protection of rights. This new third edition includes cases decided through the 2009-2010 term and several new essays. The authors traditionally provide online supplements each year at no charge.

Constitutional Law: Cases, Materials, and Problems is designed as a "teacher's book" by stimulating thought, inviting classroom discussion, and helping professors to effectively teach. Its thought-provoking problem approach encourages students to delve deeper into constitutional doctrine and gives them an accessible and interesting way to learn constitutional issues. Problems at the beginning of each chapter are referenced throughout the text for continuity. Principal constitutional law cases are edited as lightly as possible to allow the Supreme Court to speak for itself, and shorter notes accompany the problems. A detailed Teacher's Manual gives insights into the problems and cases in the text. Chapter-opening problems in the Third Edition are revised in light of the 2011 Supreme Court health care decision. The Occupy Wall Street Movement is carefully explored as well. New court cases are included, such as National Federation of Independent Business v. Sebelius, Arizona v. United States, United States v. Alvarez, Knox v. Service Employees International Union, Hosanna-Tabor Evangelical Lutheran Church, Arizona Christian School Tuition Organization v. Book excerpt: In the age of American mass incarceration, a complex legal regime governs prison conditions and presents a host of controversial questions at the intersection of constitutional liberty, statutory interpretation, administrative regulation, and public policy. This is a completely overhauled, re-titled, and much-expanded version of the leading casebook about incarceration. It addresses both pretrial and post-conviction incarceration, presenting Supreme Court and leading lower court case law, statutes, litigation materials, professional standards, academic commentary, and prisoner writing. Topics include conditions of confinement, civil liberties, particular prisoner populations and relevant legal issues (race and national origin discrimination, the particular issues/law governing treatment of incarcerated women, LGBTQ people, and people with disabilities). Litigated remedies (injunctive litigation, damages, the Prison Litigation Reform Act, and criminal prosecution of prison staff), are also covered in detail, as is non-litigation oversight. The casebook is supplemented by an open-access website that offers additional resources and sources for further reading.
