Book excerpt: Data sharing can accelerate new discoveries by avoiding duplicative trials, stimulating new ideas for research, and enabling the maximal scientific knowledge and benefits to be gained from the efforts of clinical trial participants and investigators. At the same time, sharing clinical trial data presents risks, burdens, and challenges. These include the need to protect the privacy and honor the consent of clinical trial participants; safeguard the legitimate economic interests of sponsors; and guard against invalid secondary analyses, which could undermine trust in clinical trials or otherwise harm public health. Sharing Clinical Trial Data presents activities and strategies for the responsible sharing of clinical trial data. With the goal of increasing scientific knowledge to lead to better therapies for patients, this book identifies guiding principles and makes recommendations to maximize the benefits and minimize risks. This report offers guidance on the types of clinical trial data available at different points in the process, the points in the process at which each type of data should be shared, methods for sharing data, what groups should have access to data, and future knowledge and infrastructure needs. Book excerpt: Pharmaceutical companies, academic researchers, and government agencies such as the Food and Drug Administration and the National Institutes of Health all possess large quantities of clinical research data. If these data were shared more widely within and across sectors, the resulting research advances derived from data pooling and analysis could improve public health, enhance patient safety, and spur drug development. Data sharing can also increase public trust in clinical trials and conclusions derived from them by lending transparency to the clinical research process. Much of this information, however, is never shared. Retention of clinical research data by investigators and within organizations may represent lost opportunities in biomedical research. Despite the potential benefits that could be accrued from pooling and analysis of shared data, barriers to data sharing faced by researchers in industry include concerns about data mining, erroneous secondary analyses of data, and unwarranted litigation, as well as a desire to protect confidential commercial information. Academic partners face significant cultural barriers to sharing data and participating in longer term collaborative efforts that stem from a desire to protect intellectual autonomy and a career advancement system built on priority of publication and citation requirements. Some barriers, like the need to protect patient privacy, pre- sent challenges for both sectors. Looking ahead, there are also a number of technical challenges to be faced in analyzing potentially large and heterogeneous datasets. This public workshop focused on strategies to facilitate sharing of clinical research data in order to advance scientific knowledge and public health. While the workshop focused on sharing of data from preplanned interventional studies of human subjects, models and projects involving sharing of other clinical data types were considered to the extent that they provided lessons learned and best practices. The workshop objectives were to examine the benefits of sharing of clinical research data from all sectors and among these sectors, including, for example: benefits to the research and development enterprise and benefits to the analysis of safety and efficacy. Sharing Clinical Research Data: Workshop Summary identifies barriers and challenges to sharing clinical research data, explores strategies to address these barriers and challenges, including identifying priority actions and "low-hanging fruit" opportunities, and discusses strategies for using these potentially large datasets to facilitate scientific and public health advances.

This book addresses these issues. It outlines the national and international policy processes that are currently underway to protect local genetic resources and related traditional knowledge and the challenges these initiatives have faced. In particular these themes are addressed within the context of the Convention of Biological Diversity and the International Treaty on Plant Genetic Resources for Food and Agriculture. The authors broaden the policy and legal debates beyond the sphere of policy experts to include the knowledge-holders themselves. These are the 'custodians of biodiversity': farmers, herders and fishers in local communities. Their experience in sharing access and benefits to genetic resources is shown to be crucial for the development of effective national and international agreements. The book presents and analyzes this experience, including case studies from China, Cuba, Honduras, Jordan, Nepal, Peru and Syria. The continued proliferation of benefit-sharing clauses can be explained by their appeal as an optimistic frame in addressing sustainability and equity concerns related to bio-based innovation, the use of natural resources, environmental protection, and knowledge creation. In principle, fair and equitable benefit-sharing serves to recognize, encourage, and incentivise sustainable human relationships with the environment by focusing on equity issues arising from the most intractable challenges of our time, such as loss of biodiversity, climate change, poverty, and global epidemics. Empirical evidence, however, indicates that, in practice, benefit-sharing rarely achieves its fairness and equity objectives, and ends up entrenching or worsening inequitable relationships with little to no benefit for the environment. Instead of focusing on fair and equitable benefit-sharing in sub-specialist areas of international law in isolation, Elisa Morgera assesses the phenomenon from a general international law perspective and through comparison-across international environmental law, international human rights law, international health law, and the law of the sea. Strengthened by insights from local-level case studies in different regions and sectors, this book looks toward overcoming the limitations inherent in individual international regimes and addressing the shortcomings in benefit-sharing implementation. Morgera's topical and comprehensive analysis reveals opportunities to advance fairness and equity in benefit-sharing through a mutually supportive interpretation of international biodiversity law and international human rights law, as well as opportunities to contribute to future research in areas such as international health law, international law on outer space, and international economic law. Book excerpt: The issue of REDD+ benefit sharing has captured the attention of policymakers and local communities because the success of REDD+ will depend greatly on the design and implementation of its benefit?sharing mechanism. Despite a large body of literature on potential benefit?sharing mechanisms for REDD+, the field has lacked global comparative analyses of national REDD+ policies and of the political?economic influences that can either enable or impede the mechanisms. Similarly, relatively few studies have investigated the political?economic principles underlying existing benefit?sharing policies and approaches. This working paper builds on a study of REDD+ policies in 13 countries to provide a global overview and up?to?date profile of benefit?sharing mechanisms for REDD+ and of the political?economic factors affecting their design and setting. Five types of benefit?sharing models relevant to REDD+ and natural resource management are used to create an organising framework for identifying what does and does not work and to examine the structure of rights under REDD+. The authors also consider the mechanisms in light of five prominent discourses on the question of who should benefit from REDD+ and, by viewing REDD+ through a 3E (effectiveness, efficiency, equity) lens, map out some of the associated risks for REDD+ outcomes. Existing benefit?sharing models and REDD+ projects have generated initial lessons for building REDD+ benefit?sharing mechanisms. However, the relevant policies in the 13 countries studied could lead to carbon ineffectiveness, cost inefficiency and inequity because of weak linkages to performance or results, unclear tenure and carbon rights, under?representation of certain actors, technical and financial issues related to the scope and scale of REDD+, potential elite capture and the possible negative side effects of the decentralisation of authority. Furthermore, the enabling factors for achieving 3E benefit?sharing mechanisms are largely absent from the study countries. Whether REDD+ can catalyse the necessary changes will depend in part on how the costs and benefits of REDD+ are shared, and whether the benefits are sufficient to affect a shift in entrenched behaviour and policies at all levels of government. The successful design and implementation of benefit?sharing mechanisms – and hence the legitimacy and acceptance of REDD+ – depend on having clear objectives, procedural equity and an inclusive process and on engaging in a rigorous analysis of the options for benefit sharing and their potential effects on beneficiaries and climate mitigation efforts.

In this perspective, shared public service provision is viewed as a way to enhance the accessibility, affordability and quality of essential public services. This report provides recommendations and an action plan to address challenges inherent to the legal, fiscal and institutional frameworks for shared municipal service provision in Lithuania, while taking stock of these different challenges. The report also provides two roadmaps for piloting primary healthcare and long-term care services in Tauragė+ functional zone (Jurbarkas, Pagėgiai, Šilalė, Tauragė municipalities) through shared municipal service provision. The report draws lessons from peer country experiences, and in particular Finland, where inter-municipal cooperation has been used successfully for decades.

Rosen explores a new pattern in urban development: local residents and community representatives leveraging large-scale development projects for agreements that promise dedicated local benefits, such as parks and jobs. In general, such development projects have not produced impactful benefits for local residents, and often have contributed to significant community harm, including gentrification and displacement. In response, community activists have launched a fight to control development, using benefits-sharing agreements to ensure that projects produced better outcomes for local residents. While such agreements now exist across the nation, the process of negotiating and enforcing them remains challenging. This book dives deep into four case studies--in Los Angeles, Atlanta, Seattle, and Milwaukee--to answer the following questions: Who ultimately benefits from both the agreements and the projects in question? How do benefits get delivered, and who controls this process? What works for these agreements to successfully produce community outcomes? Rosen shows that, without agreements that promote accountability, developers and other project proponents can walk away from the negotiating table once the agreement is signed and the development moves forward. This disregard for community benefits and priorities can leave community residents solely responsible for benefits delivery during implementation, but with few viable avenues to ensure that outcomes materialize. The cases reveal specific elements that agreements require to achieve success during implementation: community participation, managerial connections, effective partnerships, responsiveness, and vigorous oversight with accountability mechanisms. Although creating these conditions is difficult, sometimes impossible, and contingent on fragile processes, Rosen concludes the book with recommendations for both the agreement negotiation and implementation phases to ensure success.
