Book excerpt: The clerk of the court may properly be the signatory on an arrest warrant only (a) when the warrant is based upon an indictment returned by a grand jury pursuant to K.S.A. 22-3011, or (b) in a misdemeanor case when the prosecution is commenced by the filing of an information, which is verified positively or accompanied by affidavits setting forth the facts of the crime, a̲n̲d̲ a judge has expressly made the requisite findings of probable cause. County approval of the location, upon the right of way of a county road, of transmission lines and poles of an electric cooperative does not obligate the county to bear the cost of any future relocation of the lines, if the same becomes necessary. Part of the compact concerns the escape of dangerous or potentially dangerous patients from institutions in any state party to the compact. Upon the capture and identification of such patients, they are to be detained until they can be returned to the state in which they were committed. In lieu of such examinations, the commissioner may accept examinations made by the Federal Savings and Loan Insurance Corporation, even though federal examinations may be made only every 20 months. In that the legislature has expressly permitted the commissioner to adopt the federal report as a substitute for his own, the 18 month period must be construed as being directory, rather than mandatory. Book excerpt: K.S.A. 17-5904 prohibits corporations from owning, acquiring or otherwise obtaining or leasing any agricultural land in Kansas, except as provided therein. While subsection (1) allows bona fide encumbrances to be taken by corporations for the purpose of security, such language refers to mortgages or other equitable interests, and does not include legal title retained by a vendor in a contract for deed and thereafter sold to a corporation. By contrast, a corporation could acquire agricultural land which is subject to a contract for deed under the provisions of subsection (4), through foreclosure on a vendor's interest which had been pledged as security for a separate loan. Accordingly, a corporation could not acquire legal title in agricultural land through a program of purchasing vendors' interests in contracts for deed. Cited herein: K.S.A. 17-5904.

Book excerpt: Where there is an impairment of capital of a state-chartered savings and loan association, and such association has been approved as a qualified institution under the Garn-St. Germain Depository Institutions Act of 1982 (P.L. 97-320), section 202 of that act preempts the application of those provisions of K.S.A. 17-5412 and 17-5811 which effectively require the cessation of such association's operations. Moreover, if such association's participation in the programs under the federal act as a qualified institution prevents the state savings and loan commissioner from making a finding that the association's impairment of capital threatens loss to its members, the commissioner has no authority to appoint a trustee for such association on the basis of its impairment of capital. Book excerpt: For purposes of civil proceedings under the Code for Care of Children, the legislature defined types of behavior which would constitute sexual abuse by reference to sex offenses in the criminal code, however, it did not thereby intend to adopt a criminal definition of sexual abuse. Thus, while certain acts described as sex offenses in the criminal statutes may not be punishable crimes if committed with a child age 16 years or older; those same acts may constitute abuse of that child under the definition of that term in the Code for Care of Children.
