There is no existing basis upon which to conclude that any member of a governing body or public official who willfully and deliberately fails to require the filing of the bond is immune from personal liability against a claim by any materialmen or worker on such project for any indebtedness which the contractor or subcontractor has failed to satisfy.

Book excerpt: Under K.S.A. 75-4319(b)(2) of the Kansas open meetings law, consultation with an attorney for the body or agency which would be deemed privileged in the attorney-client is a permissible basis for an executive or closed session. This exception applies only to communications between the attorney and client which are made in the course of that relationship and which are made in professional confidence. If a body recesses into executive session in order to discuss pending litigation among the members thereof, in the absence of the attorney, that discussion among the board members does not fall within the attorney-client privilege, and is not a permissible ground for holding a closed or executive session.

If the Secretary believes that a negotiating committee is necessary for the selection of a project which is not estimated to cost in excess of $250,000, the Secretary may proceed to convene a negotiating committee for the selection of an architect therefor. If no negotiating committee is convened, the Secretary may not negotiate a contract for architectural services, but must provide the needed architectural services through the Department of Administration or must designate a qualified employee of the agency for which the project is undertaken as agency architect to provide those services.
