These discussions culminated in the convening of the Third United Nations Conference on the Law of the Sea in December 1973 and in four additional sessions up to September 1976. Whether the almost 150 participating states will be able to reach an accord in 1977 or later on, the myriad issues on their agenda is still uncertain. Two major issues have been the extension of coastal-state jurisdiction over resources and activities and the estblishment of an international regime to govern the exploitation of the deep seabed. Canada's most significant role has been that of a leader of the "coastal-state grouping," which has sought to expand states' jurisdiction over fisheries, seabed resources, scientific research, and pollution control within a 200-mile economic zone and sometimes beyond. A number of these Canadian policy goals have already been accepted by a large majority of the participants in the conference. In this role, Canada has found itsself opposed to many of its traditional allies among the developed nations with large fleets engaged in commerce in distant waters, and concerned about the traditional freedom of the high seas, and has aligned itself with the coastal developing nations of Africa, Asia, and Latin America. The seven essays in this volume examine the development of Canadian policies on the major law of the sea issues and the outcome of the negotiations on them. In so doing, the studies have analysed Canada's dramatic seward expansion and involvement in one of teh most important United Nations Conferences.

Book excerpt: In order to frame discussion of these issues it is necessary to describe the overall structure of UNCLOS, the nature of the negotiations leading to its finalization, Canadian foreign policy objectives at the time, the way in which UNCLOS provisions balance the various interests at play in the uses of the oceans, coastal state rights in respect of the exploitation of seabed resources and the extent [...] The continental shelf (CS) is the seabed and subsoil of the submarine areas lying under the territorial sea and extending to the outer edge of the continental margin.24 In many places the Canadian CS extends beyond 200 miles. [...] In particular, the maritime zones defined in the Oceans Act are derived from the same zones specified in UNCLOS, and the nature of the rights to explore and/or exploit hydrocarbon resources of the CS are identical to the comparable Articles of UNCLOS. [...] Currently the ISA is developing the various frameworks necessary to manage the nascent seabed mining industry in the Area.49 The ISA in effect is the body responsible for caring for the largest commons in the world: the seabed and its non-living resources beyond national jurisdiction. [...] Canada is a party to the Vienna Convention on the Law of Treaties,62 which directs that "a treaty shall be interpreted in good faith in accordance with the ordinary meaning to be given to the terms of the treaty in their context and in the light of its object and purpose."63 The Supreme Court of Canada has applied this rule64 of treaty interpretation on a number of occasions.
