McCarran virtually blackmailed more than one attorneygeneral into carrying out his policies. From Capitol Hill to theUnited Nations, from union halls to Hollywood, McCarran's wrathbroke careers and lives and ultimately, in a self-destructive fit ofpique, cost his party control of the Senate. Ybarra's even-handednarrative shows that McCarran was ultimately half right: Therereally were Communists in Washington--but it was the hunt forthem that did the real damage.

Book excerpt: The Emergency Detention Act, Title II of the Internal Security Act of 1950, is the only law in American history to legalize preventive detention. It restricted the freedom of a certain individual or a group of individuals based on actions that may be taken that would threaten the security of a nation or of a particular area. Yet the Act was never enforced before it was repealed in 1971. Masumi Izumi links the Emergency Detention Act with Japanese American wartime incarceration in her cogent study, The Rise and Fall of America’s Concentration Camp Law. She dissects the entangled discourses of race, national security, and civil liberties between 1941 and 1971 by examining how this historical precedent generated “the concentration camp law” and expanded a ubiquitous regime of surveillance in McCarthyist America. Izumi also shows how political radicalism grew as a result of these laws. Japanese Americas were instrumental in forming grassroots social movements that worked to repeal Title II. Anglo-American institutions of intellectual property protect and restrict access to vast amounts of information. Ideas and expressions captured in music, movies, paintings, processes of manufacture, human genetic information, and the like are protected domestically and globally. The ethical issues and tensions surrounding free speech and information control intersect in at least two important respects. First, the commons of thought and expression is threatened by institutions of copyright, patent, and trade secret. While institutions of intellectual property may be necessary for innovation and social progress they may also be detrimental when used by the privileged and economically advantaged to control information access, consumption, and expression. Second, free speech concerns have been allowed to trump privacy interests in all but the most egregious of cases. At the same time, our ability to control access to information about ourselves--what some call "informational privacy"--is rapidly diminishing. Data mining and digital profiling are opening up what most would consider private domains for public consumption and manipulation. Post-9/11, issues of national security have run headlong into individual rights to privacy and free speech concerns. While constitutional guarantees against unwarranted searches and seizures have been relaxed, access to vast amounts of information held by government agencies, libraries, and other information storehouses has been restricted in the name of national security.

By contrast, a majority of southern Democrats remained as committed as ever to a traditional, segregationist ideology. Through the career of Senator James Eastland, one of the mid-century's most prominent politicians, author Maarten Zwiers explores the uneasy, yet mutually beneficial relationship between conservative southerners and the increasingly liberal party to which they belonged. Mississippi Democrat James "Big Jim" Eastland began an influential four-decade career in the United States Senate in 1941, ultimately rising to become president pro tempore of the Senate, a position that placed him third in the line of presidential succession. His reputation for toughness developed from his unfailing and ruthless opposition to greater civil rights and his concern over the global spread of communism, as he believed participants in the two movements were working together to undermine the American way of life. Zwiers contends that despite Eastland's extreme positions, he still managed to maintain influence through productive relationships with his Senate colleagues-liberal as well as conservative.
