Book Synopsis International Agreements between Non-State Actors as a Source of International Law by : Melissa Loja
Download or read book International Agreements between Non-State Actors as a Source of International Law written by Melissa Loja and published by Bloomsbury Publishing. This book was released on 2022-09-22 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines whether international agreements between non-state actors can be identified as a source of international law using objective criteria. It asks whether, beyond Article 38 of the Statute of the International Court of Justice, there is a system of rules, processes, beliefs or semantics by which these agreements can be objectively identified as a source of international law. Departing from the more usual state-centric analysis, it adopts postmodern legal positivism as its analytical tool. This allows for the reality that international law-making takes place in subjective social landscapes. To test the effectiveness of this approach, it is applied to agreements between petroleum agencies and corporations which allow two or more states to exploit disputed resources across boundaries looking in particular at arrangements involving China, Vietnam and the Philippines. By so doing it illustrates an alternative way that states can manage disputes, without having to resort to conflict. It will appeal to both scholars and practitioners of public international law, as well as civil servants.

Book excerpt: First published in 1990. A country’s development does not take place in a vacuum and it was therefore essential in this earlier work that the main subject (the Kingdom of Saudi Arabia’s development) should be set into an historical, political and social context. The original edition includes a summary of this background information, starting with the Kingdom’s geographical location and proceeding with a brief account of its history, its political importance and its role in the world economy. Within this context, is described the development and progress of what the Kingdom had achieved, outlining the country’s governmental structure, its administrative divisions, its available investment potential, its prevailing legal and commercial regulations, and its future plans and ambitions. This new book, which has been structured to encompass all aspects of the Kingdom’s development, contains the latest statistical data on the Kingdom’s progress, together with the newly revised background information of the former book. Thus each of the books complements the other, for each records the relevant information at a particular stage in the Kingdom of Saudi Arabia’s continuing developmental process.

Book Synopsis The Promoting and Licensing of Petroleum Prospective Acreage by : Michael Bunter
Download or read book The Promoting and Licensing of Petroleum Prospective Acreage written by Michael Bunter and published by Kluwer Law International B.V.. This book was released on 2002-01-17 with total page 410 pages. Available in PDF, EPUB and Kindle. Book excerpt: This detailed work is based on more than ten years experience in conducting tenders for the licensing of petroleum prospective acreage on behalf of a number of sovereign governments in Europe, Africa and the former Soviet Union. It explains the processes of licensing from the points of view of the two main protagonists, the government bodies and the international oil companies. The book also gives due prominence to the interests of the host communities and to the environment, as well as to the neighbouring states and the other participants who may be affected by the licensing process. In the modern world petroleum licensing takes place in the full glare of attention from the press and from public opinion. This work breaks new ground in recommending ways in which government and the oil companies may devise best practice in licensing to serve the interest of all parties and also an ethical business environment.

Book Synopsis Stabilization Clauses in International Investment Law by : Jola Gjuzi
Download or read book Stabilization Clauses in International Investment Law written by Jola Gjuzi and published by Springer. This book was released on 2018-12-05 with total page 585 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyzes the tension between the host state’s commitment to provide regulatory stability for foreign investors – which is a tool for attracting FDI and generating economic growth – and its evolving non-economic commitments towards its citizens with regard to environmental protection and social welfare. The main thesis is that the ‘stabilization clause/regulatory power antinomy,’ as it appears in many cases, contradicts the content and rationale of sustainable development, a concept that is increasingly prevalent in national and international law and which aims at the integration and balancing of economic, environmental, and social development. To reconcile this antinomy at the decision-making and dispute settlement levels, the book employs a ‘constructive sustainable development approach,’ which is based on the integration and reconciliation imperatives of the concept of sustainable development as well as on the application of principles of law such as non-discrimination, public purpose, due process, proportionality, and more generally, good governance and rule of law. It subsequently re-conceptualizes stabilization clauses in terms of their design (ex-ante) and interpretation (ex-post), yielding stability to the benefit of foreign investors, while also mitigating their negative effects on the host state’s power to regulate.
