Book excerpt: Excerpt from Actual Facts About the Campaign for Disruption of Southern Pacific Lines: Facts and Circumstances of Public Interest The California Railroad Commission, in its Opinion February 24, 1913, said: We are not unmindful of the fact that, as testified by both Judge Lovett and Mr. Sproule, these companies are more or less under duress to contract. On the one hand the stock of the Southern Pacific owned by the Union Pacific is in the hands of the court for sale, and if an arrange ment is not consummated before ninety days shall have elapsed after the decision of the court, this stock is to be placed in the hands of a receiver to be sold as the court directs. It is testified that the Attorney General is threatening proceedings against the Southern Pacific if it does not divest itself of control of its alleged competing line, the Central Pacific, and we appreciate the desire of the parties to bring about a solution of their troubles which will result in as little financial loss to them as possible, yet we believe it is our duty to have in mind the efiect of any arrangement which may be designed upon not only the contracting parties here, but the public. The California Railroad Commission held that while it had no jurisdiction over the subject matter as a whole, it would not approve certain features-of the proposed contract with reference to exclusive trackage rights, length Of terms Of leases, etc. The Commission held in the course Of its Opinion, however, that such sale from the Southern Pacific to the Union Pacific Of the Central Pacific properties would.
