Book Synopsis The History of Nebraska Law by : Alan G. Gless
Download or read book The History of Nebraska Law written by Alan G. Gless and published by Ohio University Press. This book was released on 2008 with total page 337 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the aftermath of the Civil War, legislators in the Nebraska Territory grappled with the responsibility of forming a state government as well as with the larger issues of reconstructing the Union, protecting civil rights, and redefining federal-state relations. In the years that followed, Nebraskans coped with regional and national economic collapses. Nebraska women struggled for full recognition in the legal profession. Meyer v. Nebraska, a case involving a teacher in a one-room rural Nebraska schoolhouse, changed the course of American constitutional doctrine and remains one of the cornerstones of civil liberties law. And Roscoe Pound, a boy from Lincoln, went on to become one of the nation's great legal philosophers. Nebraska holds a prominent position in the field of Native American legal history, and the state's original inhabitants have been at the center of many significant developments in federal Indian policy. Nebraska Indian legal history is replete with stories of failure and success, heartache and triumph, hardship and hope. These stories are more than a mere record of the past, of treaties broken or trials won -- they are reminders of the ongoing and sometimes tense relations among the many peoples and nations that make up the heartland. Much of Nebraska law reflects mainstream American law, yet Nebraskans also have been open to experiment and innovation. The state revamped the legislative process by establishing the nation's only unicameral legislature and pioneered public employment collective bargaining and dispute resolution through its industrial relations commission and its relaxation of strict separation of powers. These seemingly contradictory trends, however, are but differing expressions of a single underlying principle inscribed in the state's motto: "Equality Before the Law."

Download or read book Rural Rebellion written by Ross Benes and published by University Press of Kansas. This book was released on 2021-01-26 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: After Ross Benes left Nebraska for New York, he witnessed his polite home state become synonymous with “Trump country.” Long dismissed as “flyover” land, the area where he was born and raised suddenly became the subject of TV features and frequent opinion columns. With the rural-urban divide overtaking the national conversation, Benes knew what he had to do: he had to go home. In Rural Rebellion Benes explores Nebraska’s shifting political landscape to better understand what’s plaguing America. He clarifies how Nebraska defies red-state stereotypes while offering readers insights into how a frontier state with a tradition of nonpartisanship succumbed to the hardened right. Extensive interviews with US senators, representatives, governors, state lawmakers, and other power brokers illustrate how local disputes over health-care coverage and education funding became microcosms for our current national crisis. Rural Rebellion is also the story of one man coming to terms with both his past and present. Benes writes about the dissonance of moving from the most rural and conservative region of the country to its most liberal and urban centers as they grow further apart at a critical moment in history. He seeks to bridge America’s current political divides by contrasting the conservative values he learned growing up in a town of three hundred with those of his liberal acquaintances in New York City, where he now lives. At a time when social and political differences are too often portrayed in stark binary terms, and people in the Trump-supporting heartland are depicted in reductive, one-dimensional ways, Benes tells real-life stories to add depth and nuance to our understanding of rural Americans’ attitudes about abortion, immigration, big government, and other contentious issues. His argument and conclusion are simple but powerful: that Americans in disparate places would be less hostile to one another if they just knew each other a little better. Part memoir, journalism, and social science, Rural Rebellion is a book for our times.
Download or read book One House written by Charlyne Berens and published by U of Nebraska Press. This book was released on 2013-01-01 with total page 285 pages. Available in PDF, EPUB and Kindle. Book excerpt: When Nebraskans voted to trade in their bicameral, partisan legislature for a one-house, nonpartisan body in 1934, it was a revolutionary decision. George Norris, a U.S. senator from Nebraska, argued that the new institution would be more open, efficient, responsible, and responsive to the people it was meant to serve. An ardent progressive, Norris convinced his fellow Nebraskans that a nonpartisan, unicameral legislature would take power from the elites and return it to the people. One House examines the forces at work behind the unicameral’s creation and chronicles the lawmakers’ struggles to remain true to the populist, progressive vision of its founders and the people of Nebraska. Using historical research, surveys of Nebraskans, and in-depth interviews with senators and legislative observers, Charlyne Berens examines whether the promises that Norris and his fellow unicameral promoters made have held up over the years. The one-house legislature remains a unique experiment in American democracy as well as a powerful symbol of Nebraskans’ identity. In a new introduction for this second edition, Berens discusses the recent addition of term limits.
