Available in PDF, EPUB and Kindle.

Available in PDF, EPUB and Kindle. Book excerpt: There have been extraordinary developments in the field of neuroscience in recent years, sparking a number of discussions within the legal field. This book studies the various interactions between neuroscience and the world of law, and explores how neuroscientific findings could affect some fundamental legal categories and how the law should be implemented in such cases. The book is divided into three main parts. Starting with a general overview of the convergence of neuroscience and law, the first part outlines the importance of their continuous interaction, the challenges that neuroscience poses for the concepts of free will and responsibility, and the peculiar characteristics of a “new” cognitive liberty. In turn, the second part addresses the phenomenon of cognitive and moral enhancement, as well as the uses of neurotechnology and their impacts on health, self-determination and the concept of being human. The third and last part investigates the use of neuroscientific findings in both criminal and civil cases, and seeks to determine whether they can provide valuable evidence and facilitate the assessment of personal responsibility, helping to resolve cases. The book is the result of an interdisciplinary dialogue involving jurists, philosophers, neuroscientists, forensic medicine specialists, and scholars in the humanities; further, it is intended for a broad readership interested in understanding the impacts of scientific and technological developments on people’s lives and on our social systems.

Book excerpt: From the tone of the report by the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Re search, one might conclude that the whole-brain-oriented definition of death is now firmly established as an enduring element of public policy. In that report, Defining Death: Medical, Legal and Ethical Issues in the Determination of Death, the President's Commission forwarded a uni form determination of death act, which laid heavy accent on the signifi cance of the brain stem in determining whether an individual is alive or dead: An individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions, or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead. A determination of death must be made in accordance with accepted medical standards ([1], p. 2). The plausibility of these criteria is undermined as soon as one confronts the question of the level of treatment that ought to be provided to human bodies that have permanently lost consciousness but whose brain stems are still functioning.

Available in PDF, EPUB and Kindle. Book excerpt: This book is a successor to J Griffiths, A Bood and H Weyers, Euthanasia and Law in the Netherlands (Amsterdam University Press 1998) which was widely praised for its thoroughness, clarity, and accuracy. The new book emphasises recent legal developments and new research, and has been expanded to include a full treatment of Belgium, where since 2002 euthanasia has also become legal. The book also includes descriptions written by local specialists of the legal situation and what is known about actual practice in a number of other European countries (England and Wales, France, Italy, Scandinavia, Spain, Switzerland). The book strives for as complete and dispassionate a description of the situation as possible. It covers in detail: - the substantive law applicable to euthanasia, physician-assisted suicide, withholding and withdrawing treatment, use of pain relief in potentially lethal doses, palliative and terminal sedation, and termination of life without a request (in particular in the case of newborn babies); -the process of legal development that has led to the current state of the law; -the system of legal control and its operation in practice; -the results of empirical research concerning actual medical practice. A concluding part deals with some general questions that arise out of the material presented: Is the legalisation of euthanasia an example of the decline of law or should it, on the contrary, be seen as part and parcel of the increasing juridification of the doctor-patient relationship? Does the Dutch experience with legalised euthanasia support the idea of a 'slippery slope' toward a situation in which life-especially of the more vulnerable members of society-is less effectively protected? Is it possible to explain and to predict when a society will decide to legalise euthanasia?

Available in PDF, EPUB and Kindle. Book excerpt: Over the last 10 years advances in the new field of neuromarketing have yielded a host of findings which defy common stereotypes about consumer behavior. Reason and emotions do not necessarily appear as opposing forces. Rather, they complement one another. Hence, it reveals that consumers utilize mental accounting processes different from those assumed in marketers' logical inferences when it comes to time, problems with rating and choosing, and in post-purchase evaluation. People are often guided by illusions not only when they perceive the outside world but also when planning their actions - and consumer behavior is no exception. Strengthening the control over their own desires and the ability to navigate the maze of data are crucial skills consumers can gain to benefit themselves, marketers and the public. Understanding the mind of the consumer is the hardest task faced by business researchers. This book presents the first analytical perspective on the brain - and biometric studies which open a new frontier in market research.

Book excerpt: The Italian original of this book, Che cos'è il diritto privato?, is widely recognized as an influential treatise on the basic methods of legal science, introducing the student to the main institutions and theories of Italian and European Private law, as well as to the basic ideas and principles related to the concept, function and purpose of Italian and European Private law. In translation, this book thus provides any reader with the perspective of the Italian student of law on the ideas that have shaped legal practice in Italy and on the continent of Europe. Its unique value lies in the fact that it is not a gloss, not secondary literature, not an interpretation and not a summary--it is a direct, primary source made available to readers in the English language for the first time. This book is part of the Comparative Legal Thinking Series, edited by Kirk W. Junker, Associate Profesor of Law & Director of International Programs, Duquesne University School of Law.

Available in PDF, EPUB and Kindle. Book excerpt: Will understanding our brains help us to know our minds? Or is there an unbridgeable distance between the work of neuroscience and the workings of human consciousness? In a remarkable exchange between neuroscientist Jean-Pierre Changeux and philosopher Paul Ricoeur, this book explores the vexed territory between these divergent approaches--and comes to a deeper, more complex perspective on human nature. Ranging across diverse traditions, from phrenology to PET scans and from Spinoza to Charles Taylor, What Makes Us Think? revolves around a central issue: the relation between the facts (or "what is") of science and the prescriptions (or "what ought to be") of ethics. Changeux and Ricoeur ask: Will neuroscientific knowledge influence our moral conduct? Is a naturally based ethics possible? Pursuing these questions, they attack key topics at the intersection of philosophy and neuroscience: What are the relations between brain states and psychological experience? Between language and truth? Memory and culture? Behavior and action? What is a mental representation? How does a sign relate to what it signifies? How might subjective experience be constructed rather than discovered? And can biological or cultural evolution be considered progressive? Throughout, Changeux and Ricoeur provide unprecedented insight into what neuroscience can--and cannot--tell us about the nature of human experience. Changeux and Ricoeur bring an unusual depth of engagement and breadth of knowledge to each other's subject. In doing so, they make two often hostile disciplines speak to one another in surprising and instructive ways--and speak with all the subtlety and passion of conversation at its very best.

Available in PDF, EPUB and Kindle. Book excerpt: Sergio Moravia's The Enigma of the Mind (originally published in Italian as L'enigma della mente) offers a broad and lucid critical and historical survey of one of the fundamental debates in the philosophy of mind - the relationship of mind and body. This problem continues to raise deep questions concerning the nature of man. The book has two central aims. First, Professor Moravia sketches the major recent contributions to the mind/body problem from philosophers of mind. Having established this framework Professor Moravia pursues his second aim - the articulation of a particular interpretation of the mental and the mind-body problem. The book's detailed and systematic treatment of this fundamental philosophical issue make it ideal for upper-level undergraduate and graduate courses in epistemology and the philosophy of mind. It should also prove provocative reading for psychologists and cognitive scientists.
