Book excerpt: Rules prohibiting the unauthorized practice of law by non-lawyers serve many important purposes: limiting fraudulent activities, protecting the public, protecting the bar, and many more. However, those valid purposes can limit non-lawyers from engaging in otherwise helpful activities, particularly in the domestic violence arena. For instance, the laws against the unauthorized practice of law have been relaxed in some states, including Illinois, in the case of laypersons working to assist domestic violence victims in court to allow those who cannot afford a lawyer to have a helping hand from a knowledgeable and trained layperson or victim advocate. Librarians are ideally suited, especially in rural areas, to serve as advocates, at least within the confines of the library, to domestic violence victims as well. Indeed, with the proper training, librarians could be an ideal partner to combating domestic abuse in rural areas, as many victims of domestic abuse are prevented from working outside the home and may only be permitted by their abuser to access public places, like a library, without punishment. To establish this premise, the Article will begin by attempting to define the term rural to better form a context for the surrounding discussion of a specific portion of the domestic violence victim population. Next, the Article will further elaborate on the specific needs of domestic violence victims in rural areas, where shelters and legal services are often limited or absent. Then, the Article will explain why unauthorized practice of law (UPL) policies exist generally and how they have been interpreted to apply to librarians. Additionally, the relaxation of domestic UPL policies, with respect to domestic violence advocates, will be explained. Finally, some examples of the justification for and use of librarians to serve the domestic violence population will be examined. The Article will conclude with a plea for more efforts to train rural librarians to support domestic violence victims.

Book excerpt: Intimate partner violence (IPV) affects the health and mental health of many women in the United States, with some estimates projecting that one in three women will experience physical, sexual, and/or psychological abuse from a current or former partner during their lifetimes (National Intimate Partner and Sexual Violence Survey [NISVS], 2011). The problems many survivors of IPV face as they attempt to secure help and establish a life free from violence are numerous and include housing, legal, employment, medical, and other domains. Such problems are frequently compounded for survivors residing in rural areas of the U.S., where access to social services, including domestic violence shelters, is notably scarce (Iyengar & Sabik, 2009). Although many rural areas are also medically under-served, rural health care providers represent one of the front lines of helping professionals with whom abused women have semi-regular contact. Rural health care providers may thus play an important role in the identification of IPV and the assistance or referral of survivors to additional helping services. However, the ways that rural health care providers identify and respond to IPV in their resource-poor communities is not known. This dissertation research was undertaken to address a gap in the social work and public health literature regarding the management of IPV by primary health care providers, specifically rural primary health care providers, in addition to collecting information on the perceptions of helpfulness by survivors who received care from a rural provider. A mixed-methods study was conducted across rural Missouri and included surveys and interviews of rural providers and interviews with rural survivors of IPV. Overall, data indicated that rural providers are aware of IPV and view it as a problem in their communities, yet have low levels of knowledge regarding its dynamics and correlates with other problems, such as substance misuse. The lack of social, mental, and behavioral health services in many rural parts of the state also made it difficult for providers to respond effectively to the presenting concerns of their patients experiencing IPV. The majority of survivors interviewed stated they had never been asked about IPV by a primary health care provider and did not characterize their overall experience in the health care setting as helpful or effective in resolving issues related to their abuse. These and additional research findings indicate an urgent need for social workers to take an active role in health care, and that this role that may be especially meaningful for rural survivors of IPV.

According to the U.S. Department of Justice, rape, assault, and robbery rates tripled in rural communities from 1965 to 1992. Rural violence differs from urban violence in several key ways: rural victims of violence are much more likely to know their assailants than victims in urban areas; rural victims are more likely to report that the perpetrator was using alcohol as compared to urban victims; and while crime rates in rural areas are generally lower than urban or suburban areas, rural women are just as likely to experience violence at the hands of an intimate partner as their urban and suburban counterparts. Efforts that make a difference across all categories of violence include reducing drug and alcohol abuse, increasing community collaboration and education, reducing poverty, increasing the availability of health care and safe places for victims, and restricting access to firearms. The first part of the report lists strategies pertaining to physical assault, child abuse, rape and sexual assault, domestic abuse, elder abuse, suicide, and bias (hate) crimes. Strategies are categorized according to the research information available about their effectiveness. Those strategies that have been applied and studied in rural areas are specifically noted. Most strategies are followed by a reference number indicating a brief summary of the strategy in the appendix. The second part of the report includes a set of worksheets to help communities monitor violence and prevention efforts and assess the level of services available for dealing with violence. Book excerpt: The need for specific inquiry into rural domestic violence is pressing because rural survivors face barriers to legal and economic access, assistance, and development that are compounded by their isolated physical location. However, there is a paucity of legal discourse addressing the issue of rural domestic violence. In particular, it is important to consider law enforcement response to domestic violence calls because police officers often serve as the gateway to the legal community through first-response action. This Article, which was the first focus-group based study of survivors' perceptions of law enforcement response to domestic violence in the rural Midwest, points out the disparity between law and action in rural Illinois as detailed by the survivor narratives. The survivors participating in focus groups detailed ineffective police responses to domestic violence calls. The gap between law and practice is expounded by interposing the legal obligations provided by Illinois statute with the narratives of police inaction and failure to arrest. Then, a method of strengthening police responses to domestic violence calls in rural areas is proposed in order to address the issues presented in the survivor narratives. The proposal includes the use of detailed first response forms that will encourage officers to engage in risk assessment techniques in order to better gage whether an arrest is warranted in response to a domestic violence call. Additionally, the form will serve as a reminder of statutorily mandated duties imposed on law enforcement officers. Through the use of these methods, rural officers can respond more effectively to domestic violence calls and better serve rural survivors of domestic abuse.
