Available in PDF, EPUB and Kindle. Book excerpt: The Singapore Convention on Mediation is just beginning its life as an international legal instrument. How is it likely to fare? In the second edition of this comprehensive, article-by-article commentary, the authors provide a robust report on the features of the Convention and their implications, with an analysis of potential controversies and authoritative clarifications of particular provisions. The book’s meticulous examination considers these issues and topics: international mediated settlement agreements as a new type of legal instrument in international law; types of settlement agreements that fall within the scope of the Convention; how the Convention’s enforcement mechanism works; the meaning of ‘international’ and the absence of a seat of mediation; the Convention’s approach to recognition and enforcement of international mediated settlement agreements; the grounds for refusal to grant relief under the Convention; mediator misconduct as a ground for refusal to grant relief; the role of confidentiality in granting relief for international mediated settlement agreements; the impact of the Convention on private international law; the relationship of the Singapore Convention to other international instruments such as the UN Model Law on International Commercial Mediation and the New York Convention on Arbitration; possibilities for Contracting States to declare reservations; court decisions from around the globe on the recognition and enforceability of international mediated settlement agreements; and domestic mediation legislation including domestic laws that implement the Singapore Convention. This book takes a giant step towards relieving the inherent uncertainty associated with how this newly constituted instrument may operate, and how States may become ‘Convention ready’. It is an essential reference for international lawyers, mediators and government officials as the Convention proves itself in the coming years.

Available in PDF, EPUB and Kindle. Book excerpt: Since the Arab oil embargo of 1974, it has been clear that the days of almost limitless quantities of low-cost energy have passed. In addition, ever worsening pollution due to fossil fuel consumption, for instance oil and chemical spills, strip mining, sulphur emission and accumulation of solid wastes, has, among other things, led to an increase of as much as 10% in the carbon dioxide content of the atmosphere in this century. This has induced a warming trend through the 'greenhouse effect' which prevents infrared radiation from leaving it. Many people think the average planetary temperatures may rise by 4°C or so by 2050. This is probably true since Antarctic ice cores evidence indicates that, over the last 160000 years, ice ages coincided with reduced levels of carbon dioxide and warmer interglacial episodes with increased levels of the gas in the atmosphere. Consequently, such an elevation of temperature over such a relatively short span of time would have catastrophic results in terms of rising sea level and associated flooding of vast tracts of low-lying lands. Reducing the burning of fossil fuels makes sense on both economic and environmental grounds. One of the most attractive alternatives is geothermal resources, especially in developing countries, for instance in El Salvador where geothermal energy provides about a fifth of total installed electrical power already. In fact, by the middle 1980s, at least 121 geothermal power plants were operating worldwide, most being of the dry steam type.

This book explains Tasmania's landforms and geology in terms of geologic processes. Chapters include: (1) "Our Changing Earth"; (2) "Weathering"; (3) "Soils and Soil Erosion"; (4) "Groundwater"; (5) "The Development of Rivers"; (6) "Waves and Coastlines"; (7) "Glaciation and Tasmania"; (8) "The Effects of Wind"; and (9) "The Geological History of Tasmania". Book excerpt: Professor Juel defends a simple thesis: "The beginnings of Christian reflection can be traced to interpretation of Israel's scriptures, and the major focus of that scriptural interpretation was Jesus, the crucified and risen Messiah." He therefore proceeds to demonstrate how certain Old Testament texts came to be applied to Jesus as Christ. He argues that the interpretative application of such texts to Jesus was part of the interior logic of Christianity.

Book excerpt: The Zechariah Tradition and the Gospel of Matthew is a comprehensive study of the ways Matthew utilizes Zechariah texts and traditions. Against the background of materials from Qumran, and apocryphal and deuterocanonical writings Matthew’s explicit citations of Zechariah are examined; the influence of Zechariah elsewhere in the First Gospel is identified; and the extent to which Matthew alludes to characteristic Zechariah themes, alone or in combination with other prophetic traditions, is explored. Zechariah traditions appear in Matthew’s distinctive materials, as well as in texts Matthew has transmitted, or altered, from Mark and Q. The impact of Zech 9-14 is not limited to the Passion Narrative but extends through Matthew’s Infancy and Galilean healing narratives, as well; important concepts from Zech 1-8 are also discerned in the Infancy and Passion Narratives. Moss works through the canonical order of Matthew; this enables readers to appreciate the cumulative effect of Zechariah’s influence at each stage of the Gospel story. Two appendices, one arranged according to Zechariah and the other to Matthew, list possible references to Zechariah in Matthew. This monograph is useful for Matthean studies and it is an insightful investigation of how one set of Old Testamental traditions are appropriated in one canonical Gospel and in the New Testament.
