Download or read book Reading Law written by Antonin Scalia and published by West Publishing Company. This book was released on 2012 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this groundbreaking book, Scalia and Garner systematically explain all the most important principles of constitutional, statutory, and contractual interpretation in an engaging and informative style with hundreds of illustrations from actual cases. Is a burrito a sandwich? Is a corporation entitled to personal privacy? If you trade a gun for drugs, are you using a gun in a drug transaction? The authors grapple with these and dozens of equally curious questions while explaining the most principled, lucid, and reliable techniques for deriving meaning from authoritative texts. Meanwhile, the book takes up some of the most controversial issues in modern jurisprudence. What, exactly, is textualism? Why is strict construction a bad thing? What is the true doctrine of originalism? And which is more important: the spirit of the law, or the letter? The authors write with a well-argued point of view that is definitive yet nuanced, straightforward yet sophisticated.
Book Synopsis Liberty and Sexuality by : David J. Garrow
Download or read book Liberty and Sexuality written by David J. Garrow and published by Open Road Media. This book was released on 2015-07-07 with total page 777 pages. Available in PDF, EPUB and Kindle. Book excerpt: Pulitzer Prize–winning author David J. Garrow’s stirring and essential history of the politics of abortion and America’s battle for the right to choose In 1973, the Supreme Court handed down its landmark Roe v. Wade decision legalizing abortion, and more than forty years later the issue continues to spark controversy and divisiveness. But behind this historic legal case lie the battles women fought to establish their rights to use contraceptives and choose to have an abortion. Liberty and Sexuality traces these political and legal struggles in the decades leading up to Roe v. Wade—including the momentous 1965 Supreme Court ruling in Griswold v. Connecticut that established a constitutional “right to privacy.” Garrow personalizes the struggles by detailing the vital contributions made by dozens of crusaders who tirelessly paved the way. This expansive and substantial work also addresses the threats to sexual privacy and the legality of abortion that have risen since Roe v. Wade. With abortion still a contentious subject on the national political landscape, Liberty and Sexuality is not just a historical account of the right to choose, but an indispensable read about preserving a freedom that continues to divide America.

Book excerpt: Geoffrey Stone's Perilous Times incisively investigates how the First Amendment and other civil liberties have been compromised in America during wartime. Stone delineates the consistent suppression of free speech in six historical periods from the Sedition Act of 1798 to the Vietnam War, and ends with a coda that examines the state of civil liberties in the Bush era. Full of fresh legal and historical insight, Perilous Times magisterially presents a dramatic cast of characters who influenced the course of history over a two-hundred-year period: from the presidents—Adams, Lincoln, Wilson, Roosevelt, and Nixon—to the Supreme Court justices—Taney, Holmes, Brandeis, Black, and Warren—to the resisters—Clement Vallandingham, Emma Goldman, Fred Korematsu, and David Dellinger. Filled with dozens of rare photographs, posters, and historical illustrations, Perilous Times is resonant in its call for a new approach in our response to grave crises.

Book Synopsis Conservatives in an Age of Change by : James A. Reichley
Download or read book Conservatives in an Age of Change written by James A. Reichley and published by Brookings Institution Press. This book was released on 2010-12-01 with total page 500 pages. Available in PDF, EPUB and Kindle. Book excerpt: From 1969 to 1977 the executive branch of the U.S. government was dominated by politicians and their advisers who called themselves "conservatives." In their speeches they professed belief in such values and institutions as social order, military strength, market capitalism, governmental decentralization, and traditional morality. But did these social ideas have much influence on their actual policy decisions? Or were their decisions, as some observers have argued, largely based on personal ambition, partisan interest, and pragmatic response to the day-to-day problems of government? To answer these questions, A. James Reichley examines the effects of conservative ideology on the formation of specific administration policies under the presidencies of Richard Nixon and Gerald Ford. The policies covered include the development of detente with the Soviet Union, welfare reform, revenue sharing, resistance to "busing," the imposition of wage and price controls in 1971, and governmental reorganization under Nixon; and, under Ford, adjustment to the rise of the third world and problems with detente, the drive for decontrol of oil prices, and the fight against inflation. In the last chapter Reichley considers whether the Nixon and Ford administrations can be truly described as conservative, and suggests what the future role of conservatism in American politics is likely to be.

Book Synopsis Same-sex Marriage in the United States by : Jason Pierceson
Download or read book Same-sex Marriage in the United States written by Jason Pierceson and published by Rowman & Littlefield. This book was released on 2014 with total page 267 pages. Available in PDF, EPUB and Kindle. Book excerpt: Same-sex marriage has become one of the defining social issues in contemporary U.S. politics. State court decisions finding in favor of same-sex relationship equality claims have been central to the issue's ascent from nowhere to near the top of the national political agenda. Same Sex Marriage in the United States tells the story of the legal and cultural shift, its backlash, and how it has evolved over the past 15 years. This book aids in a classroom examination of the legal, political, and social developments surrounding the issue of same-sex marriage in the United States. While books about same-sex marriage have proliferated in recent years, few, if any, have provided a clear and comprehensive account of the litigation for same-sex marriage, and its successes and failures, as this book does. Updated through 2013, this edition details the watershed rulings in favor of same-sex marriage: the Supreme Court's June 26th repeal of DOMA, and of Proposition 8 in California, as well as the many states (New Jersey, Illinois, New Mexico, Hawaii, and Nevada among others) where activists and public leaders have made recent strides to ensure that gay couples have an equal right to marry.
