Book excerpt: 57 million Americans, one-third of them children, qualify for free legal aid, but half or more who seek help are turned away because providers lack sufficient resources. Tens of millions more moderate-income Americans are ineligible for free legal aid, yet lack reliable access to an affordable lawyer. At the same time, state and local governments, nonprofit organizations, and law schools around the country are developing innovative approaches to addressing legal needs in their communities. This issue brief for the Center for American Progress suggests how the federal government can hasten these developments by promoting legal service delivery models that are backed by rigorous evidence of their effectiveness. Evidence-based approaches in civil legal assistance can help service providers target resources more efficiently and bolster the case for new investments by Congress and other funders to increase access to justice. With new leadership and initiative in key institutions, we recommend that the White House and Congress seize the opportunity to: • Establish a "National Access to Justice Institute" in the Justice Department to coordinate legal aid research through a partnership with the American Bar Foundation and the Legal Services Corporation; • Support state and regional centers for legal aid research to catalyze innovation and evaluation through collaboration between the new institute, state access-to-justice commissions, legal services providers, and law school clinics; and • Target federal funds to incentivize evidence-based legal aid delivery systems through competitive grants and market-based mechanisms.

Book excerpt: Online intake systems for civil legal aid can affect access to justice in two ways: (1) allowing new individuals access to civil legal aid who would not otherwise have had access if only the traditional intake methods were available and (2) allowing legal aid agencies to increase intake efficiency, thereby allowing them to serve more individuals overall with the same resources. To better assess the effects online intake systems might have in practice, this project conducts an evaluation of the online intake system for civil legal aid that New Mexico implemented in April 2016. Staff interviews, as well as analyses of administrative data, identified several implementation issues that indicated the online intake system likely did not result in efficiency gains in the intake process during the eight-month period this project evaluated. Usage of the online system was also low. Survey results indicated that a relatively small fraction of online applicants were new users who would not have been able to access legal aid without the online intake option. Due to contemporaneous staffing declines this project cannot identify how the number of individuals receiving services changed in response to the implementation of the online system. However, because there was no real improvement in intake efficiency during this period, it is unrealistic to expect to see any change in the number of individuals overall that receive service. Because the evaluation examined a short period after implementation, it is possible the usage and efficiency of the system will increase as the system matures.
