Book excerpt: Medieval Douai was one of the wealthiest cloth towns of Flanders, and it left an enormous archive documenting the personal financial affairs of its citizens—wills, marriage agreements, business contracts, and records of court disputes over property rights of all kinds. Based on extensive research in this archive, this book reveals how these documents were produced in a centuries-long effort to regulate—and ultimately to redefine—property and gender relations. At the center of the transformation was a shift from a marital property regime based on custom to one based on contract. In the former, a widow typically inherited her husband's property; in the latter, she shared it with or simply held it for his family or offspring. Howell asks why the law changed as it did and assesses the law's effects on both social and gender meanings but she insists that the reform did not originate in general dissatisfaction with custom or a desire to disempower widows. Instead, it was born in a complex economic, social and cultural history during which Douaisiens gradually came to think about both property and gender in new ways.

The Willoughby family, from Wollaton, Nottinghamshire, built up an extensive medieval library, including the notable Wollaton Antiphonal; theirs is the largest surviving library gathered by a gentry family of the period, the product of a single acquisitive burst, beginning around 1460 and mainly completed at about the time of the Dissolution in 1540. The manuscripts remain unique because of the very substantial core which survives more or less in situ, together with a huge collection of family archives, at the University of Nottingham, just a few miles from their original home. This book focuses upon the ten manuscripts now in the Wollaton Library Collection as well asthe famous Antiphonal. Essays explore the history of the library and the Willoughby family, the books of Sir Thomas Chaworth, the art and function of the Antiphonal, the works of pastoral instruction, the decoration of the Frenchmanuscripts (including the earliest fully illustrated manuscript of romances), the Confessio Amantis, and the conservation of the collection. Feudalism is normally associated with eighteenth-century France only in its more bizarre survivals, as in The Marriage of Figaro, when his seigneur claims the rights to spend the first night with the bride. If feudalism menat no more in the eighteenth century than a few quaint customs that could tickle an audence at the Comedie Francaise, why did French writers attack it so furiously? The author suggests that contemporary writers saw remnants of the feudal regime as important less in themselves, than as symbols of an attitude of mind which the 'enlightened' among them would no longer tolerate. Instead of representing the ideas of the eighteenth century through the eyes of a few outstanding writers, Dr Mackrell has tried to reconstitute the intellectual climate of the ancien regime from the works of largely unknown historians, jurists, economists and others. In this way he illuminates the rich texture of eighteenth-century French thought, without which the ideas of Voltaire, Montesquieu and even Rousseau lose much of their meaning. This study breathes life into the fierce controversies that shook the Age of Reason long before the outbreak of Revolution.
