Book Synopsis Religion and the American Constitutional Experiment by : John Witte
Download or read book Religion and the American Constitutional Experiment written by John Witte and published by Oxford University Press. This book was released on 2016 with total page 425 pages. Available in PDF, EPUB and Kindle. Book excerpt: A final chapter shows how favorably American religious freedom compares with international human rights norms and European Court of Human Rights case law. Lucid, comprehensive, multidisciplinary, and balanced, this volume is an ideal classroom text and armchair paperback. Detailed appendices offer drafts of each of the religion clauses debated in 1788 and 1789, a table of all state constitutional laws on religious freedom, and a summary of every Supreme Court case on religious liberty from 1815 to 2015. Throughout the volume, the authors address frankly and fully the hot button issues of our day: religious freedom versus sexual liberty, freedom of conscience and its limitations, religious group rights and the worries about abuse, faith-based legal systems and their place in liberal democracies, and the fresh rise of anti-Semitism, Islamophobia, and anti-Christianity in America and abroad.

Book Synopsis Improperly Obtained Evidence in Anglo-American and Continental Law by : Dimitrios Giannoulopoulos
Download or read book Improperly Obtained Evidence in Anglo-American and Continental Law written by Dimitrios Giannoulopoulos and published by Bloomsbury Publishing. This book was released on 2019-02-21 with total page 329 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first book to offer an extensive cosmopolitan, cross-cultural insight into the perennial controversy over the use of improperly obtained evidence in criminal trials. It challenges the conventional view that exclusionary rules are idiosyncratic of Anglo-American law, and highlights the 'constitutionalisation' and 'internationalisation' of criminal evidence and procedure as a cause of rapprochement (or divergence) beyond the Anglo-American and Continental law divide. Analysis focuses on confessional evidence and evidence obtained by search and seizure, telephone interceptions and other means of electronic surveillance. The laws of England and Wales, France, Greece and the United States are systematically compared and contrasted throughout this study, but, where appropriate, analysis extends to other Anglo-American and Continental legal systems. The book reviews exclusionary rules vis-à-vis the operation of judicial discretion, and explores the normative justifications that underpin them. It attempts to reinvigorate the idea of excluding evidence to protect constitutional or human rights (the rights thesis), arguing that there is significant scope for Anglo-American and Continental legal systems to place a renewed emphasis on it, particularly in relation to confessional evidence obtained in violation of custodial interrogation rights; we can locate an emerging rapprochement, and unique potential for European Court of Human Rights jurisprudence to build consensus in this respect. In marked contrast, remaining divergence with regard to evidence obtained by privacy violations means there is little momentum to adopt a reinvigorated rights thesis more widely. Longlisted for the Inner Temple Book Prize 2022.
Book Synopsis The Literature of Japanese American Incarceration by : Frank Abe
Download or read book The Literature of Japanese American Incarceration written by Frank Abe and published by Penguin. This book was released on 2024-05-14 with total page 337 pages. Available in PDF, EPUB and Kindle. Book excerpt: “An essential volume” —Hua Hsu, The New Yorker The collective voice of Japanese Americans defined by a specific moment in time: the four years of World War II during which the US government expelled resident aliens and its own citizens from their homes and imprisoned 125,000 of them in American concentration camps, based solely upon the race they shared with a wartime enemy. A Penguin Classic This anthology presents a new vision that recovers and reframes the literature produced by the people targeted by the actions of President Franklin D. Roosevelt and Congress to deny Americans of Japanese ancestry any individual hearings or other due process after the Japanese attack at Pearl Harbor. From nearly seventy selections of fiction, poetry, essays, memoirs, and letters emerges a shared story of the struggle to retain personal integrity in the face of increasing dehumanization – all anchored by the key government documents that incite the action. The selections favor the pointed over the poignant, and the unknown over the familiar, with several new translations among previously unseen works that have been long overlooked on the shelf, buried in the archives, or languished unread in the Japanese language. The writings are presented chronologically so that readers can trace the continuum of events as the incarcerees experienced it. The contributors span incarcerees, their children born in or soon after the camps, and their descendants who reflect on the long-term consequences of mass incarceration for themselves and the nation. Many of the voices are those of protest. Some are those of accommodation. All are authentic. Together they form an epic narrative with a singular vision of America’s past, one with disturbing resonances with the American present.

Book Synopsis Rule of Law, Human Rights and Judicial Control of Power by : Rainer Arnold
Download or read book Rule of Law, Human Rights and Judicial Control of Power written by Rainer Arnold and published by Springer. This book was released on 2017-05-16 with total page 444 pages. Available in PDF, EPUB and Kindle. Book excerpt: Judicial control of public power ensures a guarantee of the rule of law. This book addresses the scope and limits of judicial control at the national level, i.e. the control of public authorities, and at the supranational level, i.e. the control of States. It explores the risk of judicial review leading to judicial activism that can threaten the principle of the separation of powers or the legitimate exercise of state powers. It analyzes how national and supranational legal systems have embodied certain mechanisms, such as the principles of reasonableness, proportionality, deference and margin of appreciation, as well as the horizontal effects of human rights that help to determine how far a judge can go. Taking a theoretical and comparative view, the book first examines the conceptual bases of the various control systems and then studies the models, structural elements, and functions of the control instruments in selected countries and regions. It uses country and regional reports as the basis for the comparison of the convergences and divergences of the implementation of control in certain countries of Europe, Latin America, and Africa. The book’s theoretical reflections and comparative investigations provide answers to important questions, such as whether or not there are nascent universal principles concerning the control of public power, how strong the impact of particular legal traditions is, and to what extent international law concepts have had harmonizing and strengthening effects on internal public-power control.
