Book excerpt: Brilliant. Colorful. Visionary. Tenacious. Witty. Since his appointment to the Supreme Court in 1986, Associate Justice Antonin Scalia has been described as all of these things and for good reason. He is perhaps the best-known justice on the Supreme Court today and certainly the most controversial. Yet most Americans have probably not read even one of his several hundred Supreme Court opinions. In Scalia Dissents, Kevin Ring, former counsel to the U.S. Senate's Constitution Subcommittee, lets Justice Scalia speak for himself. This volume—the first of its kind— showcases the quotable justice's take on many of today's most contentious constitutional debates. Scalia Dissentscontains over a dozen of the justice's most compelling and controversial opinions. Ring also provides helpful background on the opinions and a primer on Justice Scalia's judicial philosophy. Scalia Dissents is the perfect book for readers who love scintillating prose and penetrating insight on the most important constitutional issues of our time.

Book excerpt: From the back cover: Public perceptions of the use of force by law enforcement officers can dramatically and negatively affect the way the police and the community interact. The International Association of Chiefs of Police (IACP) and the Office of Community Oriented Policing Services (COPS Office) convened a Use of Force Symposium to find ways in which law enforcement can address the perceived excessive use of force by officers. Discussions centered around five major themes, including public perception; getting the facts; managing use of force; officer training; and officer mindset. Emerging Use of Force Issues: Balancing Public and Officer Safety summarizes the discussions from the Symposium and provides suggestions and conclusions on what actions can be taken to address these issues.

Book excerpt: National parks are different from other federal lands in the United States. Beginning in 1872 with the establishment of Yellowstone, they were largely set aside to preserve for future generations the most spectacular and inspirational features of the country, seeking the best representative examples of major ecosystems such as Yosemite, geologic forms such as the Grand Canyon, archaeological sites such as Mesa Verde, and scenes of human events such as Gettysburg. But one type of habitat--the desert--fell short of that goal in American eyes until travel writers and the Automobile Age began to change that perception. As the Park Service began to explore the better-known Mojave and Colorado deserts of southern California during the 1920s for a possible desert park, many agency leaders still carried the same negative image of arid lands shared by many Americans--that they are hostile and largely useless. But one wealthy woman--Minerva Hamilton Hoyt, from Pasadena--came forward, believing in the value of the desert, and convinced President Franklin D. Roosevelt to establish a national monument that would protect the unique and iconic Joshua trees and other desert flora and fauna. Thus was Joshua Tree National Monument officially established in 1936, with the area later expanded in 1994 when it became Joshua Tree National Park. Since 1936, the National Park Service and a growing cadre of environmentalists and recreationalists have fought to block ongoing proposals from miners, ranchers, private landowners, and real estate developers who historically have refused to accept the idea that any desert is suitable for anything other than their consumptive activities. To their dismay, Joshua Tree National Park, even with its often-conflicting land uses, is more popular today than ever, serving more than one million visitors per year who find the desert to be a place worthy of respect and preservation. Book excerpt: The Federal Bureau of Prisons (BOP), the component of the Department of Justice (DOJ) responsible for incarcerating all federal defendants sentenced to prison, was operating at 20% over its rated capacity as of December 2015. To alleviate overcrowding, in 1997 the BOP had begun contracting with privately operated institutions (contract prisons), to confine federal inmates who are primarily low security, criminal alien adult males with 90 months or less remaining to serve on their sentences. This report examined how the BOP monitors these facilities and assessed whether contractor performance meets certain inmate safety and security requirements. It found that, in most key areas, contract prisons incurred more safety and security incidents per capita than comparable BOP institutions and that the BOP needs to improve how it monitors contract prisons. Figures. This is a print on demand report.

Available in PDF, EPUB and Kindle. Book excerpt: From the earliest days of nationhood, the United States has determined who might enter the country and who might be naturalized. In this sweeping review of US immigration policies, Bill Ong Hing points to the racial, ethnic, and social struggles over who should be welcomed into the community of citizens. He shows how shifting visions of America have shaped policies governing asylum, exclusion, amnesty, and border policing. Written for a broad audience, Defining America Through Immigration Policy sets the continuing debates about immigration in the context of what value we as a people have assigned to cultural pluralism in various eras. Hing examines the competing visions of America reflected in immigration debates over the last 225 years. For instance, he compares the rationales and regulations that limited immigration of southern and eastern Europeans to those that excluded Asians in the nineteenth century. He offers a detailed history of the policies and enforcement procedures put in place to limit migration from Mexico, and indicts current border control measures as immoral. He probes into little discussed issues such as the exclusion of gays and lesbians and the impact of political considerations on the availability of amnesty and asylum to various groups of migrants. Hing's spirited discussion and sophisticated analysis will appeal to readers in a wide spectrum of academic disciplines as well as those general readers interested in America's on-going attempts to make one of many.
