Book Synopsis Debtors and Creditors in America by : Peter J. Coleman
Download or read book Debtors and Creditors in America written by Peter J. Coleman and published by Beard Books. This book was released on 1999 with total page 322 pages. Available in PDF, EPUB and Kindle. Book excerpt: Americans now depend more heavily upon credit than any other society on Earth, or any other time in history. Borrowing has become a way of life for millions of families, and it is hard to imagine a time when charge accounts did not exist. Nonetheless, it would be a mistake to assume that, because a wallet filled with plastic instead of cash is a relatively new phenomenon, Americans have not been borrowers and lenders since the colonization of the New World. Author Peter J. Coleman proves otherwise. In one Form or another -- notes of hand, book credit, commercial paper, mortgages, land contracts -- settlers borrowed to pay their passage from Europe, to buy and clear land, to build and operate mills, to purchase slaves, and to gamble and drink. Debtors' prison awaited those who could not pay their debts, and a pauper's grave received the unfortunate who lacked the private means to feed and clothe himself in prison. While the debtors' prisons described in this book no longer exist, the author maintains that our credit-oriented society has yet to devise cheap, efficient, equitable, and humane methods of enforcing contracts for debt.

Book Synopsis Creditors' Rights by : Alexander L. Paskay
Download or read book Creditors' Rights written by Alexander L. Paskay and published by Vandeplas Pub.. This book was released on 2006 with total page 976 pages. Available in PDF, EPUB and Kindle. Book excerpt: With the enactment of the Bankruptcy Abuse Prevention Consumer Protection Act of 2005 (BAPCPA) after 8 years of repeated attempts by Congress to completely revise the Bankruptcy Code, it became evident that the last Edition of this Book in 2002 had to be revised to reflect the monumental and far reaching changes brought about by this Legislation. This work is designed to give the reader a complete landscape of the revised bankruptcy jurisprudence. It does not cover the new Chapter 15, entitled "Ancillary and Other Cross-Border Cases" which also includes the Model Law on Cross-Border Insolvency. The new Chapter 15 replaced the former Section 304 of the Bankruptcy Code. In the event there are significant developments in the field of Cross-Border insolvencies, the subject might be explored later either in the form of a supplement to this work or by the treatment of this complex subject in a separate publication. While BAPCPA only became partially operative in April 2005, it is now fully operational since October 17, 2005. In addition to the revisions to the Bankruptcy Code by BAPCPA, since the last revision of this work, there has been a significant body of case law developed by the Supreme Court and by the Courts of Appeal, giving rise to an opportunity to update the cases cited in this work.

Book Synopsis Creditor Rights and the Public Interest by : Janis Pearl Sarra
Download or read book Creditor Rights and the Public Interest written by Janis Pearl Sarra and published by . This book was released on 2003 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: Creditor Rights and the Public Interest supports the greater representation of non-traditional creditors in the process of insolvency restructuring in Canada, concentrating particularly on restructuring under the federal Companies' Creditors' Arrangement Act (CCAA). Arguing in favour of the representation of such non-traditional creditors as workers, consumers, trade suppliers, and local governments, Janis Sarra describes the existing process of addressing their interests, analyzes four case studies that focus on non-creditor groups, and compares the Canadian approach to that of several other countries, such as Germany, France, and the United States. Sarra draws on a comprehensive body of academic literature that covers a broad range of issues--insolvency theory, corporate governance theory, legislative history, and bankruptcy and insolvency practice. She further surveys the relevant legislation and supplements her analysis with insights drawn from extensive primary research of court records and personal interviews with lawyers, judges, and government officials. Creditor Rights and the Public Interest ultimately illustrates the way in which the concept of the public interest can be utilized to foreground the concerns of non-traditional stakeholders. Sarra provides a coherent account of the justification for recognizing these creditors by situating insolvency law in a legal regime that realizes a duty to maximize all of the interests and investments at stake in the corporation. In an academic field where scholarship is currently scarce, Sarra's text will be a welcome contribution.
Book Synopsis Guidelines for Efficient Bankruptcy and Creditor's Rights Reform by : Ziad Raymond Azar
Download or read book Guidelines for Efficient Bankruptcy and Creditor's Rights Reform written by Ziad Raymond Azar and published by LAP Lambert Academic Publishing. This book was released on 2013 with total page 372 pages. Available in PDF, EPUB and Kindle. Book excerpt: What does corporate bankruptcy law aim to achieve and how should it achieve its aim? This book comprehensively reviews and analyzes the theoretical debate and the existing empirical evidence that aspire to answer these two questions. It studies what various country-specific and cross-country empirical studies have shown, and what they have failed to prove so far. By highlighting the findings and methodological limitations of these studies, this book formulates and implements a research agenda whose final purpose is to provide a decisive answer to the debate on what are, or should be, the goals and means of bankruptcy law. While protecting creditors seems always a right policy choice that enhances the supply of credit, a carefully crafted collective bankruptcy statute that balances the rights of creditors and debtors equally promotes credit availability. In addition, it provides creditors with higher recovery rates in bankruptcy and significantly lowers the cost of capital. Overall, this book argues that efficient collective procedures are more equitable and more conductive to financial development than divisive auction bankruptcies.
