The third would raise the statutory public debt limit by $781 billion to $8,965 billion to accommodate the government's ongoing borrowing needs to finance its deficits. Only the first two instructions would have any direct effect on the deficit over those five years (the debt limit has no direct effect on the deficit).

Book excerpt: On April 28, 2005, Congress approved an FY2006 budget resolution (H.Con.Res. 95) with reconciliation instructions calling for three bills: a bill containing spending cuts ($1.5 billion in FY2006 and $34.7 billion over five years); a bill increasing the public debt limit by $781 billion (to $8,965 billion); and a bill containing tax cuts. The reconciliation instructions for taxes called for tax cuts of $11 billion in FY2006 and $70 billion over five years. As 2005 draws to a close, Congress has begun consideration of the tax-reduction reconciliation bill. On November 15, both the House Ways and Means Committee and the Senate Finance Committee approved separate tax-cut proposals as H.R. 4297 and S. 2020, respectively. The full Senate approved a slightly modified version of S. 2020 on November 18. An important part of both bills is the extension of numerous temporary, tax-reducing provisions that are scheduled to expire at various times over the next several years. While most of these "extenders" are the same in each package, there are some differences, including extension of the increased alternative minimum tax (AMT) exemption, which is contained in the Senate proposal but not the Ways and Means bill; and reduced rates for capital gains and dividends, which are in the Ways and Means measure but not the Senate plan. Aside from the extenders, the Senate bill contains a number of additional items not contained in the Ways and Means Committee plan, including tax incentives for development in areas affected by recent hurricanes; both tax benefits and reforms related to charitable contributions; and revenue-raising items in the area of tax shelters and elsewhere. In addition, on December 7, the House passed "stand alone" bills extending the increased AMT exemption (H.R. 4096) and providing disaster-related tax benefits (H.R. 4440). This report will be updated as legislative developments occur.

The debate limitation makes a reconciliation measure an attractive vehicle for legislative initiatives that otherwise might be subject to a filibuster. Reconciliation is a two-step process, involving the inclusion of reconciliation instructions in the budget resolution, which direct the appropriate committees to develop legislation achieving the desired budgetary outcomes, and the subsequent consideration of the resultant reconciliation legislation under expedited procedures. The FY2006 budget resolution (H.Con.Res. 95), which was agreed to by the House and Senate on April 28, 2005, included reconciliation instructions expected to lead to the development of three different reconciliation measures: (1) an omnibus spending bill to reduce mandatory outlays by about $35 billion over FY2006FY2010; (2) a revenue bill to reduce revenues by $70 billion over the same period; and (3) a bill to increase the limit on the public debt by $781 billion. Following a surge in spending for relief and reconstruction efforts associated with Hurricanes Katrina and Rita, Republican leaders in the House and Senate announced plans to achieve additional savings in mandatory outlays through the reconciliation process, and to pursue other savings in annual appropriations acts. The Senate Budget Committee reported the spending reconciliation bill, S. 1932, the Deficit Reduction Omnibus Reconciliation Act of 2005, on October 27. The Senate passed the bill with amendments on November 3, by a vote of 52-47. Congressional Budget Office (CBO) estimated that the committee recommendations would yield net outlay savings of $39.114 billion over FY2006-FY2010; the amendments adopted by the Senate reduced the five-year savings to $34.644 billion. The House Budget Committee reported the spending reconciliation bill, H.R. 4241, the Deficit Reduction Act of 2005, on November 7. The House passed the bill on November 18, by a vote of 217-215; amendments were incorporated into the bill automatically under a self-executing feature of the rule governing consideration (H.Res. 560, as amended), but no other amendments were allowed. CBO estimated that the committee recommendations would yield net outlay savings of $53.929 billion over FY2006-FY2010, about $4 billion the revised level of savings requested by the House leadership; the amendments adopted by the House reduced the five-year savings to $49.889 billion. The Senate Finance Committee approved the revenue reconciliation bill, S. 2020, the Tax Relief Act of 2005, on November 15. The Senate passed the bill with amendments on November 18, by a vote of 64-33. The House Ways and Means Committee reported the revenue reconciliation bill, H.R. 4297, the Tax Relief Extension Reconciliation Act of 2005, on November 17. The House passed the bill on December 8, by a vote of 234-197. The Joint Committee on Taxation estimated the five-year revenue reduction at $57.756 billion in the Senate-passed bill and $56.082 billion in the House-passed bill. The Senate Committee on Finance was instructed to meet a budget reconciliation target of $10 billion in direct spending savings over a five-year period, FY2006FY2010. On October 25, 2005, the Senate Finance Committee reported its reconciliation proposal to the Senate Budget Committee, which subsequently incorporated the proposal into S. 1932, The Deficit Reduction Omnibus Reconciliation Act of 2005. In the House, the Committee on Energy and Commerce had budget reconciliation instructions that specified a mandatory savings target of $14.734 billion between FY2006 and FY2010. The Committee's recommendations were incorporated into the House Budget Committee's bill, The Deficit Reduction Act of 2005. The House passed its version of the bill on November 18, 2005. The Senate bill proposes changes to Medicaid, the State Children's Health Insurance program (SCHIP), and Medicare. Based on Congressional Budget Office (CBO) estimates, the largest Medicaid savings amounts are the result of changes in the reimbursement of outpatient prescription drugs. Other areas of Medicaid savings include changes to some asset transfer rules for Medicaid-eligible individuals applying for long-term care services and changes to the Medicaid program designed to combat fraud, waste, and abuse. Increases in Medicaid spending would largely result from temporary federal medical assistance percentage (FMAP) increases targeted to help Medicaid recipients from selected Louisiana parishes and counties in Alabama and Mississippi devastated by Hurricane Katrina, and also from the limiting of any FY2006-FY2007 FMAP decrease to Alaska and the re-computation of FMAPs for FY2006. The bill includes a number of Medicaid demonstration projects and some benefit and eligibility expansions. The proposal would alter the method for redistribution of SCHIP funds to the states. Medicare savings would result from changes in Medicare's Part C (Medicare Advantage) and the establishment of variations in provider payments that reflect quality differences (value-based purchasing, or "pay for performance"). The proposal would also provide for a 1% Medicare payment update for physicians in 2006. The House bill's health program provisions are largely limited to changes in the Medicaid program. The House bill achieves its largest savings with cost-sharing and benefit changes. The bill also foresees savings from changes in prescription drug reimbursement and asset transfer rules. Increased spending provisions are focused on long-term care service benefits, the establishment of health opportunity account demonstrations, and Hurricane Katrina health program relief. On December 19, 2006 the House agreed to a conference report on S. 1932. However, the Senate amended the report. The amended agreement passed the Senate on December 21, 2006, and was returned to the House for further action. It is expected that the agreement will be taken up in the early part of the session.
