This book was released on 2017 with total page 363 pages. Available in PDF, EPUB and Kindle. Book excerpt: As the name implies, this book is intended to be a practical guide for those lawyers and non-lawyers who require a guide to pursuing (or defending) a claim for damages for personal injuries or clinical negligence. The key to success in all cases is preparation, so this involves knowing or researching the substantive law, knowing the procedure (the Civil Procedure Rules) and how to present cases on paper and orally before a court. The book covers these areas and provides helpful tips and tactics to improve chances of success. Worked examples include drafting interim applications and the evidence necessary, drafting skeleton arguments, making an opening and closing argument and how to appeal if things go wrong. Guidance is given on developing an advocacy style so as to persuade and influence the judge. The book will be useful for those embarking on their legal careers but will also be beneficial for more experienced practitioners who require a condensed summation in this specialist area. ABOUT THE AUTHOR Dorian Williams has practised as a solicitor in private practice for over 22 years, acting almost exclusively for claimants in personal injury and clinical negligence claims. Initially he worked for clients referred from a major Trades Union, specialising in industrial disease and employers' liability claims. For the last 17 years, Dorian has received a broad spread of instructions whilst working in a general high street practice, Freeman Johnson. His caseload now mostly comprises clinical negligence cases which he has has been privileged to receive, and thanks all his clients for developing his experience. When Dorian is not at work, he may be found climbing peaks in the Lake District, Peak District, Snowdonia or Majorca.

Available in PDF, EPUB and Kindle. Book excerpt: Clinical Negligence claims currently cost the NHS over £2 billion every year. Litigation is time-consuming, expensive and stressful for all involved. For those whose lives have been changed dramatically as a result of negligent medical treatment, bringing a claim may be the only means of obtaining redress for the harm done to them. But the process of litigation can be a bewildering and sometimes hostile experience. For many healthcare professionals the fear of litigation is a real concern and there is deep anxiety that litigation contributes to an unhealthy, even dangerous culture of blame. Clinical Negligence Made Clear: A Guide for Patients and Professionals is an attempt by one the country’s leading clinical negligence practitioners to help all those who might be affected by such cases to understand what is involved and thereby to reduce the cost and emotional impact of clinical negligence litigation. In concise, accessible language Nigel Poole QC charts how clinical negligence has evolved, its place within the justice system and how compensation is assessed explains ten core legal principles of clinical negligence such as the doctor’s duty of care and the standards expected of healthcare professionals sets out how a claim proceeds and what happens before and during a trial focuses on specific common areas of clinical negligence claims such as wrongful birth, delays in cancer treatment and cosmetic surgery looks to the future and asks whether the current system is sustainable The aim is to provide an intelligent but accessible guide for patients, doctors, nurses, therapists, expert witnesses, and healthcare managers so that those caught up in legal proceedings have a realistic view of the impact they will have and a clearer understanding of when a dispute might be best resolved early. No doubt it will also provide a lively introduction to the subject for students, trainees and lawyers looking to move into clinical negligence work.

Available in PDF, EPUB and Kindle. Book excerpt: Strategies & Tactics for the FINZ Multistate Method, Sixth Edition, is an indispensable tool for both law school exams and the Multistate Bar Exam (MBE). It features more than 1200 multiple-choice questions and detailed answers unavailable elsewhere. Many law students are intimidated by the MBE exam. They are trained to look at every possibility in a legal analysis. The MBE questions offer four answer choices that all seem plausible at first glance. Students who do poorly on the MBE tend to talk themselves out of the correct answer because of this. The Finz Multistate Method’s game plan suggests that students treat each answer option as a separate true-false item. This method simplifies the analysis by encouraging students to consider each possible answer choice separately as opposed to trying to consider the entire question as a whole. As a result, the answer process becomes faster, less overwhelming, and it removes the incorrect answers that might lead students to reconsider the correct one New to the Sixth Edition: 16 new questions in Civil Procedure 19 new questions in Constitutional Law 18 new questions each in Contracts, Criminal Law, Evidence, and Property 17 new questions in Torts 16 new questions in the Practice Exam Students will benefit from: More than 1200 multiple-choice questions and answers: Each question contains a sophisticated and intricate fact pattern that tests your ability to pull out the essential facts and tie them to the rules and theories you’ve learned in class. The answers not only explain the reasoning behind the correct choice, but also why the other choices are incorrect. Coverage of first-year subjects: Questions and detailed answers for each first-year course—Civil Procedure, Constitutional Law, Contracts, Criminal Law (including Criminal Procedure), Property (including Future Interests), and Torts—as well as the upper-year subject of Evidence. Supplemental questions for your bar review: Every question is written in the Multistate Bar Exam (MBE) style for school exams or MBE preparation and complies with the latest MBE formats. If you’re taking a bar review course, you still need Strategies & Tactics for the Finz Multistate Method because our questions are written in the MBE style and format, but are not actual released exam questions, so we guarantee you’ve never seen these questions before in your MBE review materials. Special section on how to handle MBE-style questions: The book includes an In-depth guide, “Strategies & Tactics—Playing the MBE Game to Win,” on handling the MBE and MBE-style multiple-choice questions—how to break the question down to the essential facts, how to recognize the legal issues, how to avoid the examiners’ traps and pitfalls, and how to pick the right answer and avoid being misled by the wrong answers. Complete MBE-style practice exam: The book comes with a complete 200-question practice exam, with detailed answers that explain the reasoning behind the correct choice and why each of the other choices is incorrect.

Book excerpt: This is the first book ever written for the defense on how to avoid runaway jury verdicts. I wrote this book because I care about fairness. I believe everyone has the right to a fair trial, not just plaintiff lawyers and their clients. Defendants are entitled to have a jury decide their case without being stirred with passion and bias by creative plaintiff lawyers. This is the defense "playbook" for justice. You will learn trial techniques to even the playing field for defendants seeking a fair trial. Every aspect of a civil jury trial will be covered, from voir dire to opening statements to witnesses and finally closing arguments. There is a formula for defeating plaintiff attorneys' deceptive tactics and psychological gamesmanship, and you will learn it. While full of 30 years of trial victories and personal experiences, this is a "how to" book. How to defend at trial. How to beat plaintiff attorneys at their own game. How to win. It is time to bring an end to the epidemic of nuclear verdicts across our country. It is time for you to take back justice for all! NUCLEAR VERDICTS MUST BE STOPPED! YOU CAN STOP THEM. RESPONSIBILITY. In every jury trial, accepting responsibility is not only the right thing to do, it is the most important thing you will do, no exceptions. Own what you did in every single jury trial, no excuses. REASONABLENESS. Be the most reasonable person in the courtroom. Do not take the typical defense approach of fighting every little thing. Show the jury you care, and they will return a verdict that is fair and just for all. COMMON SENSE. The ultimate equalizer in any case is common sense. It allows the jury to come to a conclusion that is fair and reasonable. You must go beyond the evidence and the law, and help the jury apply their common sense for a righteous verdict.
