Book Synopsis Essays on the Visualisation of Legal Informatics by : Vytautas Cyras
Download or read book Essays on the Visualisation of Legal Informatics written by Vytautas Cyras and published by Springer Nature. This book was released on 2023-05-18 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: Both legal scholars and computer scientists will be curious to know how the gap between law and computing can be bridged. The law, and also jurisprudence, is based on language, and is mainly textual. Every syntactic system has its semantic range, and so does language, which in law achieves a high degree of professional precision. The use of visualisations is a syntactic supplement and opens up a new understanding of legal forms. This understanding was reinforced by the paradigm shift from textual law to legal informatics, in which visual formal notations are decisive. The authors have been dealing with visualisation approaches for a long time and summarise them here for discussion. In this book, a multiphase transformation from the legal domain to computer code is explored. The authors consider law enforcement by computer. The target view is that legal machines are legal actors that are capable of triggering institutional facts. In the visualisation of statutory law, an approach called Structural Legal Visualisation is presented. Specifically, the visualisation of legal meaning is linked with tertium comparationis, the third part of the comparison. In a legal documentation system, representing one legal source with multiple documents is viewed as a granularity problem. The authors propose to supplement legislative documents ex ante with explicit logic-oriented information in the form of a mini thesaurus. In contrast to so-called strong relations such as synonymy, antonymy and hypernymy/hyponymy, one should consider weak relations: (1) dialectical relations, a term of dialectical antithesis; (2) context relations; and (3) metaphorical relations, which means the use of metaphors for terms. The chapters trace topics such as the distinction between knowledge visualisation and knowledge representation, the visualisation of Hans Kelsen’s Pure Theory of Law, the separation of law and legal science, legal subsumption, legal relations, legal machines, encapsulation, compliance, transparency, standard cases and hard cases.

Book Synopsis Cassirers Weg zur Philosophie der Politik by : Enno Rudolph
Download or read book Cassirers Weg zur Philosophie der Politik written by Enno Rudolph and published by Felix Meiner Verlag. This book was released on 1999-01-01 with total page 159 pages. Available in PDF, EPUB and Kindle.
Download or read book Die Rechtsstellung des Menschen im Völkerrecht written by Thilo Marauhn and published by Mohr Siebeck. This book was released on 2003 with total page 144 pages. Available in PDF, EPUB and Kindle. Book excerpt: English summary: The individual has long been seen as being only a part of the state, which is the primary subject of public international law. Recently, however, it has become a generally accepted fact that the individual has international rights and obligations, which means that he has at least limited legal capacity. This volume reflects recent tendencies in this dynamic field and provides perspectives for further development.

Book Synopsis Hans Kelsen and the Natural Law Tradition by : Peter Langford
Download or read book Hans Kelsen and the Natural Law Tradition written by Peter Langford and published by BRILL. This book was released on 2019-03-19 with total page 555 pages. Available in PDF, EPUB and Kindle. Book excerpt: Hans Kelsen and the Natural Law Tradition provides the first sustained examination of Hans Kelsen’s critical engagement, itself founded upon a distinctive theory of legal positivism, with the Natural Law Tradition. This edited collection commences with a comprehensive introduction which establishes the character of Kelsen’s critical engagement as a general critique of natural law combined with a more specific critique of representative thinkers of the Natural Law Tradition. The subsequent chapters are then devoted to a detailed analysis of Kelsen’s engagement with prominent theorists from the Natural Law Tradition. The volume concludes with an exploration, focusing upon the delineation of a non-positivist legal theory in the debate between Robert Alexy and Joseph Raz, of the continued presence of Kelsenian legal positivism in contemporary legal theory.

This book was released on 2000-01-31 with total page 448 pages. Available in PDF, EPUB and Kindle.
Book Synopsis Righteousness by : Jeffrey J. Niehaus
Download or read book Righteousness written by Jeffrey J. Niehaus and published by Wipf and Stock Publishers. This book was released on 2023-10-11 with total page 287 pages. Available in PDF, EPUB and Kindle. Book excerpt: The first volume of this three-volume work reviews the history of efforts to define biblical righteousness. Modern views are engaged and critiqued, from the seminal article (1860) by Ludwig Diestel (God's righteousness as the agreement of his will and purpose) to others in the theological stream known as the "New Perspective." Scholars discussed include Walther Eichrodt, Gerhard von Rad, Elizabeth Achtemeier, James D. G. Dunn and N. T. Wright. Other perspectives are also engaged, including H. H. Schmid's definition of righteousness as conformity to the created order (Weltordnung), John Piper's view that God's righteousness is God's concern for his own glory, and the traditional view, championed by C. L. Irons, that God's righteousness is his iustitia distributiva. The author examines these views, all of which have been supported by inductive studies, in light of a proposed alternative: that righteousness is conformity to God's Being and doing. That definition will be explored further in Volumes II (OT) and III (NT). Unlike previous studies, the present work proceeds deductively and experimentally, and thereby seeks to avoid the pitfalls of a dogmatic approach. Extra-biblical, patristic, medieval, and reformation views of righteousness are also considered as background to the modern study of righteousness.

Book Synopsis International justice and interpretation by : Giuseppe Zaccaria
Download or read book International justice and interpretation written by Giuseppe Zaccaria and published by LIT Verlag Münster. This book was released on 2002 with total page 390 pages. Available in PDF, EPUB and Kindle. Book excerpt: The 2001 issue of the Yearbook deals with the problem of international justice. What is the meaning of "justice" in the age of globalisation? In which sense can the "right" provide for criteria that make it possible to afford conflicts in international relations? Which new interpretative standards do turn out to be introduced within domestic law by international dimension? This issue of Ars interpretandi tries to answer these questions as well as other ones, according to an interdisciplinary view, which examine their implications in law, ethics, politics, economics and religion.

Book Synopsis Voices in Times of Change by : David Rock
Download or read book Voices in Times of Change written by David Rock and published by Berghahn Books. This book was released on 2000-09-01 with total page 160 pages. Available in PDF, EPUB and Kindle. Book excerpt: Taking an interdisciplinary approach, this volume offers an overview of the role of writers, intellectuals, citizens, and the churches both before, but particularly after, 1989 in the GDR and the new Germany. Friedrich Schorlemmer provides the focal point, giving the book its coherence. Issues related to his role in the GDR church and citizens movement are examined, as well as his support for GDR writers both before and after unification, and his own writings on east and west German literature. After general surveys on intellectuals, civil rights groups, opposition movements, and churches in the transformation of east Germany the volume focuses on Friedrich Schorlemmer himself: a chapter on the significance of the role that he played is followed by interviews with him and an original essay by him, giving his personal view of the role of intellectuals, citizens, and writers in east Germany. The volume is rounded off by a chapter on the reactions of lesser known writers, and, finally, on the responses of prominent GDR writers to unification and on the changing role of writers in society. Combining literary and cultural with social and political analysis, this volume provides a lively and multifaceted picture of the new Germany.
