A wide variety of methods is open to the non-litigious, including resort to Ombudsmen, negotiation, small claims courts and mini-trials; these and other options receive detailed attention. Given the newness of ADR as a discipline, questions about the training of mediators and about the role of central government have not yet been resolved. The final section of the book is devoted to discussion of these issues. Case studies are drawn from the international arena - examples from China, Canada, Australia, Germany and North America place ADR in a cultural and historical perspective.

Book excerpt: The theoretical underpinnings of public international law have taken the sovereign status of the nation-state for granted since the beginning of the modern era. After centuries of evolution in legal and political thought, the state's definition as a bounded territorial unit has been strictly codified. The legal development of the nation-state was an ideological project informed by extra-legal considerations. Additionally, the ever-narrowing scope of the juridical idea of sovereignty functioned as a boundary mechanism instrumental in colonising Africa and other regions. While international law claims universal liberalism today, the current system based on sovereign nation-states represents not social inclusion but fierce and dangerous exclusion. The central thesis of this book is that the development of legal sovereignty was, rather than part of the modernist progress narrative, a historically contingent evolutionary regression. While other social systems such as economics and science became globalised, politics and law counterintuitively became more territorialised. It is argued that the nation-state today is not only anachronistic but is dangerously ill-equipped for facing international problems such as the climate crisis or global pandemics. Finally, it also leaves African states and many other formerly-colonised territories at a particular disadvantage by regulating their political practices into a predefined mould.

This became evident with the help of computer models of deterministic-recursive systems in which simple mathematical equation systems provide an extremely complex behavior. (2) Irregularity of nature is not treated as an anomaly but becomes the focus of research and thus is declared to be normal. One looks for regularity within irregularity. Non-equilibrium processes are recognized as the source of order and the search for equilibrium is replaced by the search for the dynamics of processes. (3) The classical system-environment model, according to which the adaptation of a system to its environment is controlled externally and according to which the adaptation of the system occurs in the course of a learning process, is replaced by a model of systemic closure. This closure is operational in so far as the effects produced by the system are the causes for the maintenance of systemic organization. If there is sufficient complexity, the systems perform internal self-observation and exert self-control (»Cognition« as understood by Maturana as self-perception and self-limitation, e. g. , that of a cell vis-a. -vis its environment). 22 But any information a system provides on its environment is a system-internal construct. The »reference to the other« is merely a special case of »self-reference«. The social sciences frequently have suffered from the careless way in which scientific ideas and models have been transferred.
