He examines the history of relations between the European Economic Community and the Associated African States; he provides a thorough analysis of the international institutions and of the wider political, economic and legal problems involved in Afro-European co-operation. The author is concerned with the manner in which African sovereign states are now able to enter into relations with Europe on a basis of legal equality. He emphasizes the principles involved in the law of nations; this should comprise, not merely "civilized" law in traditional parlance, but also Mrican customary law. As Dr. Djamson puts it, "the international community can no longer afford to ignore the principles of law peculiar to the so-called Third World . . . after all the 'general principles of law recognized by civilized nations' are not at variance with the basic ideas of law andjustice as understood by the newcomers to the international scene. " At the same time, both the new states and the old, established powers must accept those obligations that derive from their being signatories to international agreement. Adherence to the principle of pacta sunt obser vanda does not violate sovereignty, but of itself gives evidence of a country's maturity and ability to co-exist with other sovereign entities. Dr.

Book excerpt: Of the 54African states, only South Africa is categorised by the United Nations Industrial Development Organization (UNIDO) amongst industrialised countries. The economic activities in Africa are still dominated by the production and trade of agricultural and mineral commodities. This situation is in spite of the longstanding Africa--European Union (EU) co-operation, which intends, among other things, to support Africa’s industrialisation endeavours. Imperatively, a long road to substantive levels of industrialisation still lies ahead of most African countries. This raises the question as to what role the international community could and should play in the twenty-first century to provide the support needed to expedite Africa’s industrial transformation. This book argues that to supplement the initiatives of each African country, international partnerships, of both a ‘North–South’ and ‘South–South’ nature, will serve better purposes if they are leveraged to develop productive capacities in African economies. In order to enable the African countries to leverage their traditional partnership with the EU for industrialisation, a paradigm shift is obligatory. A feasible model should emulate the Japanese-led ‘flying geese’ model and the Chinese-led ‘bamboo capitalism’ model.

Book excerpt: This volume provides the most comprehensive account to date of the foundations, evolution, and nature of the treaty-making practice, known as the practice of mixed agreements, whereby the European Community and its Member States enter into international agreements with one or more other subjects of international law. Covering policy areas from external economic relations to the environment, from development cooperation to the law of the sea, the practice of mixed agreements occupies a highly prominent position in the external relations of the EU. Rather than focusing upon any particular agreement or subject area, the book seeks to identify, through analysis of the respective interests of the Community, the Member States and other parties, as they are reflected in actual practice, the general parameters for the conclusion and application of mixed agreements. The basic thesis defended is that there are mediating strategies whereby mixed agreements can be turned into an effective technique for manifesting the Community's position in external relations whilst nevertheless safeguarding the vital interests of the Member States and the other, non-EC parties. Rather than a `necessary evil', mixed agreements should be regarded as a natural way of organizing the international relations of the EC and its Member States. Of individual treaties, the most thorough examination is made of the Community and the Member States' participation in the Law of the Sea Convention, the Food and Agriculture Organization of the UN (FAO), as well as the Agreement establishing the World Trade Organization (WTO). As regards the WTO, for instance, the book offers a comprehensive account of the dispute settlement practice under the GATS and TRIPS Agreements.
