Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Historical Jurisprudence: An Introduction to the Systematic Study of the Development of Law Jurisprudence Should be regarded as more than a mere knowledge of the law. It is a science, which endeavors to ascertain the fundamental principles of which the law is the expression. It rests'upon the laws as established facts but at the same time it is a power in bringing the laws into a coherent system and in rendering all parts thereof subservient to fixed principles of justice. Although jurisprudence is based upon the laws as given facts, it is essentially a progressive science, inasmuch as the law which it endeavors to comprehend and systematize is progressive and aims with ever-closer approximation to approach the ideals of the race in which it Obta'ms. Juris prudence is So closely interwoven with the development and history of the world as to claim a place among the historical sciences. At the same time it is so closely con nected with - iin fact, springing from -a clearly felt ethical need, that it takes a place closely allied to that of ethical science. The connection which law has always held with morality is hardly less intimate than that which exists between its fundamental principles and those of ethics. Book excerpt: Excerpt from An Introduction to the History of Jurisprudence Bolingbroke has observed, that to enable one to take a commanding view of the field of Law and Legislation there are two principal vantage grounds on which it is necessary to mount - History and Metaphysics. The road is smooth and flowery to that vantage ground offered by History. There has been no want of those who have ascended to it, and taken post upon it. To that which belongs to the region of Metaphysics, the road is rugged and full of thorns. Few have attempted to gain it fewer have succeeded in placing themselves in a position whence a View at once clear and extensive could be obtained. Book excerpt: Excerpt from A History of English Law, Vol. 1 The first volume was begun in 1901, and the second and third volumes were finished in 1909. From 1909 to 1921 I have been writing the history of the law from 1485 onwards. I have, therefore, been engaged upon this History of English Law for twenty years; and necessarily both the material available for the study of the subject and my own knowledge have, in the course of that time, increased considerably. For both these reasons it has become clear to me that the first volume in its original form is quite inadequate, and that the second and third volumes need revision to bring them up to date. It has also become clear to me, as the work on the later volumes progressed, that the earlier volumes need revision in order that the whole work may form a complete and co-ordinated whole. Therefore, simultaneously with my work on the later volumes, I have been en aged on the work of the revision and co-ordination of t e earlier volumes. The first volume is a new book; and the second and third have been considerably added to and altered. The result' is a continuous History of English Law as a whole down. To 1700, and, in respect to some parts of the subject, down to modern times. The mode of treatment appears from the Plan of the History which will be printed at the begin ning of each of the volumes. Book excerpt: Excerpt from The Origin and Growth of the Common Law in England and America: A Study of Private Law, Comparing the Evolution of the Common Law and the Civil Law The work of Sir Henry Maine has to be supplemented bv subsequent investigators. But his illuminating maxim that legal progress has been through Procedure from Status to Contract will never be superseded. I have found in the principle underlying it the explanation which I was seek ing. In the Introduction is a discussion of what constitutes Status, and the book as a whole. Is a develop ment of the theme that law begins with Status and that the difference between the two leading systems is that while the Common Law has been a continuous growth of Contract, the Civil Law has been a gradual refinement of Status. Book excerpt: Excerpt from A History of English Law, Vol. 12 It ma be thought that I have dealt with the legal history 0 the eighteenth century at too great a length. But there are several reasons why I have found it necessary to fill three bulky volumes. In the first place, this is the first complete legal history of the eighteenth century which has ever been written. In the second place, to make that history intelligible it has been necessary to deal somewhat more fully than in the preceding periods with the political background. Book excerpt: Excerpt from A History of English Law, Vol. 11 In the first and introductory volume, which contains Book I of this History, I have related the history of the Judicial System down to the passing of the Judicature Act in 1875. In the eight succeeding volumes, which contain Books II-IV, I have described the sources and influences which shaped the development of English law down to 1700, and I have related both the history of English public law during the same period, and also the history of the principal doctrines of English private law, in some cases to 1700 and in others down to the nineteenth century. These three succeeding volumes begin Book V, the last Book of this History, in which I propose to relate the history of English law from 1700 to 1875. They begin Part I of this Book, and they relate the history of public law, and of the sources and influences which shaped the development of English law, during the eighteenth century. If I continue to have sufficient health and leisure, I hope in a succeeding volume to complete Part I of this Book, and in Part II to complete the History in two more volumes by giving some account of the history of those doctrines of English law with which I have not fully dealt in the preceding volumes. It may be thought that I have dealt with the legal history of the eighteenth century at too great a length. But there are several reasons why I have found it necessary to fill three bulky volumes. In the first place, this is the first complete legal history of the eighteenth century which has ever been written. In the second place, to make that history intelligible it has been necessary to deal somewhat more fully than in the preceding periods with the political background.
