In anni recenti, dapprima, il d.lgs. 26 marzo 2008, n. 62, ha inserito nel codice dei beni culturali e del paesaggio (d.lgs. n. 22 gennaio 2004, n. 42, all’art. 7-bis) la tutela delle c.d. “espressioni di identità culturale collettiva”, successivamente, il d.l. 8 agosto 2013, n. 91 , ha esteso tale disciplina alle “attività di artigianato tradizionale e altre attività commerciali tradizionali”; in seguito, la legge 8 marzo 2017, n. 44, nel modificare la legge 20 febbraio 2006, n. 77 , ha introdotto il riferimento agli “elementi del patrimonio culturale immateriale”; da ultimo, la legge n. 133/2020 ha autorizzato la ratifica della Convenzione quadro del Consiglio d’Europa sul valore del patrimonio culturale per la società, meglio nota come “Convenzione di Faro”, con conseguente entrata in vigore della medesima per la Repubblica italiana in data 1° aprile 2021. Interventi legislativi che, nell’introdurre nuove disposizioni o nel novellare quelle esistenti, pongono l’attenzione sul c.d. “bene culturale immateriale” e, più in generale, sul c.d. “patrimonio culturale immateriale”, in contrapposizione alla famigliare nozione codicistica di “patrimonio culturale”, a sua volta frutto di una, ormai secolare, tradizione giuridica interna, fondata sulla tutela delle “cose” munite d’interesse culturale o – nel seguire la terminologia invalsa nel diritto amministrativo all’indomani dei lavori della c.d. “Commissione Franceschini” – sulla protezione della “testimonianza materiale avente valore di civiltà”. Il diritto pattizio dell’UNESCO – inerente alla Convenzione di Parigi del 3 novembre 2003 – aveva posto l’attenzione sul tema dell’immaterialità, quale naturale sviluppo della protezione assicurata dai precedenti accordi in materia di beni culturali. Nel diritto amministrativo della cultura si era, pertanto, avviato un processo di adeguamento del “patrimonio culturale” al c.d. intangible cultural heritage sfociato nelle menzionate novelle al codice del 2004 e nella legge n. 77/2006. Processo che, allo stato, resta incompiuto, dal momento che l’ordinamento italiano non dispone né di una puntuale definizione giuridica dell’intangibilità connessa all’interesse culturale – in altri e più diretti termini, non è ravvisabile alcuna disposizione che sancisca la consistenza del “bene culturale immateriale” e del “patrimonio culturale immateriale” –, né di una regolazione idonea a delineare i rapporti sussistenti fra la sfera corporea (il codice del 2004 appunto) e la dimensione intangibile, a livello interno, sovranazionale ed internazionale. Proprio quest’ultimo aspetto reca – pur nella meritoria ratio ispiratrice, come si vedrà nel capitolo primo, del codice del 2004 – con sé evidenti carenze di sistematizzazione, giacché, a fianco di un modello UNESCO non ancora compiutamente trasposto nella regolazione amministrativa settoriale, oggi s’impone il meccanismo proposto dal Consiglio d’Europa – la menzionata “Convenzione di Faro”, parimenti ratificata dal legislatore italiano –, privo di una qualsivoglia forma di normazione interna che vada oltre la legge di ratifica, ma potenzialmente idoneo ad alterare i procedimenti e i provvedimenti amministrativi descritti nel codice del 2004, dal momento che la nozione di cultural heritage promossa dall’accordo in parola si presenta onnicomprensiva, di un’ampiezza che supera il sistema UNESCO e certamente quello codicistico italiano. È evidente che siffatte regolazioni sovranazionali – l’attualità delle quali si pone all’intera comunità internazionale nel pregevole intento di arricchire gli strumenti di tutela globalizzata dei beni culturali – sono sottese ad un accresciuto bisogno di salvaguardia e di promozione di interessi culturali altri rispetto a quelli che la legislazione italiana conosce dall’inizio del ’900 e, di conseguenza, impone un ripensamento di categorie giuridiche consolidate in questa branca del diritto amministrativo. Non è un caso, dunque, che parte della giurisprudenza amministrativa si sia avveduta di questo mutamento e abbia sottolineato la policromia del bene culturale, nel quale la dimensione intangibile assume dignità autonoma, eventualmente in modo del tutto disancorato dal substrato materiale o anche in assenza del medesimo. Il presente studio, muovendo da una ricostruzione diacronica e sincronica del “bene culturale” e del “patrimonio culturale”, si propone di sondare il fondamento giuridico dell’intangibilità. Tale proposito sarà affrontato, dapprima, sulla base di un’analisi della disciplina costituzionale e primaria che racchiude la vigente nozione di bene culturale; successivamente, nella ricerca delle prescrizioni sovranazionali ed internazionali che consentono un inquadramento del intangible cultural heritage o, più semplicemente, del cultural heritage; in seguito, sarà proposto un raffronto, in rapporto dialettico, di queste ultime con l’ordinamento italiano, anche per la via di cenni ad alcune esperienze di Stati consimili al nostro. Da ultimo, si tenterà di proporre talune chiavi di lettura del fenomeno complessivamente inteso, esponendo alcune soluzioni terminologiche e possibili revisioni normative.

In the spring of 2014, the binders of the archive of Robert Marichal were dusted off by the ERC funded project PLATINUM (ERC-StG 2014 n°636983) in response to Tiziano Dorandi’s recollections of a series of unpublished notes on Latin texts on papyrus. Among these was an in-progress edition of the Latin rolls from Herculaneum, together with Marichal’s intuition that one of them had to be ascribed to a certain ‘Annaeus Seneca’. PLATINUM followed the unpublished intuition by Robert Marichal as one path of investigation in its own research and work. Working on the Latin P.Herc. 1067 led to confirm Marichal’s intuitions and to go beyond it: P.Herc. 1067 is the only extant direct witness to Seneca the Elder’s Historiae. Bringing a new and important chapter of Latin literature arise out of a charred papyrus is significant. The present volume is made up of two complementary sections, each of which contains seven contributions. They are in close dialogue with each other, as looking at the same literary matter from several points of view yields undeniable advantages and represents an innovative and fruitful step in Latin literary criticism. These two sections express the two different but interlinked axes along which the contributions were developed. On one side, the focus is on the starting point of the debate, namely the discovery of the papyrus roll transmitting the Historiae of Seneca the Elder and how such a discovery can be integrated with prior knowledge about this historiographical work. On the other side, there is a broader view on early-imperial Roman historiography, to which the new perspectives opened by the rediscovery of Seneca the Elder’s Historiae greatly contribute.
