Book excerpt: This study provides an impact analysis of federal regulations on foreign student enrollment at three distinct U.S. higher education institutions. The two major pieces of legislation affecting international study in the U.S. are the Immigration & Naturalization Act of 1952 and the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRAIRA). The INA is enveloped in IIRAIRA due to the latter amending the former. Thus, they are companion pieces of legislation that overlap and reinforce one another. Because of the public outcry following the events of September 11, both laws were amended by the Enhanced Border Security and Visa Entry Reform Act of 2002 and the USA Patriot Act of 2001. However, while the above acts are related to IIRAIRA, they do not significantly change the legislation. Thus, the major focus of this study is on IIRAIRA. In addition to providing an analysis of the impact of the policy regulations on foreign student enrollments, specific areas of impact will include the impact of the Student and Exchange Visitor Information System.

Book excerpt: International students contribute to America's scientific and technical research, bring international perspectives into U.S. classrooms, help prepare American undergraduates for global careers, and lead to longer-term business relationships. They have a considerable impact on the country's economy. In 2015, international students contributed $30.5 billion to the U.S. economy and supported 373,000 jobs. However, although the international students keep flowing into the country in steadily growing numbers, the rate of increase is much below the ratio of worldwide growth of international students, which means that international students choose to pursue higher education in other countries, as numerous competitors have emerged to seize a larger slice of the growing global marketplace of students. The present dissertation first sets the framework of the study. In the second step, it reviews the historical, social and administrative context of international mobile students and international student enrollment trends in U.S. colleges and universities, and analyzes the inbound mobility patterns over the three periods of years based on the data from OECD UIS and IIE Open Doors statistics. Having thus set a picture of the inbound mobility pattern, the study then reviews the laws and policies and political, social, and economic movements affecting the enrollment of the U.S. inbound international students--The Patriot Act, Homeland Security Act, Arab Spring, the 9/11, Eurozone Crisis, Brexit vote and other factors--in the third step. The fourth step is where the study tries to analyze the context and the factors and group them under legal issues, students' expectations and motivations, and factors affecting application. The dissertation concludes, in the fifth step, reviewing and presenting some recommendations.

Book excerpt: The purpose of this multi-case study was threefold: (a) to explore how Principal/Designated School Officials (P/DSOs) at Student and Exchange Visitor (SEVP)-certified urban community colleges make meaning of the international student regulatory environment; b) to provide a conceptual framework for understanding and explaining the practices and interventions for community college administrators to aid in improving immigration practices at community colleges; c) to propose practices and interventions for community college administrators and advisors to address the needs of international students served by the institution. This study explored how Principal/Designated School Officials (P/DSOs) interpret and make meaning of immigration regulatory environment. Historically, the United States has sought to maximize the talents and contributions of international students, export higher education, and take advantage of international students' presence here as a foreign policy asset. Higher education institutions have emerged as critical partners in advancing national security while serving international student populations and maintaining a balance between governmental reporting responsibilities and institutional (and student-related) responsibilities. United States' immigration laws and policies are constantly undergoing rapid and, in some instances, substantial changes that directly impact international students. These changing policies impact how P/DSOs, particularly in urban community colleges, enact and implement processes and procedures to keep international students in compliance. A Foucauldian knowledge-power theoretical framework was employed, situating federal regulations, institutional policy, and P/DSOs in a Panopticon of surveillance. Using qualitative methods, data was collected from in-depth interviews, and document analysis of federal documents pertaining to congressional committee meetings, regulatory documents, and legislative texts), NAFSA documents (opinion pieces, advocacy position statements and recommendations, research), newspaper and journal articles, and documents and materials from the community colleges being researched in the study relating to international student policies and procedures (including institutional websites). Themes that emerged include advocacy, fear, criminalization, prejudice, surveillance, and docile bodies. The findings document how immigration related regulations are interpreted and implemented.
