Book excerpt: In view of the risk posed by the improper handling of hazardous waste, the extensive international, European and national regulations on the transboundary shipment of waste aim to prevent the shipment of hazardous waste in particular to countries that do not have the appropriate capacities for environmentally sound disposal. This guidebook is based on the valuable experience of the expert Dr. Joachim Wuttke, who was head of the Basel Convention Focal Point at the German Federal Environment Agency for many years, as well as on seminar materials he prepared as a speaker on transboundary waste shipments for various seminar organisers. The handbook is therefore intended to support all interested parties and those involved in authorities, industry and society in the application and implementation of the extensive international regulations on transboundary waste shipments. In addition to all relevant legal provisions, it contains a number of practical aids, especially on waste classification. An explanatory text at the beginning of the book explains the interrelationships and the most important legal regulations in a practical manner. This compilation of information provides waste producers, exporters and disposers with a good knowledge base and can contribute to the successful implementation of the legal regulations, the avoidance of illegal waste shipments and the support of enforcement.

Book excerpt: This study provides an in-depth analysis of the Hong Kong Ship Recycling Convention as adopted in May 2009 and a thorough analysis of the overall status quo of ship recycling regulations. It investigates the lack of sufficient ratifications of the Convention from both a legal and an economic perspective. The first part of the study focuses on the history of the Convention’s entry-into-force provision and the rationale behind it. Due to the fact that this provision provides a considerable additional obstacle to the Convention’s becoming legally binding, in the second part the focus of the work shifts to unilateral action in this field. An overview of the legal environment of European ship recycling legislation is followed by an analysis and evaluation of a number of proposals by the European Commission attempting to tackle the problems of current ship recycling procedures. With a particular emphasis on (planned) European measures in this regard, the analysis’ overall message is one of cautious optimism.

It then elaborates on the concept and practices of zero waste, discussing about the relationship between zero waste and eco-design, and about relative international standards. At last, it points out that zero waste could be the pathway from linear economy to circular economy, backed up by theories and practices. This book offers a clear direction for companies and organizations about environment. It can also be used as a sustainable development strategy handbook for executives in companies and organizations.

Available in PDF, EPUB and Kindle. Book excerpt: Unconventional Lawmaking in the Law of the Sea explores the ways that actors operating at the international level develop standards of behaviour to regulate varied maritime activities beyond traditional lawmaking. Other than conventions and customary international law, there is a plethora of international agreements that influence international conduct. This 'soft law' or 'informal law' is now prolific in ocean governance, and so it is time to consider its significance for the law of the sea. This monograph brings together women law-of-the-sea scholars with expertise in specific areas of the law of the sea, as well as international law more generally. Informal lawmaking is examined in relation to ocean resources, maritime security, shipping and navigation, and the marine environment. In each instance, there are reflections on the diverse actors, processes, and outputs shaping the regulation of the oceans. The analyses in this book further consider what this activity means within the rules on the sources, formation, and interpretation of international law. The growing reliance on informal agreements to fill legal gaps provides quick responses to pressing matters. We must assess and understand these new forms of cooperation in order to influence existing treaties or customary international law. Unconventional Lawmaking in the Law of the Sea surveys the scope of informal lawmaking in the law of the sea and evaluates the significance of this activity for the UN Convention on the Law of the Sea, as well as for ocean governance more broadly, now and in the future.

Available in PDF, EPUB and Kindle. Book excerpt: With the Stockholm+50 Conference, held on 2-3 June 2022, the global movement to protect the environment has reached a 50 year milestone. The first UN Conference on the Human Environment, also held in Stockholm, from 5-16 June 1972, proved to be the watershed in addressing this problem, and as the world assembles once more in the Swedish capital it is time to think aloud and look ahead. In his address in 1972, the then Swedish Prime Minister Olof Palme said: “The decisive question is in which direction we will develop ... there is no individual future, neither for people nor for nations.” The only other head of government to attend in 1972, Indian Prime Minister Indira Gandhi, highlighted the development as “one of the primary means of improving the environment of living, of providing food, water, sanitation and shelter, of making the deserts green and mountains habitable” and drew attention to the wisdom of the Atharva Veda: “What of thee I dig out; Let that quickly grow over; Let me not hit thy vitals or thy heart." As we look back over 50 years, we need to assess what has gone wrong in the trajectory travelled so far and look ahead to the future of our environment at this juncture and beyond. As a scholarly journal for global decision-makers, Environmental Policy and Law has sought to envision what lies ahead in the 21st century by inviting outstanding scholarly works from around the world. The 22 articles which resulted from this invitation are presented in this book, Envisioning Our Environmental Future, which is organised in three parts: Testing Times; Global Ideas; and Sectoral Ideas. The book is a sequel to Our Earth Matters (IOS Press), which was published on 5 June 2021. Bharat H. Desai is Professor of International Law and Jawaharlal Nehru Chair in International Environmental Law at the Centre for International Legal Studies, School of International Studies of Jawaharlal Nehru University, New Delhi. He is Editor-in-Chief of the global journals Environmental Policy and Law (Amsterdam: IOS Press) and Yearbook of International Environmental Law (Oxford: Oxford University Press). Prof. Desai’s ideas and proposals are reflected in his published books and in journals of international repute.

Available in PDF, EPUB and Kindle. Book excerpt: As conflict and cooperation among states turn to an ever greater extent on economic issues, this fully updated and expanded second edition presents a comprehensive exploration of the legal foundations of the international economy. It not only examines the current status of the law, but also explores the origins, political tensions and development of outcomes that are often difficult to comprehend. Lowenfeld examines the major elements of economic law in the international arena including the World Trade Organization and its antecedents; dumping, subsidies, and other devices that alter the market; the International Monetary System, including the collapse of the Bretton Woods system; the debt of developing countries; the law of foreign direct investment, including changing perceptions of the rights of host states and multinational enterprises; and economic sanctions. The book also contains chapters on competition law, environmental law, and new chapters on intellectual property and the various forms of arbitration; demonstrating how these subjects fit into the framework of international economic law. Professor Lowenfeld brings to his task a lifetime of practice and teaching experience to produce a book that will be of use to international lawyers and non-specialists alike.

The elders, and others, for climate justice and urgent action, and convenes insights from leading legal and institutional experts, professors, professionals and early career scholars on emerging climate law and policy challenges, commitments and solutions. The collection explores the role of law and governance in scaling up global responses to climate change and advancing sustainability. Analytical chapters by leading experts, practitioners and scholars close to ongoing climate negotiations explore recent legal and institutional innovations related to climate change which can support implementation and compliance with the Paris Agreement and advance the global Sustainable Development Goals (SDGs). They highlight ways to raise ambition through law and policy, to reform national legal and institutional arrangements to implement NDCs and to further develop international law and governance in the face of the existential threat of climate change and the world: sustainable development commitments. Presenting a pathway for advancing climate ambition in the coming decades, this book will be of interest to government officials, academics, students, professionals and policy makers working in the area of climate law and governance.

Available in PDF, EPUB and Kindle. Book excerpt: Environmental law and policy in India affects all sections of society. Those most deeply affected by it are the poor. They are the first victims of poor sanitation, polluted air, and contaminated water. Since the 1970s, efforts to protect environmental quality have met with limited success, posing enduring challenges for policy designers and decision-makers entrusted with protecting and preserving natural resources. This edition of Environmental Law and Policy retains the familiar analytical structure of the second edition and includes all major developments since then. It focuses on Indian environmental law, policies, problems, and needs with the comprehensiveness of an American law case book, compiles all the leading cases in environmental law in India with concise extracts of landmark judgments and policy documents, and provides discussions on projects which could potentially degrade the environment. This volume also covers air and water pollution, forests, wildlife, noise pollution, common property resources and tribal communities, environmental impact assessment, coastal regulations, large projects, urban problems, the National Green Tribunal, hazardous substances, transnational environmental policies, and international environment law. It is interlaced with notes, comments, and questions intended to encourage critical thinking amongst lawyers and law students.

Book excerpt: One hundred years ago, the world celebrated the opening of the Panama Canal, which connected the world’s two largest oceans and signaled America’s emergence as a global superpower. It was a miracle, this path of water where a mountain had stood—and creating a miracle is no easy thing. Thousands lost their lives, and those who survived worked under the harshest conditions for only a few silver coins a day. From the young "silver people" whose back-breaking labor built the Canal to the denizens of the endangered rainforest itself, this is the story of one of the largest and most difficult engineering projects ever undertaken, as only Newbery Honor-winning author Margarita Engle could tell it.
