Book excerpt: The question whether and how boundaries might individuate and thereby be constitutive features of any imaginable legal order has yet to be addressed in a systematic and comprehensive manner by legal and political theory. This book seeks to address this important omission, providing an original contribution to the debate about law in a global setting. Against the widely endorsed assumption that we are now moving towards law without boundaries, it argues that every imaginable legal order, global or otherwise, is bounded in space, time, membership, and content. The book is built up around three main insights. Firstly, that legal orders can best be understood as a form of joint action in which authorities mediate and uphold who ought to do what, where, and when with a view to realising the normative point of acting together. Secondly, that behaviour can call into question the boundaries that determine who ought to do what, where and when: a-legality. Thirdly, that this a-legality reveals boundaries as marking a limit and, to a lesser or greater extent, a fault line of the respective legal order. Legal boundaries reveal ways of ordering the who, what, where, and when of behaviour which have been excluded, yet which remain within the range of practical possibilities accessible to the collective: limits. However legal boundaries also intimate an order which exceeds the range of possibilities accessible to that collective - the fault line of the respective legal order. Careful analysis of a wide range of legal orders, including nomadism, Roman law, classical international law, ius gentium, multinationals, cyberlaw, lex mercatoria, the EU, global regimes of human rights, and space law validates this thesis. What sense, then, can we make of the normativity of the law, if there can be no inclusion without exclusion? Arguing that legal and political theories misunderstand how legal boundaries do their work of including and excluding, the book develops a normative theory of legal order which is alternative to both communitarianism and cosmopolitanism.

In some cases, law shapes conflict proactively by imposing normative limits in advance of the appearance of proscribed conduct. Much more commonly, armed conflict either reveals lacunae in the law or demonstrates how law designed for yesterday’s wars falls short when applied to contemporary conflict. When that happens, international law reacts by allowing provisions to fall into desuetude, embracing new interpretations of existing prescriptions, or generating new norms through practice or codification. In the 21st Century, both international security and armed conflict are the subject of arguably unprecedented sea changes. As a result, claims that both the jus ad bellum and jus in bello are unwieldy and ill-fitting in the context of modern hostilities have surfaced prominently. Whether one agrees with such dire assessments, what has become clear is that armed conflict is increasingly exposing faultlines in the law governing the resort to force. The intent of this collection of essays in honour of Professor Yoram Dinstein on the occasion of his 70th birthday is to explore such faultlines, first by identifying them and then by assessing their consequences. In a sense, then, the essays, contributed by the top minds in the field, will serve to assist academics and practitioners to anticipate pressure on the law governing armed conflict and, to the extent possible, react accordingly. Book excerpt: The descendents of twentieth-century southern and central European immigrants successfully assimilated into mainstream American culture and generally achieved economic parity with other Americans within several generations. So far, that is not the case with recent immigrants from Latin America and the Caribbean. A compelling case study of first- and second-generation Dominicans in Providence, Rhode Island, Encountering American Faultlines suggests that even as immigrants and their children increasingly participate in American life and culture, racialization and social polarization remain key obstacles to further progress. Encountering American Faultlines uses occupational and socioeconomic data and in-depth interviews to address key questions about the challenges Dominicans encounter in American society. What is their position in the American socioeconomic structure? What occupations do first- and second-generation Dominicans hold as they enter the workforce? How do Dominican families fare economically? How do Dominicans identify themselves in the American racial and ethnic landscape? The first generation works largely in what is left of Providence's declining manufacturing industry. Second-generation Dominicans do better than their parents economically, but even as some are able to enter middle-class occupations, the majority remains in the service-sector working class. José Itzigsohn suggests that the third generation will likely continue this pattern of stratification, and he worries that the chances for further economic advancement in the next generation may be seriously in doubt. While transnational involvement is important to first-generation Dominicans, the second generation concentrates more on life in the United States and empowering their local communities. Itzigsohn ties this to the second generation's tendency to embrace panethnic identities. Panethnic identity provides Dominicans with choices that defy strict American racial categories and enables them to build political coalitions across multiple ethnicities. This intimate study of the Dominican immigrant experience proposes an innovative theoretical approach to look at the contemporary forms and meanings of becoming American. José Itzigsohn acknowledges the social exclusion and racialization encountered by the Dominican population, but he observes that, by developing their own group identities and engaging in collective action and institution building at the local level, Dominicans can distinguish themselves and make inroads into American society. But Encountering American Faultlines also finds that hard work and hope have less to do with their social mobility than the existing economic and racial structures of U.S. society.
