This book was released on 2009-06-18 with total page 142 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report finds that relations between the United Kingdom and the Republic of Ireland are closer than has ever been the case and that co-operative arrangements in place in the spheres of policing and law enforcement have never run more smoothly or been more effective in countering crime and bringing its perpetrators to justice. The border provides considerable opportunities for the highly experienced and inventive organised criminal gangs, frequently arisen from paramilitary groupings, that have blighted Northern Ireland's life for several decades. Criminals exploit the room opened for them by the border, such as the jurisdictional issues that arise out of having two systems of law and law enforcement operating in an area so criss-crossed with roads, streams and other crossing points. The inquiry has found many good examples of work done by the law enforcement agencies on both sides of the border. The value of institutional contacts between organisations such as the PSNI and An Garda Siochana is inestimable. Chapters in the report cover: policing and co-operation; criminal justice and co-operation; areas for closer co-operation (including scope for legislative change and sex offenders and public safety).

Book excerpt: The Brexit vote for UK withdrawal from the EU has put the constitutional future of Northern Ireland centre-stage once again. Beyond the Border is an authoritative, timely and up-to-date guide to the provisions of the Good Friday Agreement. A compelling and accessible exploration of how the Agreement can be upheld despite Brexit uncertainties, and implemented despite political deadlock, it powerfully argues for the permanence of the Agreement and its cross-community approach, even in the event of the achievement of Irish unity. It comprehensively explains the radical implications of the principle of parity of esteem between the traditions and how the conflicting aspirations of nationalists and unionists can be accommodated. At a time of seismic constitutional transition it outlines the milestones on the pathway to a united Ireland by consent as envisaged by the Agreement. The Good Friday Agreement was endorsed by 71 per cent of voters in Northern Ireland and by 94 per cent in the rest of Ireland. Despite huge difficulties in implementation, this book contends that the Agreement remains a cornerstone of Ireland’s constitutional settlement. Beyond the Border is a vital and objective exploration of how the Agreement provides a peaceful path towards resolving Ireland’s ultimate constitutional dilemma.

Book excerpt: The report EU Police and Criminal Justice Measures: The UK's 2014 Op-out Option (HL 159) examines the consequences to the UK should the Government choose to opt-out of approximately 130 EU police and criminal justice measures, that were adopted before the Treaty of Lisbon in 2009. The European Arrest Warrant (EAW) is the single most important pre-Lisbon police and criminal justice measure and, if the Government decides to exercise the opt-out, the Committee recommends that it should opt back in to the EAW immediately, to avoid any gap in its application. The Committee also expresses particular concern about the potential impact that the opt-out, including the loss of the EAW, could have on efforts by the UK and Ireland to effectively tackle cross-border crime, and does not believe that possible alternatives to the EAW would be adequate. The Committee concludes that the Government has not made a convincing case to opt-out and that to do so would h

Book excerpt: This report examines the arrangements in place for communication between the UK Government and Scottish Executive, particularly when the UK Government formulates international policy which will specifically affect Scottish interests and devolved matters. Generally there are effective channels of communication at both ministerial and official level between the two governments. Whitehall tends to overlook the Scottish angle of policy and legislation more often in those departments which are unfamiliar with devolved matters. We recommend that the Government ensures that each department has a devolution champion to ensure that there is a good level of awareness of devolution issues. The revival of the Joint Ministerial Committee should provide an important forum for discussion between Ministers of the UK Government and devolved administrations. However, there is little opportunity for parliamentary scrutiny of the outcomes and effectiveness of the Committee's meetings. The report welcomes the publication of the new Protocol for Avoidance and Resolution of Disputes as the 2001 Memorandum of Understanding did not provide adequate guidance on how disputes between the UK and Scotland should be resolved. This was demonstrated during the communications between the governments on the UK's negotiations with Libya on the Prisoner Transfer Agreement. Both Governments should display the necessary political will to ensure that both understand each other's point of view and demonstrate the mutual respect which should characterise all their dealings.

Available in PDF, EPUB and Kindle. Book excerpt: This book deals with the cartel offence introduced into UK law by the Enterprise Act 2002. It is now, for the first time, a criminal offence to operate certain cartel arrangements in the UK, and those found guilty of the offence face the prospect of fines and/or imprisonment. This presents new challenges for competition lawyers, who may not have expertise in criminal law, and criminal lawyers who are unlikely to have expertise in the complex substantive issues raised by competition law. This book addresses these issues, providing a guide to the workings of the provisions, explanations of the definitions set out in the Act, and an analysis of the relationship of the new offence with the existing UK and EC competition law. Human rights issues and practical considerations in the application of the relevant procedural law are also dealt with. Relevant OFT guidance and statutory provisions are published in the Appendix.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides new insights into police cooperation from a comparative socio-legal perspective. It presents a broad analysis of comparable police cooperation strategies in two systems: the EU and Australia. The evolution of regulatory trends and cooperation models is analysed for both systems and possible transferable strategies identified. Drawing on interviews with practitioners in the EU and Australia this book highlights a number of areas where the EU can be compared to a federal system and addresses the advantages and disadvantages of being a Union or a federation of states with a view to police cooperation practice. Particular topics addressed are the evolution of legal frameworks regulating police cooperation, informal cooperation strategies, Joint Investigation Teams, Europol and regional cooperation. These instruments foster police cooperation, but could be improved with a view to cooperation practice by learning from regulatory techniques and practitioner experiences of the respective other system.

Available in PDF, EPUB and Kindle. Book excerpt: The Trade & Cooperation Agreement (TCA) is the treaty which regulates free trade and economic arrangements between the European Union (EU) and the United Kingdom (UK) post-Brexit. The treaty entered into force provisionally on 1 January 2021 and officially on 1 May 2021, and has governed trade relations between the parties since. This book brings together contributions by leading scholars in EU and international trade law, economics and political science to provide a comprehensive, interdisciplinary analysis of the TCA. It contextualizes the treaty and identifies several emerging political, economic, and security challenges, which serve as the background to evolving EU-UK relations. The book also unpacks the treaty's complex provisions on customs and rules of origin, investments, services and procurement, subsidies, fisheries, aviation, cooperation on energy, environment, health, social security, and on UK participation in EU programs. Furthermore, it provides an updated assessment of EU-UK disagreement on the implementation of the Protocol on Ireland/NI, and considers the positive impact of the Windsor Framework in rebuilding trust between the parties, and the possibilities to further expand EU-UK cooperation within the TCA and beyond. Available in PDF, EPUB and Kindle. Book excerpt: Organised crime covers a wide range of activities, including drug trafficking, illegal trafficking of people, and fraud. The existence of a land border does not impede these operations; instead in many cases it is used to their advantage. In response, law enforcement strategies must include a transnational, multi-agency approach. This book critically analyses the extent to which Northern Ireland and the Republic of Ireland have been successful in implementing effective action against transnational organised crime. It explores the adoption of key law enforcement strategies and measures in these jurisdictions, and evaluates how regional (EU law) and international (UN Convention) standards have been implemented at the national level. Drawing on interviews with over 90 stakeholders including the Department of Justice Northern Ireland, the Department of Justice and Equality in Ireland, the Police Service of Northern Ireland and An Garda Síochána, Tom Obokata and Brian Payne discuss the factors affecting the effective prevention and suppression of organised crime, particularly in relation to cross-border cooperation. In exploring challenges of transnational crime and cooperation, this book will be of great use to students and researchers in international and transnational criminal law, criminology, and crime prevention.

Book excerpt: This is the third book in the series Shared Responsibility in International Law, which examines the problem of distribution of responsibilities among multiple states and other actors. In its work on the responsibility of states and international organisations, the International Law Commission recognised that attribution of acts to one actor does not exclude possible attribution of the same act to another state or organisation. Recognising that the applicable rules and procedures for shared responsibility may differ between particular issue areas, this volume reviews the practice of states, international organisations, courts and other bodies that have dealt with the issue of international responsibility of multiple wrongdoing actors in a wide range of issue areas, including energy, extradition, investment law, NATO-led operations and fisheries. These analyses jointly assess the fit of the prevailing principles of international responsibility and provide a basis for reform and further development of international law.

Available in PDF, EPUB and Kindle. Book excerpt: Scholarly interest in the study of state borders and border regions is growing in Europe, keeping pace with the remarkable changes associated with the transformation of old borders and the creation of new ones in the European Union and beyond over the last fifteen years. Social scientists have increasingly examined cross-border co-operation as one way to understand the changes which affect European borderlands. Ironically, given the recent turn to issues of culture and identity in the social sciences, one of the most neglected aspects of the critical and comparative analysis of cross-border co-operation has been culture. Culture and Cooperation in Europe's Borderlands, the first collection of essays to provide multidisciplinary perspectives on these issues in European borderlands, presents three modes of analysis of culture and cross-border co-operation as a tentative way forward to redress this imbalance. These overlapping perspectives, on cultures of co-operation, co-operation about culture, and the impact of culture on forms of co-operation, are offered as possible strategies in the comparative social science of European borderlands. The contributions to this collection examine some or all of the following: - cross-border cooperation about culture, in such areas of culture as tradition, language use and rights, and education. - cross-border cooperation and culture, i.e., in ways in which ‘culture’ enhances or hinders economic and political co-operation across state borders, as for example, through issues of national, regional and local identity, cultural practices, and ethnic relations. - the culture of cooperation, i.e., ways in which co-operation across borders creates new cultural codes, political practices, organizational cultures and transnational social and political institutions.
