Book excerpt: In this fascinating book, Henry Sumner Maine demonstrates how legal principles dating back to Ancient Rome evolved and permeated the modern legal system and society of the United States. A superb investigation of the roots of law ranging across thousands of years, this work uncovers resemblances between the government of the United States and the government of Ancient Rome. In particular the American Constitution and the Declaration of Independence are shown to have heavily derived from the Roman Jus Gentium - 'Law of the people'. At the time Maine published his analysis, the United States had already demonstrated vast differences across its regions and geography. The American Civil War in particular advertised divisions in the population. The author draws parallels between the localities of North America, and the wide-ranging cultures and peoples that populated the Roman Empire, noting that the federal legal system of both societies is a standard effectively applied to such vast, disparate areas.

Book excerpt: Henry Sumner Maine's 'Ancient Law' delves into the earliest ideas of mankind as they are reflected in ancient law and their relation to modern thought. The book takes the Roman law as a typical system and examines its earliest portions for traces of remote antiquity, and how its later rules are the staple of the civil institutions that still control modern society. Maine's inquiry into legal fictions, the law of nature, equity, testamentary succession, property, contract, delict, and crime is an informative and essential work for anyone interested in the history of early society and its connection to ancient law.

Available in PDF, EPUB and Kindle. Book excerpt: How should we talk about “the law” in a period so remote from our own and covering such a huge span of time and space? From the Code of Hammurabi (ca. 1750 BCE) to Justinian's Corpus Iuris Civilis (529-534 CE), A Cultural History of Law in Antiquity draws upon legal texts and non-textual forms (such as vase-painting, sculpture, and architecture) to uncover the diverse and rich legal traditions of societies ranging from the Ancient Near Eastern cities of Assyria and Babylon in Mesopotamia to the Ancient Israelites, and from Ancient Greece to Rome of the Archaic and Classical Periods. With a wealth of textual and visual sources, A Cultural History of Law in Antiquity presents essays that examine key cultural case studies of the period on the themes of justice, constitution, codes, agreements, arguments, property and possession, wrongs, and the legal profession.

Book excerpt: Best known as a history of progress, Ancient Law is the enduring work of the 19th-century legal historian Henry Sumner Maine. Even those who have never read Ancient Law may find Maine's famous phrase "from status to contract" familiar. His narrative spans the ancient world, in which individuals were tightly bound by status to traditional groups, and the modern one, in which individuals are viewed as autonomous beings, free to make contracts and form associations with whomever they choose. Maine's dichotomy between status-based societies and contract-based societies is a variation on a theme that has absorbed the social sciences for a century: the distinction between Gemeinschaft (community) and Gesellschaft (society). This theme has been elaborated upon by such eminent scholars as Tonnies, Durkheim, Weber, Simmel, and Parsons. Along with many lesser scholars, they have considered what we gained and what we lost when we left behind a social world held together by communal, primordial bonds, and adopted one based upon impersonal temporary agreements among individuals. Maine wrote Ancient Law to increase knowledge about the internal mechanics of developing societies. He felt a key objective was better understanding of how law develops over time. Failure to understand temporal processes in relation to legal development, he argues, leads to the creation of false dichotomies. The most important of these is the alleged division between the ancient and the modern, which Maine described as an "imaginary barrier" at which modern scholars feel they must stop and go no further. Maine's desire to breach this barrier led him to present this complex and richly nuanced analysis of legal evolution. This book will be of interest to historians, political philosophers, and those interested in the development of law.
