While there may be a perception that overpayments are generally the result of fraud, the research reported on here suggests otherwise. By comparing administrative decisions relating to overpayment, and criminal court decisions relating to fraud, it is argued that many low level fraud cases might more appropriately be dealt with as overpayments. Most fraud cases prosecuted in the lower courts are committed in a general context of extreme disadvantage, misunderstanding and administrative error. Adequate advocacy assistance is required at the earliest possible opportunity to ensure that unjust prosecutions are avoided.

In Australia, which serves as the empirical focus of this book, these strategies include stringent ID checks, pre-emptive data surveillance technologies including the infamous and illegal ‘robodebt’ programme, a dedicated fraud hotline and an ‘intelligence-led’ fraud investigation framework. Drawing on original documentary and interview data, including interviews with fraud investigators, this book unpacks the logics that underpin these anti-fraud initiatives with a focus on how these initiatives are imbued with logics and practices more readily associated with the criminal justice system. The central argument of the book is that the emergence of contemporary welfare compliance regimes represents a form of ‘governing through fraud’ in which the threat of welfare fraud has effectively necessitated a regime of criminalisation within the welfare state. This has been enabled by a broader process of neoliberal welfare reform, which has cast suspicion over all welfare use. The overall effect of this regime is to restrict access to social security, punish welfare recipients and stigmatise welfare use. Policing Welfare Fraud also highlights points of contradiction and multiplicity in the enactment of specific welfare compliance initiatives, including attempts by welfare officials to moderate or reformulate these strategies ‘on the ground’. These findings demonstrate that the criminalisation of welfare is neither uniform nor inexorable, and that more progressive welfare reform is possible. An accessible and compelling read, this book will appeal to students and scholars of criminology, sociology, politics and those interested in the policing of welfare recipients.

For women attempting to leave an abusive relationship, this may result in poverty if they leave or entrap them in the violent relationship if they are denied independent social security support. The report reviews cases concerning couple rule matters heard by the Administrative Appeal Tribunal (AAT), to investigate the dynamics between domestic violence, social security payments, and the couple rule and consider the similarities and differences among vulnerable groups such as women with disability, older women, Indigenous women, women living in rural or remote areas, culturally and linguistically diverse (CALD) women, women who have been incarcerated, and lesbian and transgender women. It also makes comparisons with 'de facto rule' cases heard by the New Zealand Social Security Appeals Authority (NZSSAA). The analysis finds many issues of concern, including the high rate of disadvantage and abuse among the women involved, the common theme of financial abuse or control over living arrangements by perpetrators, the open publication of identifiable and locatable details about the individuals involved, and the likelihood that the Tribunal will hold that the woman is in a relationship with her abuser.
