Book excerpt: Essay from the year 2016 in the subject Politics - Topic: Public International Law and Human Rights, , course: Human Rights, language: English, abstract: Conflicts and disputes are normal and natural in everyday life. Conflict is not an event; it is a process. Human beings face conflicts always and everywhere, at all levels (Galtung 1996). How conflicts are managed is what makes the difference. A common way disputes the world over are resolved is through litigation. Litigation however is often characterized by delays and other debilitating activities which adversely affect the conflict resolution process and accentuates the popular legal maxim ‘justice delayed is justice denied’. Litigation is also thought to be relatively expensive and too elitist. These undoubted flaws that surround litigation led to other means of conflicts resolution collectively termed Alternative Dispute Resolution or (ADR). The Legal Information Institute (LII, 2014) defines Alternative Dispute Resolution as any method of resolving disputes other than by litigation. Courts of competence jurisdiction could be directed to review the validity of Alternative Dispute Resolution methods, but they will hardly overturn decisions and awards proposed by ADR if the disputing parties formed a valid contract to abide by them. ADR methods or types include mediation, negotiation, conciliation, collaborative law and arbitration. ADR is arguably a much better option as all stakeholders in a conflict can resolve their own differences by working together to come up with an agreement that satisfies all parties involved. This write-up will however focus on one of the popular modes of ADR, called Arbitration. The write-up will look at a brief history of arbitration, the meaning of the term arbitration, its features and characteristics, types and forms, merits and demerits and most importantly how arbitration skills could be utilized to address human rights-related disputes, conflicts and matters.

Book excerpt: Excerpt from An Essay on Arbitration: More Particularly as It Relates to Commerce and Marine Insurance; With an Appendix on Forced Arbitration; A New Edition; In Which the Law and the Practice Are Brought Down to the Present Day The First Edition of this Essay was written under great inconveniences, as the author then resided abroad, and was, consequently, deprived of the advantages to be derived from the consultation of the law authorities, and from receiving the advice of his legal and commercial friends, which he should have felt it his duty, and consistent with his inclination, to have followed. From having himself practised for many years as an insurance and mercantile arbitrator, he is able to judge of the necessity of making the important subject which he has ventured to treat of more generally known and understood. Of this new Edition much has been re-written; and many additions have been made to the work, to bring the Law and the Practice, as far as concerns Commercial and Insurance Arbitration, down to the present day. This book was released on 2007 with total page 218 pages. Available in PDF, EPUB and Kindle. Book excerpt: First published in 1840, this was the first important statement on the preservation of peace through international mediation published in the United States. Anticipating the creation of the Permanent Court of International Justice and the League of Nations by a good 75 years, Ladd proposed an international "congress with legislative powers" that worked with a court that enforced its laws and settled international disputes. It became a central text for American peace organizations and participants in international law conferences, and did much to persuade Americans to accept the idea of an international peace organization. It was also distributed widely in Europe, where it was well-received. Ladd [1778-1841], a scholar and philanthropist, was the president of the American Peace Society. His essay was a contribution to a collection published by his society entitled Prize Essays on a Congress of Nations, For the Adjustment of International Disputes, And for the Promotion of Universal Peace Without Resort to Arms (1840).

Available in PDF, EPUB and Kindle. Book excerpt: Across a range of jurisdictions, in differing legal systems, mediation is achieving evergreater institutional and statutory force, and what not long ago was a marginal technique for dispute resolution is becoming mainstream and orthodox. But how firm a sense do we have about the social formation we call ‘mediation’? Through reflections and case histories, this distinctive collection of essays by experienced mediators from across the globe provides a clearer understanding than we have had heretofore of what mediation is and what it can offer as a practical, accessible and positive alternative in civil justice systems. The authors each address ways mediation has been or can be applied to dispute resolution in such pressing contexts as the following: • enduring and intense conflicts; • planning and environmental issues; • conflicts arising between refugee and ‘host’ communities; • elder care; • intercultural settings; • online communication; • science-based disputes; and • public policy disputes. The questions raised as to access to justice, identifying unmet needs, improving the provision of services, and fostering an ongoing conversation on mediation go well beyond the confines of commercial dispute resolution and the walls of courtrooms. Through the practical experiences described, useful and insightful perspectives emerge on the practice, principles and legitimacy of mediation. These invaluable reports and reflections on the powerful resources that mediation and mediators can bring to the table will be welcomed by a diversity of legal practitioners and jurists as well as academics.
