Book excerpt: Under U.S. domestic law and treaty practice, all international agreements concluded by the United States, regardless of their form, designation or title are divided into treaties, which are submitted to the Senate for its advice and consent to ratification, and other international agreements. Treaties which are submitted to the Senate are similar to federal laws, and their legislative history is much the same as the one followed by legislation, except that it is confined to proceedings in the Senate only. This legislative history follows the procedures established by the Senate, and it is based on primary legislative sources. The main part is arranged chronologically by the date of conclusion of the treaty. Each treaty contains the following components: it provides general information about the treaty; it lists chronologically steps taken by the Senate during the treaty approval process; legislative implementation, executive action, following Senate approval; entry into force, and annotations, such as references to related treaties, amendments, and present status. Herein lies the role of subsequent practice as a key tool for treaty change. Subsequent practice-a well-established means of treaty interpretation-sometimes diverges from the original treaty provision to such an extent that it can no longer be said to constitute an act of interpretation or application. Rather, it becomes, in effect, one of treaty modification. The modification of treaties by subsequent practice extends to all fields of international law, from the law of the sea, environmental law, and investment law, to human rights and humanitarian law. Such modifications can have significant practical consequences, from revising or creating new rights and obligations, to establishing new institutional mechanisms. Determining when and how treaty modification by subsequent practice occurs poses difficulty to legal scholars and dispute settlement bodies alike, and impacts States' expectations as to their treaty obligations. This significant yet underexplored process is the focus of this book. Modification of Treaties by Subsequent Practice proves that subsequent practice can-under carefully defined conditions that ensure strict accordance with the will of the treaty parties-alter, supplement, and terminate treaty provisions or even entire treaty frameworks. It can also generate customary law and fuel regime interaction. Ultimately, this book demonstrates the relevance and dynamism of the process of treaty modification by subsequent practice, emphasizing the need to deal with the issue head on, and explains-on a theoretical and practical level-how it can be identified and dealt with more consistently in the future. The book thus contributes to a deeper understanding of the process of treaty modification by subsequent practice and its continued role in striking the judicious balance between the stability of treaties on the one hand, and the organic evolution of the law on the other.

Book excerpt: The destruction of the ozone layer, together with global warming, is one of the hot environmental topics of today. This book examines the effect of human activities on atmospheric ozone, namely the increase of tropospheric ozone and the general diminution of stratospheric ozone and the production of the Antarctic ozone hole. Also discussed is the role of remote sensing techniques in the understanding of the effects of human activities on atmospheric ozone as well as in the development of social and political awareness of the damage to the ozone layer by man-made chemicals, principally CFCs. This led to the formulation and ratification in 1989 of the Montreal Protocol on controlling/banning the manufacture and use of chemicals that damage the ozone layer. Since then, remote sensing has played a key role in monitoring atmospheric ozone concentration and determining the success of the Montreal Protocol in protecting the ozone layer from further damage. In this book, the renowned authors discuss the sophisticated instruments that have been launched into space to study not only ozone but also other trace gases in the atmosphere, some of which play a key role in the generation and destruction of ozone in the atmosphere. Professors Cracknell and Varotsos also examine the satellite-flown instruments which are involved in monitoring the absorption of solar ultraviolet light in the atmosphere in relation both to the generation and destruction of ozone and consequently to human health. This scholarly book, written by the foremost experts in the field, looks at remote sensing and its employment in the various aspects of ozone science. It is widely acknowledged that global warming, due to anthropogenic greenhouse gases emissions, represents a threat to the sustainability of human life on Earth. However, many other threats are potentially just as serious, including atmospheric pollution, ozone depletion, water pollution, the degradation of agricultural land, deforestation, the depletion of the world's mineral resources and population growth.
